He was granted 1st<br \/>\nhigher grade scale w.e.f 21.07.1987. Thereafter he requested the<br \/>\nrespondent No. 3 to grant him the higher grade scale vide letter<br \/>\ndated 01.10.2009, which was forwarded by the Executive Engineer vide<br \/>\nletter dated 06.11.2009. Vide letter dated 08.01.2010, the petitioner<br \/>\nis  denied the higher grade scale on the ground that he has been<br \/>\nimposed a penalty of reduction in present pay scale by one stage with<br \/>\nreduction of one increment without future effect.\n<\/p>\n<p>3.0\tHeard<br \/>\nlearned advocates for the respective parties.\n<\/p>\n<p>4.0\tOn<br \/>\nconsidering the submission of the learned advocates for the<br \/>\nrespective parties, it is found that the petitioner has completed 24<br \/>\nyears of service on 20.07.2002. On date 20.07.2002 there was no<br \/>\ndepartmental inquiry pending against the petitioner. The petitioner<br \/>\nwas issued the charge-sheet on 24.07.2007 and penalty was imposed on<br \/>\n19.06.2009. Hence, as per Resolution dated 02.07.2007, the petitioner<br \/>\nwas fulfilling the criteria for grant of higher grade scale and hence<br \/>\nhe cannot be denied higher grade scale on the ground of order of<br \/>\npenalty which is subsequent in time.\n<\/p>\n<p>5.0<br \/>\n In the premises aforesaid, the petitioner shall now approach the<br \/>\nrespondent No. 3. The respondent No. 3 after considering the<br \/>\ngrievances raised by the petitioner, will take appropriate decision<br \/>\nwithin a period of four months from today.\n<\/p>\n<p>6.0<br \/>\n \tIf the order of the respondent is adverse to the petitioner, it<br \/>\nwill be open for the petitioner to challenge the same.\n<\/p>\n<p>7.0<br \/>\n\tWith the aforesaid observations and directions, the petitions stand<br \/>\ndisposed of. Notice is discharged in each petition  with no order as<br \/>\nto costs.
