Secretary &amp; PIO,\n                                                  Govt. of NCT of Delhi,\n                                                  Ministry of Urban Development,\n                                                  C Wing, Nirman Bhawan,\n                                                  New Delhi.\n\nRTI application filed on                 :        17\/10\/2007\nPIO replied                              :        15\/01\/2008\nFirst appeal filed on                    :        18\/01\/2008\nFirst Appellate Authority order          :        08\/02\/2008\nSecond Appeal filed on                   :        04\/07\/2008\n\nInformation Sought:\n<\/pre>\n<p>The Appellant had filed an application regarding the Classification of colonies in Delhi under Unit<br \/>\nArea method i.e. A, B, C, D, E, F, G in Master Plan Delhi-2001 and corrected up to 07-th September,<br \/>\n2006.\n<\/p>\n<p>The PIO&#8217;s Reply:\n<\/p>\n<p>It is stated that Part-I of the ID relates to Town Planning and Part-II of ID relates party<br \/>\nWith Town Planning Department and party with A &amp; C Dept.<\/p>\n<p>The First Appellate Authority Ordered:\n<\/p>\n<p>&#8220;It is also seen that the original I.D. has been transferred to other Department. The PIO i.e. A &amp; C is<br \/>\ndirected to furnish the reply to the appellant, if the information is available in their record within 10<br \/>\ndays from the receipt of this order.&#8221;\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. K. Chand<br \/>\nRespondent: Mr. R.K.Gupta representing Mr. A.K.Ambast PIO<br \/>\n                PIO of building department to whom notice was issued was absent<br \/>\nSome information has been provided to the appellant by A&amp;C department. The appellant<br \/>\nwants a classification of the colonies as authorized, unauthorized etc. The respondent states<br \/>\nthat to his knowledge this information is not available in the format asked for by the<br \/>\nappellant. The appellant has produced various papers of MCD in which it is stated that certain<br \/>\ncolonies are authorized, unauthorized and so on. He therefore contends that MCD has this<br \/>\nrecord.\n<\/p>\n<p> The respondent has submitted that an application was made to Ministry of Urban<br \/>\nDevelopment, Central Government who transferred it to DDA and they in tern transferred it<br \/>\nto MCD. Within the MCD the application was transferred to Town and Planning department.<br \/>\nThey in tern transferred to assessment and collection department. The first appellate authority<br \/>\nwised its order dated 31st Jan, 2008 directed to the PIO, Shri A,K,Ambast to reply to the<br \/>\nappellant if the information is available in the record. The PIO furnished the information to<br \/>\nthe appellant that is 36 pages indicating list of colonies indicating categories.<br \/>\n    It is not possible for the Commission to resolve this issue. It therefore directs the<br \/>\nAdditional Commissioner,-Engineering, -to certify if this record is available or not. If the<br \/>\nrecord is available the appropriate PIOs should be directed to provide the information directly<br \/>\nto the appellant. If this information is not available in the MCD the Additional<br \/>\nCommissioner -Eng. will send the Commission a certificate to the effect that this information<br \/>\nis not available and send a copy of the same to the appellant.\n<\/p>\n<p>Decision:\n<\/p>\n<p>Appeal is allowed.\n<\/p>\n<p>The Additional Commissioner will either direct the appropriate officers to ensure that<br \/>\nthe information is sent to the to the appellant before 30 January 2009, or issue a<br \/>\ncertificate by then to the appellant and the Commission that such information is not<br \/>\navailable in the format with MCD.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties<\/p>\n<p>                                                             Shailesh Gandhi<br \/>\n                                                        Information Commissioner<br \/>\n                                                           5 January 2009<\/p>\n<p>(In any correspondence on this decision, mentioned the complete decision number.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Central Information Commission Mr. K.
