PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present<br \/>\napplication has been filed by the applicants for grant of regular<br \/>\nbail under sec. 439 of the Code of Criminal Procedure after the<br \/>\ncharge sheet is filed.\n<\/p>\n<p>2.\tThe applicant-accused<br \/>\nis charged with having committed offences under sections 395, 397,<br \/>\n457 of IPC and sec. 135 of the Bombay Police Act for which FIR, being<br \/>\nC.R. No. I-326\/1998, has been registered with Gondal Taluka Police<br \/>\nStation.\n<\/p>\n<p>3.\tLearned advocate Mr.<br \/>\nSheth submitted that considering the nature of offences as charge<br \/>\nsheet has been filed, the present application may be allowed. He<br \/>\nsubmitted that the allegation is that he was absconding and Sessions<br \/>\nCase Nos. 76\/2003 and 67\/2005 against the two other co-accused have<br \/>\nbeen over and they have been acquitted. He also submitted that he was<br \/>\nnot aware being a labourer and therefore the present application may<br \/>\nbe allowed.\n<\/p>\n<p>4.\tLearned APP Ms. Shah<br \/>\nresisted the application.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr. Sheth and learned APP Ms. Shah and having<br \/>\nconsidered the nature of offence, the role attributed and also<br \/>\nconsidering the overall facts and circumstances that the applicant is<br \/>\na labourer who is alleged to have been involved in the loot of Rs.<br \/>\n7000-8000 and the fact that other co-accused have been in fact<br \/>\nacquitted in the sessions cases, the interest of justice would be<br \/>\nserved if he is released on bail.\n<\/p>\n<p>6.\tThe application is<br \/>\naccordingly allowed.  The applicant is ordered to be released on bail<br \/>\nin connection with C.R. No. I-326\/1998 registered with  Gondal Taluka<br \/>\nPolice Station,  on his executing a personal bond of Rs. 5,000\/-<br \/>\n(Rupees Five Thousand only) with one solvent surety for the like<br \/>\namount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the trial commences.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
