     Leave granted.\n<\/p>\n
     This appeal  is directed  against\tthe  Division  Bench
\nJudgment of  the Bombay High Court in W.P. No. 2773\/95 dated
\n22.6.95.\n<\/p>\n
     At the  time of  arguments before\tus, learned  counsel
\nappearing for  the appellant  has confined his contention to
\nthe claim  of the  appellant that  she\tbelongs\t to  “Halba”
\nScheduled Tribe.\n<\/p>\n
     Briefly stated  the facts are that the appellant with a
\nview  to   apply  for\tadmission  to  the  Medical  Course,
\napproached the\tsecond respondent, the Scheduled Tribe Caste
\nCertificate Scrutiny  Committee (for  Short “Committee”) for
\nthe issue  of a\t caste certificate  to the  effect that\t she
\nbelongs to  “Halba” Scheduled  Tribe to\t enable her to apply
\nfor admission  to the Medical Course under that category. In
\nsupport of  her\t claim,\t apart\tfrom  appearing\t before\t the
\nCommittee and  furnishing certain information, the appellant
\nhas filed  17 documents consisting of certificates issued by
\nExecutive Magistrate  and School  Certificate issued  to her
\nand Caste Certificate issued to her father.\n<\/p>\n
     The second\t respondent Committee  while considering the
\nclaim of the appellant and evaluating the probative value of
\nthe documents  produced, did  not appear  to have dealt with
\none important  document, namely,  Certificate No.  9 in\t the
\nOrder of  the second  respondent which\trelated to  an Order
\npassed by  the Government  on appeal  by the first cousin of
\nthe appellant in the matter of issue of Caste Certificate to
\nhim. That  Order of  the Government  dated 1.9.81 overruling
\nthe Order  of  a  Committee,  granted  a  Caste\t Certificate
\nholding that  the first\t cousin of  the appellant,  by name,
\nAbinash Prabhakar  Nagpure belonged  to “Halba” community, a
\nScheduled Tribe in the State of Maharashtra. Likewise, while
\nbrushing aside the Caste Certificate issued in favour of the
\nappellant’s father,  the Scrutiny  Committee merely observed
\nthat it\t was  issued  in  a  casual  manner  without  proper
\nverification.\n<\/p>\n
     In the  course  of\t the  argument\tbefore\tus,  learned
\ncounsel for the appellant contended that in the light of the
\nInstructions issued  by the Government of Maharashtra’s that
\nif a  close relative  is already  given a Caste Certificate,
\nthat must  be given due weight, has not been followed by the
\nCommittee. He  also submitted that the Certificate issued on
\n26.8.71 by  the appropriate authority after verification was
\nthe basis  for the  issue of  the Caste\t Certificate to\t the
\nfather of  the appellant,  was not noticed by the Committee.
\nHowever, the  Certificate dated\t 26.8.71  was  not  produced
\nbefore\tthe   Committee.  From\t the  Order  passed  by\t the
\nCommittee, we  find that  the failure  of the  appellant  to
\nproduce her  father’s Primary  School Certificate  was taken
\nserious note of to reject the appellant’s claim.\n<\/p>\n
     Before the High Court also, it is claimed, reliance was
\nplaced on  the Caste  Certificate issued to the first cousin
\nand also  the Death  Certificate issued\t on the death of the
\nappellant’s grandmother\t but those were not discussed by the
\nHigh Court.\n<\/p>\n
     Learned   counsel\t appearing   for   the\t respondents
\nsupporting the\tOrder  of  the\tsecond-respondent  Committee
\nsubmitted that\tin view\t of the\t judgments of  this Court in
\nKumari Madhuri\tPatil and  Anr. vs. Additional Commissioner,
