TRUSHA PATEL AGP for Appellant(s) : 1 -\n2. \nMR VIMAL M PATEL for Defendant(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/09\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThese<br \/>\nappeals are directed against the judgment and award dated 01.12.1998<br \/>\npassed by the learned Extra Assistant Judge, Junagadh in Land<br \/>\nReference Case Nos.246\/1988 to 258\/1988 whereby, the said reference<br \/>\ncases were partly allowed.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the appellant   State proposed to acquire<br \/>\nthe lands situated in Vilage Shobhavadala [Laskar], Taluka Visavadar,<br \/>\nDistrict Junagadh, belonging to the respondent   claimants, for<br \/>\ngeneral purpose, under the provisions of the Land Acquisition Act,<br \/>\n1894. On completion of all the legal formalities, the L.A.O. passed<br \/>\nhis award dated 12.09.1986. Being aggrieved by the said award, the<br \/>\nclaimants preferred applications before the authority requesting to<br \/>\nrefer the issue to the competent Court for adjudication, which,<br \/>\nultimately, came to be numbered as References. The Court below, after<br \/>\nappreciating the evidence on record, partly allowed the said<br \/>\nreferences. Hence, these appeals.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The reference Court has adopted the yield method for<br \/>\ncomputing the amount of compensation and accordingly, deducted 50% of<br \/>\nthe amount towards cultivation expenses and adopted a multiplier of<br \/>\n10 years for ascertaining the market value of the acquired lands,<br \/>\nwhich is in consonance with the law laid down by the Hon&#8217;ble Apex<br \/>\nCourt as well as this Court.  Hence, I do not find any reasons to<br \/>\ndisturb the findings recorded by the Court below qua the same. I am<br \/>\nin complete agreement with the reasonings given by the Court below<br \/>\nwhile recording the said findings.\n<\/p>\n<p>4.\tHowever,<br \/>\nso far as the calculation of compensation for fruit-bearing trees in<br \/>\nL.A. Case No.255 of 1988 is concerned, the same deserves interference<br \/>\nin view of the fact that the claimant himself has stated in his<br \/>\ndeposition before the reference Court that the total production of<br \/>\nMangoes was 500 Kg. and that the price per Kg. was Rs.250\/-. On that<br \/>\nbasis, the annual income would come to Rs.750 and if 20% thereof is<br \/>\ndeducted, the balance would come to Rs.600\/- and Rs.60,000\/- for 10<br \/>\nMango trees. So far as Rayana trees are concerned, the claimant has<br \/>\nstated that the total production was 40 Kg. and that the price per<br \/>\nKg. was Rs.2\/-. Therefore, for two Rayana trees, the claimant will be<br \/>\nentitled for Rs.1,280\/-. In all, the claimants in F. A.<br \/>\nNo.4473\/2007would be entitled for Rs.61,280\/- for the fruit-bearing<br \/>\ntrees apart from other benefits awarded by the reference Court.<br \/>\nHence, the impugned award of the reference Court is required to be<br \/>\nmodified accordingly.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, F.A Nos. 4464\/2007 to 4472\/2007 and 4474\/2007 to<br \/>\n4476\/2007 are dismissed. First Appeal No.4473\/2007 is partly allowed<br \/>\nto the extent that the original claimants will be entitled for<br \/>\nRs.61,280\/- for the fruit-bearing trees and other benefits as awarded<br \/>\nby the reference Court. The impugned award of the reference Court<br \/>\nstands modified accordingly. The appeals stand disposed of. No order<br \/>\nas to costs. The civil applications also stand disposed of<br \/>\naccordingly.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
