Heard the learned counsel for the respondent<\/p>\n<p>                       nos.1 and 2 on I.A. No.1670 of 2011.\n<\/p>\n<p>                                 This Interlocutory Application has been filed<\/p>\n<p>                       under Order 39 Rule 2A read with Section 151 of the<\/p>\n<p>                       C.P.C. for initiating a contempt proceeding for violating<\/p>\n<p>                       the order dated 06.03.2009 by the appellant no.1, 2(i),<\/p>\n<p>                       2(ii), 5 and respondent no.17.\n<\/p>\n<p>                                 The learned counsel, Mr. Yogendra Prasad<\/p>\n<p>                       Sinha appearing on behalf of the respondent nos.1 and<\/p>\n<p>                       2 submitted that by the order dated 06.03.2009, the<\/p>\n<p>                       said appellant and respondents were restrained from<\/p>\n<p>                       going over the plot nos.306 and 307 which were<\/p>\n<p>                       allotted to the respondent nos.1 and 2 in the final<\/p>\n<p>                       decree proceeding.         At the time of hearing of this<\/p>\n<p>                       Interlocutory Application, the learned counsel for the<\/p>\n<p>                       respondent nos.1 and 2 submitted that still the delivery<\/p>\n<p>                       of possession has not been affected through the<\/p>\n<p>                       execution case filed by the plaintiff-respondent nos.1<\/p>\n<p>                       and 2 for delivery of possession according to the final<\/p>\n<p>                       decree.\n<\/p>\n<p>                                 From perusal of the Interlocutory Application, it<\/p>\n<p>                       appears that nowhere the respondent nos.1 and 2 have<\/p>\n<p>                       asserted that they were in possession of the said two<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>          plots.   No doubt, even if the said plots are allotted in<\/p>\n<p>          their share but according to the learned counsel, still<\/p>\n<p>          the execution proceeding is going on and the delivery of<\/p>\n<p>          possession has not been affected. The learned counsel<\/p>\n<p>          submitted that according to the final decree, they came<\/p>\n<p>          in possession over the said property. In my opinion, at<\/p>\n<p>          this stage, under Article 39 Rule 2A, no such finding can<\/p>\n<p>          be given.\n<\/p>\n<p>                    Accordingly, I find no merit in this application.<\/p>\n<p>          Therefore, this application being I.A.
