Whether the judgment should be reported\nin the Digest ?\n\n                                  ORDER\n<\/pre>\n<pre>%                                 31.05.2011\nSANJIV KHANNA, J.\n\n<\/pre>\n<p>         The present public interest litigation writ petition has been filed<\/p>\n<p>by Dhawandeep Residents Welfare Association, representing residents<\/p>\n<p>of the Dhawandeep Building located at the Jantar Mantar Road, New<\/p>\n<p>Delhi.     Their grievance is that the respondents, which includes New<\/p>\n<p>Delhi Municipal Council, Commissioner of Police, have miserably failed<br \/>\n<span class=\"hidden_text\">WPC 2680\/2011                                         Page 1 of 9<\/span><br \/>\n to ensure that the residents of Dhawandeep Building are not<\/p>\n<p>obstructed or prevented from using the road and allowed ingress and<\/p>\n<p>egress to and from their building. It is submitted that the respondents<\/p>\n<p>have failed to ensure cleanliness as processions and dharnas are held<\/p>\n<p>almost throughout the year and the streets get littered and there is<\/p>\n<p>stagnant water and constant sloganeering. It is submitted that some<\/p>\n<p>protesters even put up tents\/temporary shelters. These protesters<\/p>\n<p>bathe, sleep, cook near the building for months together creating<\/p>\n<p>unhygienic conditions. Some photographs have been filed by the<\/p>\n<p>petitioners. The following reliefs are prayed for :-<\/p>\n<p>             &#8220;a)       Issue a Writ of Mandamus commanding the<br \/>\n             Respondents to permanently remove the protestors, their<br \/>\n             vehicles and tents from Jantar Mantar Road along with all<br \/>\n             their belongings;\n<\/p>\n<p>             b)     Issue a Writ of Mandamus commanding the<br \/>\n             Respondents to permanently ban holding dharnas\/<br \/>\n             processions on Jantar Mantar Road along;\n<\/p>\n<p>             c)      Pass such further orders or directions as this<br \/>\n             Hon&#8217;ble Court may deem fit, appropriate and proper in the<br \/>\n             facts and circumstances of the present case.&#8221;\n<\/p>\n<p>2.    Learned counsel for the petitioner has relied upon Kerala<\/p>\n<p>Vyapari Vyavasayi Ekopana Samiti vs. State of Kerala and Ors., AIR<\/p>\n<p>2004 KERALA 302, in which it has been held as under:-<br \/>\n<span class=\"hidden_text\">WPC 2680\/2011                                           Page 2 of 9<\/span>\n<\/p>\n<blockquote><p>             &#8220;5. The state of affairs as averred in the affidavit filed by<br \/>\n            the Government itself shows that Government is not able<br \/>\n            to implement it fully and fundamental rights of others are<br \/>\n            violated by the demonstrators. Apart from traffic jams,<br \/>\n            the demonstrators are creating huge loss to the public.<br \/>\n            Citizens right to move about freely and carrying on their<br \/>\n            profession etc. is obstructed. In view of the fact that<br \/>\n            roads are narrow and on gathering of even 50 peoples<br \/>\n            before Secretariat will stop the entire traffic, we are of the<br \/>\n            opinion that Government should prohibit conducting of<br \/>\n            demonstrations and processions on busy roads like M.G.<br \/>\n            Road from Palayam Junction to Thampanur, and other<br \/>\n            busy parts of the roads during working days. Imposition of<br \/>\n            ban on demonstrations and marches in certain parts of<br \/>\n            busy roads on working days in public interest to protect<br \/>\n            the fundamental rights of the majority of citizens is<br \/>\n            perfectly valid and only a reasonable restriction.<br \/>\n            Government is bound to implement the directions given<br \/>\n            by the Full Bench of this Court as approved by the Apex<br \/>\n            Court.     Police shall not allow any procession or<br \/>\n            demonstration against the above directions and shall not<br \/>\n            permit such demonstrations on working days in busy parts<br \/>\n            of the roads like M.G. Road in Thiruvananthapuram<br \/>\n            causing traffic block. Petitioners in these cases have filed<br \/>\n            representations, marked as Ext. P-1 in the original<br \/>\n            petitions. Those representations shall be considered and<br \/>\n            disposed of as expeditiously as possible.\n<\/p><\/blockquote>\n<blockquote><p>                   All these original petitions are disposed of<br \/>\n            accordingly.&#8221;\n<\/p><\/blockquote>\n<p>3.    