VENKATASWAMI, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  is directed  against\tthe  Division  Bench<br \/>\nJudgment of  the Bombay High Court in W.P. No. 2773\/95 dated<br \/>\n22.6.95.\n<\/p>\n<p>     At the  time of  arguments before\tus, learned  counsel<br \/>\nappearing for  the appellant  has confined his contention to<br \/>\nthe claim  of the  appellant that  she\tbelongs\t to  &#8220;Halba&#8221;<br \/>\nScheduled Tribe.\n<\/p>\n<p>     Briefly stated  the facts are that the appellant with a<br \/>\nview  to   apply  for\tadmission  to  the  Medical  Course,<br \/>\napproached the\tsecond respondent, the Scheduled Tribe Caste<br \/>\nCertificate Scrutiny  Committee (for  Short &#8220;Committee&#8221;) for<br \/>\nthe issue  of a\t caste certificate  to the  effect that\t she<br \/>\nbelongs to  &#8220;Halba&#8221; Scheduled  Tribe to\t enable her to apply<br \/>\nfor admission  to the Medical Course under that category. In<br \/>\nsupport of  her\t claim,\t apart\tfrom  appearing\t before\t the<br \/>\nCommittee and  furnishing certain information, the appellant<br \/>\nhas filed  17 documents consisting of certificates issued by<br \/>\nExecutive Magistrate  and School  Certificate issued  to her<br \/>\nand Caste Certificate issued to her father.\n<\/p>\n<p>     The second\t respondent Committee  while considering the<br \/>\nclaim of the appellant and evaluating the probative value of<br \/>\nthe documents  produced, did  not appear  to have dealt with<br \/>\none important  document, namely,  Certificate No.  9 in\t the<br \/>\nOrder of  the second  respondent which\trelated to  an Order<br \/>\npassed by  the Government  on appeal  by the first cousin of<br \/>\nthe appellant in the matter of issue of Caste Certificate to<br \/>\nhim. That  Order of  the Government  dated 1.9.81 overruling<br \/>\nthe Order  of  a  Committee,  granted  a  Caste\t Certificate<br \/>\nholding that  the first\t cousin of  the appellant,  by name,<br \/>\nAbinash Prabhakar  Nagpure belonged  to &#8220;Halba&#8221; community, a<br \/>\nScheduled Tribe in the State of Maharashtra. Likewise, while<br \/>\nbrushing aside the Caste Certificate issued in favour of the<br \/>\nappellant&#8217;s father,  the Scrutiny  Committee merely observed<br \/>\nthat it\t was  issued  in  a  casual  manner  without  proper<br \/>\nverification.\n<\/p>\n<p>     In the  course  of\t the  argument\tbefore\tus,  learned<br \/>\ncounsel for the appellant contended that in the light of the<br \/>\nInstructions issued  by the Government of Maharashtra&#8217;s that<br \/>\nif a  close relative  is already  given a Caste Certificate,<br \/>\nthat must  be given due weight, has not been followed by the<br \/>\nCommittee. He  also submitted that the Certificate issued on<br \/>\n26.8.71 by  the appropriate authority after verification was<br \/>\nthe basis  for the  issue of  the Caste\t Certificate to\t the<br \/>\nfather of  the appellant,  was not noticed by the Committee.<br \/>\nHowever, the  Certificate dated\t 26.8.71  was  not  produced<br \/>\nbefore\tthe   Committee.  From\t the  Order  passed  by\t the<br \/>\nCommittee, we  find that  the failure  of the  appellant  to<br \/>\nproduce her  father&#8217;s Primary  School Certificate  was taken<br \/>\nserious note of to reject the appellant&#8217;s claim.\n<\/p>\n<p>     Before the High Court also, it is claimed, reliance was<br \/>\nplaced on  the Caste  Certificate issued to the first cousin<br \/>\nand also  the Death  Certificate issued\t on the death of the<br \/>\nappellant&#8217;s grandmother\t but those were not discussed by the<br \/>\nHigh Court.\n<\/p>\n<p>     Learned   counsel\t appearing   for   the\t respondents<br \/>\nsupporting the\tOrder  of  the\tsecond-respondent  Committee<br \/>\nsubmitted that\tin view\t of the\t judgments of  this Court in<br \/>\n<a href=\"\/doc\/799713\/\">Kumari Madhuri\tPatil and  Anr. vs. Additional Commissioner,<br \/>\nTribal Development  &amp; Ors.