1.\tThe
\npresent appellant has preferred this Appeal under Section 374 of the
\nCode of Criminal Procedure, against the judgment and order of
\nconviction and sentence dated 6.8.1997 passed by the learned
\nAdditional Sessions Judge, Vadodara   in Atrocity Case No.22 of 1995,
\nwhereby the learned Sessions Judge has convicted the appellant for
\nthe offences punishable under Sections 354, 506 of the Indian Penal
\nCode, Section 3(1) (11) of the Scheduled Caste and Scheduled Tribe
\n(Prevention of Atrocity) Act, 1989. For the offence punishable under
\nSections 354 of the Indian Penal Code,  the learned trial Judge was
\npleased to sentence the appellant to undergo R.I. for 1 year and to
\npay a fine of Rs.250\/-, in default, to undergo further S.I. for three
\nmonths. The appellant was sentenced R.I. for 5 years for the offence
\npunishable under Section 506(2) of th Indian Penal Code and to pay a
\nfine of Rs.250\/-, in default, to undergo further S.I. for one year
\nand for the offence punishable under Section 3(1) (11) of the
\nAtrocity Act, the appellant was ordered to undergo three years R.I.
\nand to pay a fine of Rs.500\/-, in default, further to undergo S.I.
\nfor three months<\/p>\n
\tThe
\nbrief facts of the prosecution case is as under:\n<\/p>\n
2.\tThe
\nallegations levelled against the accused is that on 7.10.1994, when
\nthe complainant was going to her home, the appellant met her in the
\nway and tried to snatch her hand. The appellant threatened her that
\nif she would shout, she would be killed by Farsi. Thereafter the
\ncomplainant escaped and ran away from that place and therefore, the
\nappellant chased the complainant, but suddenly her mother went there
\nand thereafter, both i.e. complainant and her mother went their
\nresidence. Thereafter, the complaint was lodged against the accused
\nfor the offence punishable under sections 354, 506 of the Indian
\nPenal Code, section 3(1) (11) of the Scheduled Caste and Scheduled
\nTribe (Prevention of Atrocity) Act, 1989.\n<\/p>\n
3.\tThereafter,
\nstatements of the witnesses were recorded, panchnama was drawn and
\naccused was arrested. The medical check up of the victim was done and
\ndue to sufficient evidence against the appellant, charge-sheet was
\nfiled before the learned Judicial Magistrate First Class. Thereafter,
\nas the case was exclusively triable by the Court of Sessions, the
\nlearned Metropolitan Magistrate has committed the case to the Court
\nof Sessions, which was numbered as Sessions Case No. 22 of 1995.\n<\/p>\n
4.\tThereafter,
\nthe charge was framed against the appellant. The appellant –
\naccused has pleaded not guilty and claimed to be tried.\n<\/p>\n
5.\tTo
\nprove the case against the appellant, the prosecution has produced
\ndocumentary evidence and also examined in all 5 witnesses before the
\ntrial Court and on behalf of the defence side, 5 witnesses have been
\nexamined.\n<\/p>\n
6.\tThereafter,
\nafter examining the witnesses, further statement of the appellant –
\naccused under Section 313 of the Code of Criminal Procedure was
\nrecorded in which the appellant – accused has denied the case
\nof the prosecution.\n<\/p>\n
7.\tAfter
\nconsidering the oral as well as documentary evidence and after
\nhearing the parties, learned Additional Sessions Judge, Vadodara vide
\njudgment and order dated 6.8.1997 held the appellant – accused
\nguilty to the charge levelled against him under Sections 354, 506 of
\nthe Indian Penal Code, Section 3(1) (11) of the Scheduled Caste and
\nScheduled Tribe (Prevention of Atrocity) Act, 1989, as stated above.\n<\/p>\n
8.\tFeeling
\naggrieved and dissatisfied with the impugned judgment and order of
\nconviction and sentence passed by the learned Additional Sessions
\nJudge, Vadodara, the present appellant has preferred this appeal.\n<\/p>\n
9.\tLearned
\nadvocate Mr. B.S. Patel appearing on behalf of the appellant
\nsubmitted that there were several contradiction between the
\ndocumentary evidence produced by the prosecution. Even the main
\ningredients of Section 506(2) of the Indian Penal Code is not proved.
\nThe order which is passed by the learned trial Judge is not just and
\nproper and there is delay in lodging the complaint. He further
\nsubmitted that he is only arguing on the point quantum and submitted
\nthat the undergone period of the appellant may be considered as
\nsentence and the appellant may be set at liberty by allowing this
\nAppeal.\n<\/p>\n
10.\tThe
\nlearned APP Mr. H.H. Parikh for the State strongly opposed the
\nsubmissions made by the learned advocate for the appellant. It
\nwas contended by learned APP that the judgment and order of the
\nSessions Court is just and proper and as per the provisions of law;
\nthe Sessions Court has properly considered the evidence led by the
\nprosecution and looking to the provisions of law itself it is
\nestablished that the prosecution has proved the whole ingredients of
\nthe evidence against the present appellant. Learned APP has also
\ntaken this court  through the oral as well  as the entire documentary
\nevidence.\n<\/p>\n
11.\tI
\nhave perused the judgment and order and reasons given by the learned
\nJudge also and I am in total agreement of the reasons assigned by the
\nlearned trial Judge. I have considered his submission about the
\nquantum of punishment and considering the facts and circumstances of
\nthe case, I am not inclined to consider the undergone period of the
\nappellant as sentence, but I hold that out of total sentence, he has
\nto undergo six months in jail.\n<\/p>\n
12.\t\tFor
\nthe reasons recorded in the judgment, this Appeal is partly allowed.
\nThe judgment  and order dated 6.8.1997 passed by the learned
\nAdditional Sessions Judge, Vadodara in Atrocity Case No.22 of 1995,
\nholding the appellant – accused guilty for the offence
\npunishable under Sections 354 of the Indian Penal Code and was
\npleased to sentence the appellant to undergo R.I. for 1 year and to
\npay a fine of Rs.250\/-, in default, to undergo further S.I. for three
\nmonths. The appellant was sentenced R.I. for 5 years for the offence
\npunishable under Section 506(2) of th Indian Penal Code and to pay a
\nfine of Rs.250\/-, in default, to undergo further S.I. for one year
\nand for the offence punishable under Section 3(1) (11) of the
\nAtrocity Act, the appellant was ordered to undergo three years R.I.
\nand to pay a fine of Rs.500\/-, in default, further to undergo S.I.
\nfor three months.\n<\/p>\n
\tThe
\nsentenced aforesaid imposed by the learned Sessions Judge is  hereby
\nreduced to the extent of 6 months instead of 5 years (all sentence).
\nTherefore, the appellant is ordered to undergo the sentence of 6
\nmonths imposed by the learned Sessions Judge.\n<\/p>\n
\tThe
\nappellant is hereby directed to surrender before the Jail Authority
\nwithin four weeks from the date of this order, failing which, the
\nconcerned  Court shall issue non-bailable warrant to effect the
\narrest of the appellant. The fine imposed by the learned Sessions
\nJudge, if not paid by the appellant, then he is ordered to pay the
\nfine imposed in the aforesaid order of the learned Sessions Judge. R
\n& P, if received, be sent back to the trial Court, forthwith.\n<\/p>\n
