Justice ANTONY DOMINIC\n\n Dated :27\/11\/2007\n\n O R D E R\n                  ANTONY DOMINIC, J.\n\n             = = = = = = = = = = = = = = =\n             W.P.(C) No. 34795 OF 2007 - P\n             = = = = = = = = = = = = = = =\n\n           Dated this the 27th November, 2007.\n\n                    J U D G M E N T\n<\/pre>\n<p>    Petitioner had applied for issuance of a passport and<\/p>\n<p>Exts. P1 and P2, which were produced by the petitioner to<\/p>\n<p>prove of her date of birth and these documents showed<\/p>\n<p>different dates.  Thereupon, the passport authority issued<\/p>\n<p>Ext.P3 requiring the petitioner to furnish information<\/p>\n<p>regarding the discrepancy in dates.       At that stage,<\/p>\n<p>petitioner  filed  Ext.P4  application  (CMP   No.5120\/07)<\/p>\n<p>before  the   Judicial  First   Class  Magistrate   Court,<\/p>\n<p>Payyannur, for an order to the effect that the date of<\/p>\n<p>birth of the petitioner shown in    Ext.P1 is the correct<\/p>\n<p>one.  It is in view of the delay in passing orders on<\/p>\n<p>Ext.P4, that this writ petition has been filed praying for<\/p>\n<p>directing the Judicial First class Magistrate to pass<\/p>\n<p>orders on Ext.P4.\n<\/p>\n<p>    2.   The Ministry of External Affairs (PV-1 Section)<\/p>\n<p>have  issued circular  dated  29th  October,  2007, which<\/p>\n<p>governs the change of date of birth and place of birth in<\/p>\n<p>passports.   Clause (d) thereof being relevant for the<\/p>\n<p>W.P.(C)No.34795 OF 2007\n<\/p>\n<p>                              &#8211; 2 &#8211;\n<\/p>\n<p>particular case, it is extracted below for reference:<\/p>\n<blockquote><p>    &#8220;Where the initial entry has been made on the<br \/>\n    basis of a supportive document issued by one<br \/>\n    competent      authority  i.e.  School\/ educational<br \/>\n    authority and the applicant subsequently requests<br \/>\n    for a change on the basis of a certificate issued<br \/>\n    by another competent authority i.e., Municipal<br \/>\n    authorities       etc,  resulting   in  conflicting<br \/>\n    documents for valid proof, the PIA should direct<br \/>\n    the applicant to procure an order from a First<br \/>\n    Class Judicial Magistrate, to effect the change as<br \/>\n    per Passport Manual 2001 (In some States, this<br \/>\n    function is discharged by Civil Magistrates)&#8221;.\n<\/p><\/blockquote>\n<p>Standing counsel fro the respondent would submit that<\/p>\n<p>since the documents produced by the petitioner contains<\/p>\n<p>different dates of birth, unless the petitioner produces<\/p>\n<p>an order from the Judicial Magistrate as required, in the<\/p>\n<p>aforesaid background, they will not be in a position to<\/p>\n<p>consider the request of the petitioner.<\/p>\n<p>     3.    In view of the above, although the circular<\/p>\n<p>deals in the correction of date of birth in passport only,<\/p>\n<p>it is evident that unless orders are obtained on Ext.P4<\/p>\n<p>application made by the petitioner, the case of the<\/p>\n<p>petitioner     will    not be  considered for issuance   of<\/p>\n<p>passport.    If that be so, expeditious orders on Ext.P4 is<\/p>\n<p>necessary.\n<\/p>\n<p>     4.