<\/a>  (1994) 6  SCC 241);\t <a href=\"\/doc\/7075\/\">Director of<br \/>\nTribal Welfare,\t Govt. of A.P. vs. Laveti Giri &amp; Anr.<\/a> (1995)<br \/>\n4 SCC  32) the\tconclusion recorded by the second-respondent<br \/>\nCommittee does not call for any interference.\n<\/p>\n<p>     We have considered the rival submission and perused the<br \/>\norder of  the second-respondent\t Committee and\talso that of<br \/>\nHigh Court.\n<\/p>\n<p>     We\t have\tnoticed\t earlier  that\tbefore\tthe  second-<br \/>\nrespondent Committee,  17 documents  were  produced  by\t the<br \/>\nappellant to  support the claim that she belonged to &#8220;Halba&#8221;<br \/>\nScheduled  Tribe.   The\t second-respondent  Committee  while<br \/>\nappreciating  the   probative  value   of  almost   all\t the<br \/>\ndocuments, did\tnot  refer  to\tand  consider  an  important<br \/>\ndocument, namely,  an order  passed  by\t the  Government  on<br \/>\nappeal at  the instance\t of Abinash  Prabhakar\tNagpure\t for<br \/>\nidentical relief.  It is not disputed before us that Abinash<br \/>\nPrabhakar Nagpure  is the first cousin of the appellant. The<br \/>\nGovernment by  the said\t order dated  1.9.81  reversing\t the<br \/>\norder of  the Committee\t recognized  the  claim\t of  Abinash<br \/>\nPrabhakar Nagpure  that he  belonged  to  &#8220;Halba&#8221;  Scheduled<br \/>\nTribe.\n<\/p>\n<p>     The documents  placed  before  the\t Committee  are\t the<br \/>\nfollowing :\n<\/p>\n<blockquote><p>     1. Copy  of the  caste  certificate<br \/>\n     issued by\tPrincipal,  G.N.  Khalsa<br \/>\n     College, Bombay dated 5.7.94.\n<\/p><\/blockquote>\n<blockquote><p>     2. Zerox  copy  of\t school\t leaving<br \/>\n     certificate  issued   by  Principal<br \/>\n     AFAC   English   School,\tChembur,<br \/>\n     Bombay vide Reg No. 3032.\n<\/p><\/blockquote>\n<blockquote><p>     3. Zerox  copy  of\t school\t leaving<br \/>\n     certificate issued\t by Head Master,<br \/>\n     St.   Sabastian&#8217;s\t  High\t School,<br \/>\n     Chambur Bombay vide. Reg. no. 4768.\n<\/p><\/blockquote>\n<blockquote><p>     4. Zerox  copy  of\t School\t leaving<br \/>\n     certificate  issued  by  Principal,<br \/>\n     St.  Judge&#8217;s  High\t School,  Kalyan<br \/>\n     vide Reg. No. 2185.\n<\/p><\/blockquote>\n<blockquote><p>     5. Zerox  copy of caste certificate<br \/>\n     issued    by     Sub     Divisional<br \/>\n     Magistrate, Nashik\t Dn. Nashik vide<br \/>\n     No.;  EDN\/POL   II\/\/STSC.Sr.\/129\/92<br \/>\n     dated 31.11.92.\n<\/p><\/blockquote>\n<blockquote><p>     6. Zerox copy of certificate issued<br \/>\n     by\t Chairman,   Halba  Samaj   Seva<br \/>\n     Mandal, Naushik, dated 14.6.94.\n<\/p><\/blockquote>\n<blockquote><p>     7. Zerox  copy of caste certificate<br \/>\n     issued  by\t  Executive  Magistrate,<br \/>\n     Nagpure vide  No. 3583\/MRC-87\/92-93<br \/>\n     dated 13.4.93.\n<\/p><\/blockquote>\n<blockquote><p>     8. Zerox copy of certificate issued<br \/>\n     by\t Chief\tP&amp;A  Manager,  Hindustan<br \/>\n     Petroleum Corporation  Ltd.  Bombay<br \/>\n     dated 2.3.94.\n<\/p><\/blockquote>\n<blockquote><p>     9.Zerox copy  of  order  passed  by<br \/>\n     Assistant Secretary  to Government,<br \/>\n     Social Welfare  and  Sports  Deptt.<br \/>\n     dated 1.9.81  in respect of Abinash<br \/>\n     Prabhakar Nagpure.\n<\/p><\/blockquote>\n<blockquote><p>     10. Zerox copy of caste certificate<br \/>\n     issued  by\t  Executive   Magistrate<br \/>\n     Kopargaon dated  28.2.81 in respect<br \/>\n     of Abihash Prabhakar Nagpure.\n<\/p><\/blockquote>\n<blockquote><p>     11.  Zerox\t  copy\tof   certificate<br \/>\n     marriage  in   respect  of\t Avinash<br \/>\n     Prabhakar Nagpure.