\nTribal Development  & Ors.<\/a>  (1994) 6  SCC 241);\t Director of
\nTribal Welfare,\t Govt. of A.P. vs. Laveti Giri & Anr.<\/a> (1995)
\n4 SCC  32) the\tconclusion recorded by the second-respondent
\nCommittee does not call for any interference.\n<\/p>\n
     We have considered the rival submission and perused the
\norder of  the second-respondent\t Committee and\talso that of
\nHigh Court.\n<\/p>\n
     We\t have\tnoticed\t earlier  that\tbefore\tthe  second-
\nrespondent Committee,  17 documents  were  produced  by\t the
\nappellant to  support the claim that she belonged to “Halba”
\nScheduled  Tribe.   The\t second-respondent  Committee  while
\nappreciating  the   probative  value   of  almost   all\t the
\ndocuments, did\tnot  refer  to\tand  consider  an  important
\ndocument, namely,  an order  passed  by\t the  Government  on
\nappeal at  the instance\t of Abinash  Prabhakar\tNagpure\t for
\nidentical relief.  It is not disputed before us that Abinash
\nPrabhakar Nagpure  is the first cousin of the appellant. The
\nGovernment by  the said\t order dated  1.9.81  reversing\t the
\norder of  the Committee\t recognized  the  claim\t of  Abinash
\nPrabhakar Nagpure  that he  belonged  to  “Halba”  Scheduled
\nTribe.\n<\/p>\n
     The documents  placed  before  the\t Committee  are\t the
\nfollowing :\n<\/p>\n
     1. Copy  of the  caste  certificate
\n     issued by\tPrincipal,  G.N.  Khalsa
\n     College, Bombay dated 5.7.94.\n<\/p><\/blockquote>\n
     2. Zerox  copy  of\t school\t leaving
\n     certificate  issued   by  Principal
\n     AFAC   English   School,\tChembur,
\n     Bombay vide Reg No. 3032.\n<\/p><\/blockquote>\n
     3. Zerox  copy  of\t school\t leaving
\n     certificate issued\t by Head Master,
\n     St.   Sabastian’s\t  High\t School,
\n     Chambur Bombay vide. Reg. no. 4768.\n<\/p><\/blockquote>\n
     4. Zerox  copy  of\t School\t leaving

\n     Nagpure   issued\t by    Gramvikas
\n     Adhikari Kopargaon.\n<\/p><\/blockquote>\n
     17. Zerox copy of affidavit of Shri
\n     Abinash Prabhakar Nagpure.<\/p><\/blockquote>\n
     The second-respondent Committee ignored Sl.Nos. 1-4, 6,
\n8, 16  & 17,  though they  relate to  school records  of the
\nappellant, her\trelatives wherein  the appellant’s  caste is
\nrecorded as “Halba” by simply stating that “they were issued
\nin a  very casual  manner without  verifying the  guidelines
\ngiven by  the Government  from time  to time  to issue\tsuch
\ncertificates”. Again  while rejecting SL.. Nos. 5, 7, 10, 13
\n& 14, the Committee has commented that “there is no room for
\nthe presumption\t that the  certificate\thas  been  correctly
\nissued”. We  are not able to appreciate this approach of the
\nCommittee in  rejecting the  certificates in  the absence of
\nany attempt  on the  side of  the Government  to suspect the
\ncorrectness\/genuineness of  the documents  produced  by\t the
\nappellant. We  find from the copies of Certificates included
\nin  the\t  paper\t book  that  the  Domicile  and\t Nationality
\ncertificate issued  to the  appellant’s father (Annexure “C”
\nat page\t 28 of\tpaper book)  was  issued  on  the  basis  of
\nparticulars of proof given as under:\n<\/p>\n
     A) Answer given by the Applicant on
\n     the   prescribed\t form\tof   the
\n     questionnaire.<\/p><\/blockquote>\n
     B) Birth  or School  leaving  or  a
\n     like  Certificate\tissued\tby  Shri
\n     Sainath\tMadhyamik     Vidyalaya.
