Sharma, Advocate for the petitioner.\n\n\nAJAY KUMAR MITTAL, J.\n<\/pre>\n<p>             In this revision petition filed under Article 227 of the<\/p>\n<p>Constitution of India, the plaintiff-petitioners have challenged the order<\/p>\n<p>dated 6.4.2009 (Annexure P-1) passed by the trial court whereby the<\/p>\n<p>application filed by them under Order 39 Rules 1 and 2 of the Code of<\/p>\n<p>Civil Procedure was dismissed and also the order dated 2.6.2009<\/p>\n<p>(Annexure P-2) vide which, on appeal, that order was affirmed by the<\/p>\n<p>lower appellate court.\n<\/p>\n<p>             The trial court while dismissing the application for ad<\/p>\n<p>interim injunction of the plaintiff-petitioners had, in para 9 of its order,<\/p>\n<p>recorded as under:-\n<\/p>\n<blockquote><p>                   &#8220;9.   Plaintiffs have failed to bring on record any<\/p>\n<p>                   cogent piece of evidence at this stage regarding their<\/p>\n<p>                   possession over any specific portion of the land. At<\/p>\n<p>                   this stage, it cannot be decided as to whether any<\/p>\n<p>                   alleged oral family settlement was entered into in<\/p>\n<p>                   favour of plaintiffs by defendant No.1. This fact is a<br \/>\n<span class=\"hidden_text\"> CR No. 4008 of 2009                                       -2-<\/span><\/p>\n<p>                   matter of evidence. Defendants have produced letter<\/p>\n<p>                   dated 21.1.2000 in which daughter of plaintiff no.3<\/p>\n<p>                   has assured the defendant of taking due care of their<\/p>\n<p>                   property.    If plaintiff no.3 has sold the property<\/p>\n<p>                   measuring 250 sq. yards, she could do so qua her<\/p>\n<p>                   own share. I agree with the contention raised by Ld.<\/p>\n<p>                   counsel for defendants that every co-owner is entitled<\/p>\n<p>                   to every inch of the suit land and has a right to use<\/p>\n<p>                   the joint property in a husband like manner. At this<\/p>\n<p>                   stage, it is not clear from the perusal of the record as<\/p>\n<p>                   to who is in possession of which specific share of the<\/p>\n<p>                   suit land. Therefore, it will not be appropriate to pass<\/p>\n<p>                   injunction order as sought by the plaintiffs.&#8221;<\/p><\/blockquote>\n<p>             The said order of the trial court was affirmed on appeal by<\/p>\n<p>the lower appellate court.\n<\/p>\n<p>             After hearing the learned counsel for the petitioners and<\/p>\n<p>perusing the file, this Court is of the opinion that there being uncertainty<\/p>\n<p>regarding possession of the plaintiffs over any specific portion of the suit<\/p>\n<p>land, no ground for interference with the orders impugned herein by this<\/p>\n<p>Court in its jurisdiction under Article 227 of the Constitution of India is<\/p>\n<p>made out.\n<\/p>\n<p>             Dismissed.\n<\/p>\n<p>             Nothing observed in this order shall be construed to be an<\/p>\n<p>expression of opinion on the merits of the case.<\/p>\n<pre>August 18, 2009                                 (AJAY KUMAR MITTAL)\ngbs                                                    JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Kanwaljit Singh And Others vs Smt.