\n<\/p><\/blockquote>\n<blockquote><p>     12. Zerox\tcopy of\t order passed by<br \/>\n     Divisional Commissioner,  Konkan  &amp;<br \/>\n     Bombay    Division\t    vide     No.<br \/>\n     SO\/POL\/APPEAL\/ST\/15\/82  in\t respect<br \/>\n     of Miss Versha Laxmikant Belekar.\n<\/p><\/blockquote>\n<blockquote><p>     13. Zerox\tcopy of case certificate<br \/>\n     issued  by\t  District   Magistrate,<br \/>\n     Greater Bombay in respect of Varsha<br \/>\n     Laxmikant Belekar.\n<\/p><\/blockquote>\n<blockquote><p>     14. Zerox\tcopy of\t certificate  of<br \/>\n     validity issued  by Tribal Research<br \/>\n     &amp; Training\t Institute,  Pune  dated<br \/>\n     29.3.94  in   respect  of\tVirendra<br \/>\n     Laxmikant Relekar.\n<\/p><\/blockquote>\n<blockquote><p>     15. Zerox copy of caste certificate<br \/>\n     issued  by\t  Executive  Magistrate,<br \/>\n     Nagpur  in\t  respect  of  Prabhakar<br \/>\n     Nagpure dated 2.9.82.\n<\/p><\/blockquote>\n<blockquote><p>     16. Zerox copy of death certificate<br \/>\n     in respect\t of  Taramati  Shantaram<br \/>\n     Nagpure   issued\t by    Gramvikas<br \/>\n     Adhikari Kopargaon.\n<\/p><\/blockquote>\n<blockquote><p>     17. Zerox copy of affidavit of Shri<br \/>\n     Abinash Prabhakar Nagpure.<\/p><\/blockquote>\n<p>     The second-respondent Committee ignored Sl.Nos. 1-4, 6,<br \/>\n8, 16  &amp; 17,  though they  relate to  school records  of the<br \/>\nappellant, her\trelatives wherein  the appellant&#8217;s  caste is<br \/>\nrecorded as &#8220;Halba&#8221; by simply stating that &#8220;they were issued<br \/>\nin a  very casual  manner without  verifying the  guidelines<br \/>\ngiven by  the Government  from time  to time  to issue\tsuch<br \/>\ncertificates&#8221;. Again  while rejecting SL.. Nos. 5, 7, 10, 13<br \/>\n&amp; 14, the Committee has commented that &#8220;there is no room for<br \/>\nthe presumption\t that the  certificate\thas  been  correctly<br \/>\nissued&#8221;. We  are not able to appreciate this approach of the<br \/>\nCommittee in  rejecting the  certificates in  the absence of<br \/>\nany attempt  on the  side of  the Government  to suspect the<br \/>\ncorrectness\/genuineness of  the documents  produced  by\t the<br \/>\nappellant. We  find from the copies of Certificates included<br \/>\nin  the\t  paper\t book  that  the  Domicile  and\t Nationality<br \/>\ncertificate issued  to the  appellant&#8217;s father (Annexure &#8220;C&#8221;<br \/>\nat page\t 28 of\tpaper book)  was  issued  on  the  basis  of<br \/>\nparticulars of proof given as under:\n<\/p>\n<blockquote><p>     A) Answer given by the Applicant on<br \/>\n     the   prescribed\t form\tof   the<br \/>\n     questionnaire.<\/p><\/blockquote>\n<blockquote><p>     B) Birth  or School  leaving  or  a<br \/>\n     like  Certificate\tissued\tby  Shri<br \/>\n     Sainath\tMadhyamik     Vidyalaya.<br \/>\n     Shirdi.\n<\/p><\/blockquote>\n<blockquote><p>     C)\t Affidavits  or\t Declaration  of<br \/>\n     Birth Place &amp; Caste.\n<\/p><\/blockquote>\n<blockquote><p>     D) together proof): Nil.<\/p><\/blockquote>\n<p>     Likewise the  caste certificate issued to the appellant<br \/>\nwas not\t issued in a casual manner but after verification of<br \/>\nrelevant records. Similarly, the caste certificate issued to<br \/>\nthe father  of the appellant was not casual one but based on<br \/>\nthe following particulars :-\n<\/p>\n<blockquote><p>     1) Age, Domicile. Nationality certificate.\n<\/p><\/blockquote>\n<blockquote><p>     2) Brother S.L.C.\n<\/p><\/blockquote>\n<blockquote><p>     3) Nephew S.L.C.\n<\/p><\/blockquote>\n<blockquote><p>     4) Son, Bona fide Certificate.\n<\/p><\/blockquote>\n<blockquote><p>     t) Brothers Caste Certificate.\n<\/p><\/blockquote>\n<blockquote><p>     b) Samaj Dakhala.\n<\/p><\/blockquote>\n<blockquote><p>     7) Ration Card.\n<\/p><\/blockquote>\n<blockquote><p>     8) Affidavit and Application.