Rathore, Public Prosecutor for State.\n******\n<\/pre>\n<p>\t\tHeard learned counsel for petitioner and the learned Public Prosecutor for the State and perused the relevant documents placed before me.\n<\/p>\n<p>\t\tLearned counsel for petitioner has argued that the offence for which he has been charge sheeted is one punishable under Section 8\/29 of the NDPS Act, maximum sentence of which is six months imprisonment. He is already behind the bars for three &amp; half months as he is in jail since 4\/4\/2010. Challan has been filed and trial of the case is likely to take a long.\n<\/p>\n<p>\t\tLearned Public Prosecutor has opposed the bail application.\n<\/p>\n<p>\t\tConsidering the submissions made at the bar, the nature of accusation, the materials on record and all other facts and circumstances of the case, I deem it just and proper to enlarge the petitioner on bail.\n<\/p>\n<p>\t\tIn the result, this bail application u\/S.439 Cr.P.C. is allowed and it is directed that petitioner Nisar Ahmed S\/o Ismaile Shah shall be released on bail in FIR No.46\/2010 P.S.