\n     Shirdi.\n<\/p><\/blockquote>\n
     C)\t Affidavits  or\t Declaration  of
\n     Birth Place & Caste.\n<\/p><\/blockquote>\n
     D) together proof): Nil.<\/p><\/blockquote>\n
     Likewise the  caste certificate issued to the appellant
\nwas not\t issued in a casual manner but after verification of
\nrelevant records. Similarly, the caste certificate issued to
\nthe father  of the appellant was not casual one but based on
\nthe following particulars :-\n<\/p>\n
     1) Age, Domicile. Nationality certificate.\n<\/p><\/blockquote>\n
     2) Brother S.L.C.\n<\/p><\/blockquote>\n
     3) Nephew S.L.C.\n<\/p><\/blockquote>\n
     4) Son, Bona fide Certificate.\n<\/p><\/blockquote>\n
     t) Brothers Caste Certificate.\n<\/p><\/blockquote>\n
     b) Samaj Dakhala.\n<\/p><\/blockquote>\n
     7) Ration Card.\n<\/p><\/blockquote>\n
     8) Affidavit and Application.<\/p><\/blockquote>\n
     Taking into  consideration these  certificates and also
\nthe order  of the  Government dated  1.9.81 certifying\tthat
\nAbinash Prabhakar  Nagpure, first  cousin of  the  appellant
\nbelongs to  “Halba” community,\twe are\tof the view that the
\nrejection of  the appellant’s claim especially when there is
\nno  other  evidence  placed  contra  to\t suspect  the  proof
\nproduced by the appellant and without appreciating the vital
\ndocument placed before the Committee, is not correct.\n<\/p>\n
     lt is  true that  this Court  in Kumari Madhuri Patil’s
\ncase (supra) has observed :-\n<\/p>\n
     “The Committee  which is  empowered
\n     to\t evaluate  the\tevidence  placed
\n     before it when records a finding of
\n     fact, it  ought to\t prevail  unless
\n     found vitiated  by judicial  review
\n     of\t any   High  Court   subject  to
\n     limitations  of  interference  with
\n     findings  of  fact.  The  Committee
\n     when  considers  all  the\tmaterial
\n     facts and records a finding, though
\n     another view,  as a court of appeal
\n     may be possible, it is not a ground
\n     to reverse\t the findings. The court
\n     has to  see whether  the  Committee
\n     Considered\t  all\t the\trelevant
\n     material placed  before it\t or  has
\n     not applied  its mind  to\trelevant
\n     facts which  have led the committee
\n     ultimately\t recorded  the\tfinding.
\n     Each case must be considered in the
\n     backdrop of its own facts.”<\/p><\/blockquote>\n
     The same view has been reiterated in Director of Tribal
\nWelfare, Govt. A.P. vs. Laveti Giri & Anr.<\/a> (1995) 4 SCC 32.\n<\/p>\n
     Applying the  above test  to the  facts of\t the present
\ncase. we are satisfied that the Committee failed to consider
\nall the\t relevant materials  placed before  it and  did\t not
\napply its  mind to  an important document “SL.. No. 9” which
\nled the\t Committee ultimately  record a\t finding against the
\nappellant. By  a wrongful  denial of  the caste certificate,
\nthe genuine  candidate,\t he\/she\t will  be  deprived  of\t the
\nprivileges  conferred  upon  him\/her  by  the  Constitution.
\nTherefore greater  care must  be taken\tbefore\tgranting  or
\nrejecting any claim for caste certificate.\n<\/p>\n
     The High Court without appreciating the probative value
\nof the\tdocuments placed  before it  has dismissed  the writ
\npetition filed\tby the\tappellant by  simply accept  so\t the
\nconclusions  reached  by  the  second-respondent  Committee.
\nUndoubtedly, in\t cases of this type, the burden heavily lies
\non the applicant who seeks such a certificate. That does not
\nmean that  the authorities  have no  role to play in finding
\nout the correctness or otherwise of the claim for issue of a
\ncaste certificate.  We are  of the  view that  the concerned
\nauthorities must also play a role in assisting the Committee
\nto arrive  at a\t correct decision.  In this case, except the
\ndocuments  produced  by\t the  appellant,  nothing  has\tbeen
\nproduced  by   the  concerned  authorizes  to  arrive  at  a
\ndifferent conclusion.\n<\/p>\n
     On the  facts of this case, we are of the view that the
\nsecond-respondent Committee  was not  right in rejecting the
\nclaim of  the appellant and for the same reason the order of
\nthe High  Court cannot\tbe sustained.  In  the\tresult,\t the
\nappeal succeeds\t and is\t allowed accordingly. However. there
\nwill be no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"
