SRI RAKESH KUMAR, EXECUTIVE ENGINEER           BUILDING\n                CONSTRUCTION DIVISION, BHAGALPUR\n\n2   24.6.2010<\/pre>\n<p>                 Petitioner&#8217;s prayer is for quashing of the part of the<\/p>\n<p>                   order No.40 dated 10.10.2009 passed by the Superintending<\/p>\n<p>                   Engineer, Building Construction Department, Bhagalpur,<\/p>\n<p>                   whereby his pay fixation on account of granting first<\/p>\n<p>                   Assured Career Progression with effect from 9.8.1999 has<\/p>\n<p>                   been done in a lower scale. Further prayer is for quashing<\/p>\n<p>                   of order contained in memo no. 2132 dated 3.11.2009 and<\/p>\n<p>                   order contained in memo no. 2193 dated 9.11.2009 passed<\/p>\n<p>                   by   the     Executive    Engineer,    Building    Construction<\/p>\n<p>                   Department, Bhagalpur, whereby a direction has been issued<\/p>\n<p>                   for recovery of Rs. 30,174\/- from the pension of the<\/p>\n<p>                   petitioner on account of wrong fixation of pay, and wrongly<\/p>\n<p>                   assuming that the petitioner has been paid excess amount as<\/p>\n<p>                   salary.\n<\/p>\n<p><span class=\"hidden_text\">                                 -2-<\/span><\/p>\n<p>                      Petitioner&#8217;s case is that his pay fixation as well as<\/p>\n<p>          pension fixation was correctly done          and there was no<\/p>\n<p>          reason for reducing it even after granting the benefit of first<\/p>\n<p>          and second ACP to the petitioner.\n<\/p>\n<p>                      Counsel appearing for the State is directed to seek<\/p>\n<p>          instruction and file counter affidavit, for which four weeks&#8217;<\/p>\n<p>          time is allowed.\n<\/p>\n<p>                      Put up for admission after four weeks&#8217;, retaining its<\/p>\n<p>          position.\n<\/p>\n<p>                      Till disposal of this application recovery from the<\/p>\n<p>          pension of the petitioner shall remain stayed.<\/p>\n<p>                                         (Mridula Mishra,J.)<\/p>\n<p>A.kumar\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ganori Mandal vs The State Of Bihar &amp;Amp; Ors on 24 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.537 of 2010 1.
