KODEKAR, APP, for Respondent(s) : 1, \nNone\nfor Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr. Kodekar, learned APP, appears and waives service of rule on<br \/>\nbehalf of the respondent State of Gujarat.\n<\/p>\n<p>2.\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing.\n<\/p>\n<p>3.\t\tBy<br \/>\nfiling instant application through jail authority, the<br \/>\napplicant-convict who, by judgement and order dated 31.1.2008<br \/>\nrendered in Sessions Case No.  45 of 2006 by learned Sessions Judge,<br \/>\nNavsari, has been convicted for the offences punishable under<br \/>\nSections 307, 376 etc. of the Indian Penal Code, has prayed for<br \/>\nsuspension of sentence and to release<br \/>\nhim on bail during the pendency and final disposal of the above<br \/>\nnumbered Criminal Appeal.\n<\/p>\n<p>4.\t\tHaving<br \/>\nconsidered the submissions advanced by Mr. Kodekar, learned APP and<br \/>\nupon perusal of the averments made in the application so also the<br \/>\nimpugned judgement and order and the record of the case, it is seen<br \/>\nthat earlier application seeking suspension of sentence and to<br \/>\nrelease the applicant on bail has been rejected vide order dated<br \/>\n10.2.2009 passed in  Criminal Miscellaneous Application No. 1334 of<br \/>\n2009 by a co-ordinate Bench of this Court . Therefore, obviously,<br \/>\nthis bail application, being successive bail application and since no<br \/>\nnew ground is canvassed in this application for suspension of<br \/>\nsentence and to release the applicant on regular bail, cannot<br \/>\nentertained.\n<\/p>\n<p>5.\t\tFor<br \/>\nthe foregoing reasons, the application lacks merit and the same is<br \/>\nrejected.\n<\/p>\n<p>6.\t\tRule<br \/>\nis discharged.\n<\/p>\n<p>     (A.M.