In this decision, an earlier decision of Full Bench of Kerala High<\/p>\n<p>Court in Peoples Council for Social Justice v. State of Kerala, 1997(2)<\/p>\n<p>Kerala LT 309, has been quoted. It has been observed in this case that<\/p>\n<p>the right to assemble peacefully and the right to form an association or<\/p>\n<p>union and freedom of speech and expression are valuable fundamental<br \/>\n<span class=\"hidden_text\">WPC 2680\/2011                                              Page 3 of 9<\/span><br \/>\n rights, but these rights should be exercised without causing injury or<\/p>\n<p>annoyance to others.        Authorities have every right to impose<\/p>\n<p>reasonable restrictions as regards processions and street marches. Just<\/p>\n<p>as the participants of these processions and marches have right to use<\/p>\n<p>the highway but the same right is also vested in ordinary citizens and<\/p>\n<p>pedestrians who have equal right to pass and repass along with<\/p>\n<p>highway.\n<\/p>\n<p>4.     The Commissioner of Police has filed counter affidavit today in<\/p>\n<p>Court. In the counter affidavit, it is stated that demonstrations are<\/p>\n<p>permitted in the area subject to certain conditions. Reference is made<\/p>\n<p>to the decision of the Supreme Court in Destruction of Public and<\/p>\n<p>Private Properties vs. State of Andhara Pradesh and Ors.(2009) 5 SCC<\/p>\n<p>212.<\/p>\n<p>5.      It is stated that earlier demonstrations were permitted at Boat<\/p>\n<p>Club Lawns , but in late 1980s, there was a demonstration and the<\/p>\n<p>entire Rajpath, Rafi Marg and many other roads had to be closed for<\/p>\n<p>many days. Thus, as an administrative decision, it was decided that<\/p>\n<p>demonstrations would not be allowed at Boat Club and instead Jantar<\/p>\n<p><span class=\"hidden_text\">WPC 2680\/2011                                      Page 4 of 9<\/span><br \/>\n Mantar was offered as a place for demonstrations and all political<\/p>\n<p>parties had agreed to the said decision.                However, large<\/p>\n<p>demonstrations of more than 8000 people are permitted in Ramlila<\/p>\n<p>Maidan.    It is further stated that Delhi Police ensures that the<\/p>\n<p>demonstrations at Parliament Street, start and end in an orderly fashion<\/p>\n<p>and demonstrations are escorted throughout by adequate police force,<\/p>\n<p>but at times demonstrators become unruly, riotous, mischievous or<\/p>\n<p>uncontrollable. There have been clashes between different processions<\/p>\n<p>demonstrating simultaneously and vying for attention.            As per the<\/p>\n<p>compilation\/data of Delhi Police begining January, 2006 till 15th August,<\/p>\n<p>2010, there were 5491 demonstrations, rallies and processions and<\/p>\n<p>13118 dharnas\/hunger strikes were held at Jantar Mantar with prior<\/p>\n<p>permission. Daily 10 groups demonstrate and protest at the site. Steps<\/p>\n<p>taken by the police to mobilize adequate resources and for controlling<\/p>\n<p>and ensuring orderly demonstrations have been highlighted and stated.<\/p>\n<p>It is stated that prior permission is required to be taken and permission<\/p>\n<p>is granted after assessing the situation along with intelligence inputs<\/p>\n<p>with the paramount objective of maintenance of public order, safety<\/p>\n<p><span class=\"hidden_text\">WPC 2680\/2011                                      Page 5 of 9<\/span><br \/>\n and security of citizens and tranquility in the neighbourhood. Over the<\/p>\n<p>years, the security system has been streamlined. Steps are also taken to<\/p>\n<p>ensure smooth flow of traffic and maintenance of law and order.<\/p>\n<p>6.     In view of the facts, it is easy to visualize the task under taken by<\/p>\n<p>the Delhi Police in order to ensure that the demonstrators, who have<\/p>\n<p>the right to protest\/demonstrate and voice their opinion within<\/p>\n<p>reasonable limits, do not disturb and violate the rights of third parties.<\/p>\n<p>This requires divergent and extensive arrangements for water, toilets,<\/p>\n<p>public lighting etc. The Delhi Police has expressed concern that some of<\/p>\n<p>the demonstrators have started using Jantar Mantar as their permanent<\/p>\n<p>address and are even using it as their correspondence address. It is<\/p>\n<p>pointed out that there have been instances when overnight protestors<\/p>\n<p>have suddenly blocked traffic and movement of people at Parliament<\/p>\n<p>Street, Tolstoy Marg etc.<\/p>\n<p>7.    