As a result of<br \/>\nhearing a consensus has been arrived at between the parties in<br \/>\npursuance of which consent terms have been produced which are taken<br \/>\non record. The consent terms  are as under:\n<\/p>\n<p>&#8220;3.\tThat<br \/>\nit is now agreed between the petitioner and the respondents that the<br \/>\npetitioner has handed over peaceful possession of the said premises<br \/>\nto the respondent on 17\/06\/2011 and for the said purpose the power of<br \/>\nattorney of the present petitioner is also filing an undertaking<br \/>\nbefore this Hon&#8217;ble High Court of Gujarat for handing over possession<br \/>\nof the premises tot he respondents.\n<\/p>\n<p>4.\tThat<br \/>\nit is agreed between the petitioner and the respondents that even<br \/>\nafter the possession of the premises is handed over to the<br \/>\nrespondents, the respondents will allow the petitioner to take all<br \/>\nbelonging of the petitioner within a period of one week from the date<br \/>\nof handing over possession of the premises to the respondent.\n<\/p>\n<p>5.\tThat<br \/>\nit is agreed  between the petitioner and the respondents that the<br \/>\npetitioner will not claim possession of the said property in any<br \/>\nmanner and will not seek for any right in the said premises belonging<br \/>\nto the respondents. That it is agreed between the petitioner and the<br \/>\nrespondents that the petitioner will not claim any right of tenancy,<br \/>\nif any in respect of the said property.\n<\/p>\n<p>6.\tThat<br \/>\nit is agreed between the petitioner and the respondents that the<br \/>\njudgement, order and decree dated 25\/2\/11 passed by the Appellate<br \/>\nBench of Small Cause Court, Ahmedabad in Civil Appeal No.126\/99 and<br \/>\nby the Small Causes Curt is true and correct, in accordance with law<br \/>\nand thereby binding on the parties and thereby the possession of the<br \/>\nsaid premises is being handed over by the petitioner to the<br \/>\nrespondents. That it is agreed between the petitioner and respondents<br \/>\nthat the petitioner was in arrears of rent for more than 6 months and<br \/>\nthough Trial Court had granted the time to the petitioner to deposit<br \/>\nthe amount, but at that juncture the petitioner has failed to do<br \/>\nneedful and thereby the decree and judgement passed by the Small<br \/>\nCauses Court is proper and legal.\n<\/p>\n<p>7.\tThe<br \/>\npetitioner states that the petitioner has not handed over any portion<br \/>\nof the premises or part of the premises to any third party. That a<br \/>\nPan Stall situated in the premises which is in possession of the<br \/>\npresent petitioner, the vacant and peaceful possession of the said<br \/>\nportion is also handed over by the petitioner to the respondents and<br \/>\nit is the part of the rental premises of the petitioner. The person<br \/>\nrunning the Pan Stall in the said premises is the person of the<br \/>\npetitioner and thereby the petitioner has handed over the vacant and<br \/>\npeaceful possession of the said premises to the respondents as per<br \/>\nthe decree and judgement passed by the Small Cause Court of<br \/>\nAhmedabad.\n<\/p>\n<p>8.\tThat<br \/>\nin view of the fact that the petitioner has handed over the<br \/>\npossession of the premises to the respondents,t here is no dispute<br \/>\nfurther remaining between the petitioner and the respondents and on<br \/>\nthe basis of the fact that the petitioner has handed over the key and<br \/>\npossession of the property tot he respondent on 17\/06\/2011, Civil<br \/>\nRevision Application No.99\/11 preferred by the petitioner  and Civil<br \/>\nRevision Application No.132\/11 preferred by the respondents are<br \/>\nrequired to be disposed off on the basis of the present consent terms<br \/>\nthat have been entered into between the parties and filed by the<br \/>\nparties in the present Civil Revision Application No.99\/2011.\n<\/p>\n<p>9.\tIn<br \/>\nview of the present consent terms and in view of the fact that the<br \/>\npetitioner has handed over peaceful and vacant possession of the<br \/>\npremises to the respondents and on the basis of the present consent<br \/>\nterms your Lordship may be pleased to dispose off the Civil Revision<br \/>\nApplication No.99\/2011 preferred by the petitioner and Civil Revision<br \/>\nApplication No.132\/2011 preferred by the respondents herein.&#8221;\n<\/p>\n<p>3.0\tAn<br \/>\nUndertaking on behalf of the petitioner was also filed  stating to<br \/>\nabide by the terms and conditions entered into in the consent terms<br \/>\nexecuted between  the deponent and the respondent on 17\/6\/2011 with<br \/>\nregard to the premises of two buildings situated in Khadiya Ward No.2<br \/>\nbearing Census No.2250 and 2251 of the property bearing Survey<br \/>\nNo.2684\/4. It was also undertaken to hand over vacant and peaceful<br \/>\npossession of the premises in dispute to the respondent.\n<\/p>\n<p>4.0\tIn<br \/>\nview of the above with the consent of the parties the judgement and<br \/>\norder dated 25.02.2011  passed by the Appellate Bench of the Small<br \/>\nCauses Court in Civil Appeal No.126 of 1999 is modified in terms of<br \/>\nthe Consent Terms. Decree shall be drawn accordingly.\n<\/p>\n<p>5.0\tBoth<br \/>\nthe above revisions applications are disposed of accordingly. No<br \/>\norder as to costs. Notice is discharged.
