Justice C.N.RAMACHANDRAN NAIR\n\n Dated :16\/03\/2007\n\n O R D E R\n                    C.N.RAMACHANDRAN NAIR, J.\n\n                 ----------------------------------------\n\n                      WP(C) No. 36426 of 2003 J\n\n              ----------------------------------------------\n\n              Dated, this the 16th day of March, 2007\n\n\n                               J U D G M E N T\n<\/pre>\n<p>      Heard   the   learned   counsel   for   the   petitioner,   the   learned<\/p>\n<p>Standing   Counsel   appearing   for   the   1st  respondent,   the   learned<\/p>\n<p>Government   Pleader   and   the   learned   counsel   appearing   for   the<\/p>\n<p>additional 4th respondent impleaded.\n<\/p>\n<\/p>\n<p>      2. The petitioner as Convener of beneficiary committee was<\/p>\n<p>awarded contract for construction of protection wall for a canal in<\/p>\n<p>the   3rd  respondent   panchayat.     The   petitioner   is   advanced   an<\/p>\n<p>amount   of   Rs.   1   lakh   and   according   to   the   petitioner,   granite<\/p>\n<p>rubble   for   more   than   the   value   of   Rs.   1   lakh   is   procured   and<\/p>\n<p>stored   in   the   work   site.     Petitioner   has   produced   some<\/p>\n<p>photographs, which shows that same quantity of granite rubble is<\/p>\n<p>stored   in   the   area.     The   learned   counsel   appearing   for   the   1st<\/p>\n<p>respondent submitted that on account of delay, work had to be<\/p>\n<p>cancelled.   The dispute raised by the additional 4th  respondent is<\/p>\n<p>that   petitioner   has   not   allowed   committee   members   to   co-<\/p>\n<p>operate in the work.  It is seen that besides this case, there were<\/p>\n<p>W.P.(C)No. 36426\/2003<\/p>\n<p>                                 -Page numbers-\n<\/p>\n<p>\ntwo other writ petitions in this Court, which were all disposed of<\/p>\n<p>as of now.  In WP(C) No. 2403\/2005, there was a direction to the<\/p>\n<p>Taluk Surveyor to survey the property and earmark the course of<\/p>\n<p>the canal and the course for protection wall to be constructed by<\/p>\n<p>the petitioner.  If this is not done so far, the Taluk Surveyor has<\/p>\n<p>to do it without any delay.   I do not think delay in execution of<\/p>\n<p>work   is   attributable   to   the   petitioner   because   obviously   the<\/p>\n<p>matter was in litigation in this Court and also in Civil Court.  More<\/p>\n<p>over, if the work is cancelled and rearranged, the same will lead<\/p>\n<p>to   higher   cost   to   the   beneficiaries   and   ultimately   loss   to   the<\/p>\n<p>public at large.  In the circumstance  and since the petitioner has<\/p>\n<p>procured   substantial   quantity   of   material,   this   writ   petition   is<\/p>\n<p>disposed of with the following directions.  The 2nd respondent and<\/p>\n<p>the   engineer   allotted   by   the   1st  respondent   will   evaluate   and<\/p>\n<p>oversee   the   execution   of   the   contract.     The   material   procured<\/p>\n<p>should be valued first and if there is provision in the contract to<\/p>\n<p>advance   funds   to   the   petitioner   to   procure   material   for   the<\/p>\n<p>execution   of   the   work,   they   will   go   by   the   contract   and   make<\/p>\n<p>advances to the petitioner, if permissible, as per the terms under<\/p>\n<p>W.P.(C)No. 36426\/2003<\/p>\n<p>                                -Page numbers-\n<\/p>\n<p>\nthe contract after collecting security.