<\/p><\/blockquote>\n<p>     Taking into  consideration these  certificates and also<br \/>\nthe order  of the  Government dated  1.9.81 certifying\tthat<br \/>\nAbinash Prabhakar  Nagpure, first  cousin of  the  appellant<br \/>\nbelongs to  &#8220;Halba&#8221; community,\twe are\tof the view that the<br \/>\nrejection of  the appellant&#8217;s claim especially when there is<br \/>\nno  other  evidence  placed  contra  to\t suspect  the  proof<br \/>\nproduced by the appellant and without appreciating the vital<br \/>\ndocument placed before the Committee, is not correct.\n<\/p>\n<p>     lt is  true that  this Court  in Kumari Madhuri Patil&#8217;s<br \/>\ncase (supra) has observed :-\n<\/p>\n<blockquote><p>     &#8220;The Committee  which is  empowered<br \/>\n     to\t evaluate  the\tevidence  placed<br \/>\n     before it when records a finding of<br \/>\n     fact, it  ought to\t prevail  unless<br \/>\n     found vitiated  by judicial  review<br \/>\n     of\t any   High  Court   subject  to<br \/>\n     limitations  of  interference  with<br \/>\n     findings  of  fact.  The  Committee<br \/>\n     when  considers  all  the\tmaterial<br \/>\n     facts and records a finding, though<br \/>\n     another view,  as a court of appeal<br \/>\n     may be possible, it is not a ground<br \/>\n     to reverse\t the findings. The court<br \/>\n     has to  see whether  the  Committee<br \/>\n     Considered\t  all\t the\trelevant<br \/>\n     material placed  before it\t or  has<br \/>\n     not applied  its mind  to\trelevant<br \/>\n     facts which  have led the committee<br \/>\n     ultimately\t recorded  the\tfinding.<br \/>\n     Each case must be considered in the<br \/>\n     backdrop of its own facts.&#8221;<\/p><\/blockquote>\n<p>     The same view has been reiterated in <a href=\"\/doc\/7075\/\">Director of Tribal<br \/>\nWelfare, Govt. A.P. vs. Laveti Giri &amp; Anr.<\/a> (1995) 4 SCC 32.\n<\/p>\n<p>     Applying the  above test  to the  facts of\t the present<br \/>\ncase. we are satisfied that the Committee failed to consider<br \/>\nall the\t relevant materials  placed before  it and  did\t not<br \/>\napply its  mind to  an important document &#8220;SL.. No. 9&#8221; which<br \/>\nled the\t Committee ultimately  record a\t finding against the<br \/>\nappellant. By  a wrongful  denial of  the caste certificate,<br \/>\nthe genuine  candidate,\t he\/she\t will  be  deprived  of\t the<br \/>\nprivileges  conferred  upon  him\/her  by  the  Constitution.<br \/>\nTherefore greater  care must  be taken\tbefore\tgranting  or<br \/>\nrejecting any claim for caste certificate.\n<\/p>\n<p>     The High Court without appreciating the probative value<br \/>\nof the\tdocuments placed  before it  has dismissed  the writ<br \/>\npetition filed\tby the\tappellant by  simply accept  so\t the<br \/>\nconclusions  reached  by  the  second-respondent  Committee.<br \/>\nUndoubtedly, in\t cases of this type, the burden heavily lies<br \/>\non the applicant who seeks such a certificate. That does not<br \/>\nmean that  the authorities  have no  role to play in finding<br \/>\nout the correctness or otherwise of the claim for issue of a<br \/>\ncaste certificate.  We are  of the  view that  the concerned<br \/>\nauthorities must also play a role in assisting the Committee<br \/>\nto arrive  at a\t correct decision.  In this case, except the<br \/>\ndocuments  produced  by\t the  appellant,  nothing  has\tbeen<br \/>\nproduced  by   the  concerned  authorizes  to  arrive  at  a<br \/>\ndifferent conclusion.\n<\/p>\n<p>     On the  facts of this case, we are of the view that the<br \/>\nsecond-respondent Committee  was not  right in rejecting the<br \/>\nclaim of  the appellant and for the same reason the order of<br \/>\nthe High  Court cannot\tbe sustained.  In  the\tresult,\t the<br \/>\nappeal succeeds\t and is\t allowed accordingly.