The Supreme Court has issued detailed guidelines in the case of<\/p>\n<p>Destruction of Public and Private Properties (supra), which read:-<\/p>\n<blockquote><p>             &#8220;12. To effectuate the modalities for preventive<br \/>\n          action and adding teeth to the enquiry\/investigation,<br \/>\n          the following guidelines are to be observed:\n<\/p><\/blockquote>\n<blockquote><p>          As soon as there is a demonstration organised:\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WPC 2680\/2011                                        Page 6 of 9<\/span><\/p>\n<blockquote><p>             (I) The organiser shall meet the police to review<br \/>\n          and revise the route to be taken    and to lay down<br \/>\n          conditions for a peaceful march or protest;\n<\/p><\/blockquote>\n<blockquote><p>              (II) All weapons, including knives, lathis and the<br \/>\n          like shall be prohibited;\n<\/p><\/blockquote>\n<blockquote><p>              (III) An undertaking is to be provided by the<br \/>\n          organisers to ensure a peaceful march with marshals<br \/>\n          at each relevant junction;\n<\/p><\/blockquote>\n<blockquote><p>             (IV) The police and the State Government shall<br \/>\n          ensure videography of such protests to the<br \/>\n          maximum extent possible;\n<\/p><\/blockquote>\n<blockquote><p>             (V) The person-in-charge to supervise the<br \/>\n          demonstration shall be SP (if the situation is<br \/>\n          confined to the district) and the highest police<br \/>\n          officer in the State, where the situation stretches<br \/>\n          beyond one district;\n<\/p><\/blockquote>\n<blockquote><p>             (VI) In the event that demonstrations turn<br \/>\n          violent, the officer-in-charge shall ensure that the<br \/>\n          events are videographed through private operators<br \/>\n          and also request such further information from the<br \/>\n          media and others on the incidents in question;\n<\/p><\/blockquote>\n<blockquote><p>             (VII) The police shall immediately inform the<br \/>\n          State Government with reports on the events,<br \/>\n          including damage, if any, caused by the police; and<\/p>\n<p>             (VIII) The State Government shall prepare a<br \/>\n          report on the police reports and other information<br \/>\n          that may be available to it and shall file a petition<br \/>\n          including its report in the High Court or the<br \/>\n          Supreme Court as the case may be for the Court in<br \/>\n          question to take suo motu action.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WPC 2680\/2011                                       Page 7 of 9<\/span><\/p>\n<p> 8.     During the course of hearing Mr. Waziri, learned Standing<\/p>\n<p>Counsel for the Government of NCT of Delhi has submitted that they<\/p>\n<p>are trying to locate a different place where processions\/demonstrations<\/p>\n<p>by the protestors can be permitted but such identification will take<\/p>\n<p>some time and will require consensus. The respondents have a task of<\/p>\n<p>ensuring that the protestors and demonstrators are not denied their<\/p>\n<p>right to speak and express their point of view but at the same time the<\/p>\n<p>demonstrators cannot hold the public at ransom and must show<\/p>\n<p>concern and respect the rights of others. Balance has to be maintained<\/p>\n<p>to ensure that the rights of all parties are fully protected and not<\/p>\n<p>violated. This is a larger issue but the contentions raised and prayers<\/p>\n<p>made by the petitioners are limited to their own complex, where they<\/p>\n<p>are residing. In these circumstances, it is directed that it shall be the<\/p>\n<p>duty of the local authorities including NDMC to ensure that<\/p>\n<p>area\/streets in the area are cleaned and any litter left behind is<\/p>\n<p>removed periodically every day. NDMC may also explore possibility<\/p>\n<p>of cleaning the streets at night or late in the evening or early<\/p>\n<p><span class=\"hidden_text\">WPC 2680\/2011                                      Page 8 of 9<\/span><br \/>\n morning. Adequate toilet facilities should be provided. Strict<\/p>\n<p>compliance      or   regulation   may   be   difficult   because   the<\/p>\n<p>protesters\/demonstrators demonstrating can and do get unruly but<\/p>\n<p>every effort should be made to ensure that protestors\/demonstrators<\/p>\n<p>use the toilets and least inconvenience is caused. For the purpose of<\/p>\n<p>convenience of the petitioner, the police and NDMC will furnish to the<\/p>\n<p>office bearers of the petitioner society, telephone numbers of two<\/p>\n<p>officers of Delhi Police and NDMC, who can be contacted in case there<\/p>\n<p>is any problem or obstruction. The directions given by the Supreme<\/p>\n<p>Court in Destruction of Public and Private Properties (supra) will be<\/p>\n<p>meticulously observed.\n<\/p>\n<p>9.
