Sinha, Sr. Advocate.\n         For the Respondents       : - Mr. Manoj Tandon, S.C.-II.\n                                          ...\n         C.A.V on : 21.05.2009                Pronounced on : 26.05.2009\n\n5\/ 26.05.2009<\/pre>\n<p>     Heard Sri Anil Kumar Sinha, Learned senior advocate for the<br \/>\n            petitioner and Sri Manoj Tandon, Standing Counsel-II for the<br \/>\n            respondents and with their consent, this case is taken up for disposal<br \/>\n            at the stage of admission itself.\n<\/p>\n<p>            2.    Challenge in this writ application is to the order dated<br \/>\n            08.02.2008 (Annexure-9) issued under the signature of the Deputy<br \/>\n            Secretary, Department of Personnel, Administrative Reforms,<br \/>\n            Government of Jharkhand whereby the petitioner, who was posted<br \/>\n            as Member Secretary of the State Commission for Backward Classes,<br \/>\n            has been directed to submit his papers in prescribed proforma for<br \/>\n            processing of his death-cum-retiral dues.\n<\/p>\n<p>                  Besides praying for quashing the aforesaid impugned order,<br \/>\n            the petitioner has also prayed to issue a direction upon the<br \/>\n            respondents to allow the petitioner to complete three years tenure of<br \/>\n            service on the post of Member Secretary in the Commission and to<br \/>\n            restrain the respondents to dispense with the services of the<br \/>\n            petitioner, on the said post.\n<\/p>\n<p>            3.    The petitioner, who was earlier holding the substantive post of<br \/>\n            Joint Secretary in the Government of Jharkhand, was posted as<br \/>\n            Member Secretary of the State Commission for Backward Classes,<br \/>\n            Jharkhand at Ranchi by Notification dated 05.04.2007 (Annexure-4).\n<\/p>\n<p>                  By filing his representation (Annexure-5) on 05.04.2007 itself,<br \/>\n            he expressed his unwillingness to join on the said post and requested<br \/>\n            for cancelling the notification.\n<\/p>\n<p>                  His request was not accepted by the Government and he was<br \/>\n            directed to submit his joining as per notification (annexure-4).\n<\/p>\n<p><span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>        Pursuant to the aforesaid direction, he submitted his joining on<br \/>\nthe post of Member Secretary of the Commission on 10.05.2007.\n<\/p>\n<p>        Almost eight months thereafter, he was served with the<br \/>\nimpugned order whereby he was intimated that he would retire on<br \/>\n31.12.2008 and was called upon to submit his pension papers.\n<\/p>\n<p>4.      Assailing the impugned letter, the petitioner has raised inter-<br \/>\nalia the following grounds :-\n<\/p>\n<p>(i)     The petitioner&#8217;s appointment to the post of Member Secretary<br \/>\n        was made in exercise of powers conferred under Section 3 of<br \/>\n        the State Commission for Backward Classes Act, 1993.\n<\/p>\n<p>(ii)    The post of Member Secretary, being a tenure post, the<br \/>\n        provision of Section 4(1) of the Act stipulates that every<br \/>\n        member shall remain on the post for three years from the date<br \/>\n        of his appointment.\n<\/p>\n<p>(iii)   The corresponding rules framed under the provisions of<br \/>\n        Section 17(2)(a) of the Act stipulates that members who on the<br \/>\n        date of his appointment to the Commission was in the service<br \/>\n        of the Central or a State Government shall be deemed to have<br \/>\n        retired from such service with effect from the date of his<br \/>\n        appointment as member of such service.\n<\/p>\n<p>(iv)    The petitioner, having joined the post of Member Secretary on<br \/>\n        10.05.2007, has the right therefore to continue in office for the<br \/>\n        entire tenure period i.e. three years from the date of his<br \/>\n        joining.\n<\/p>\n<p>(v)     The petitioner&#8217;s service conditions in the post of Member<br \/>\n        Secretary, being guided by the statutory rules of the post, the<br \/>\n        respondents cannot curtail the tenure of service of the<br \/>\n        petitioner on the aforesaid post.\n<\/p>\n<p>5.      Elaborating the grounds and explaining the background facts,<br \/>\nSri Anil Kumar Sinha, learned senior advocate for the petitioner<br \/>\nsubmits that vide Notification dated 05.04.2007, the petitioner was<br \/>\nappointed on the post of Member Secretary of the Commission by<br \/>\ntransferring him from the post of Joint Secretary in the Department<br \/>\nof Planning and Development, Government of Jharkhand, till further<br \/>\norders. The petitioner had protested seeking clarifications as to why<br \/>\n<span class=\"hidden_text\">                          -3-<\/span><\/p>\n<p>he has been posted till further orders instead of posting on the post<br \/>\nfor three years. Instead of taking cognizance of the protest, he was<br \/>\nasked to give his joining on the post of Member Secretary and submit<br \/>\ncompliance report. Learned counsel argues that even though the<br \/>\npetitioner&#8217;s appointment on the post was indicated as a posting till<br \/>\nfurther orders from the date of notification, but this in itself would<br \/>\nnot deprive the rights accrued to the petitioner under the Act and the<br \/>\nRules thereunder since the tenure of service of the petitioner on the<br \/>\naforesaid post cannot be guided by the statutory rules and his service<br \/>\nconditions shall have to be guided only in accordance with service<br \/>\nconditions applicable to the particular post.\n<\/p>\n<p>       The letter of posting, according to the learned counsel, is<br \/>\nconcerned only with the entry of the petitioner in the particular<br \/>\nservice\/cadre and thereafter, the service conditions relating to the<br \/>\nperiod of working shall prevail. To gain support to his arguments,<br \/>\nlearned counsel refers to and relies upon the judgement of the<br \/>\nSupreme Court in the case of <a href=\"\/doc\/176192\/\">P.Venugopal vs. Union of India<\/a> 2008(5)<br \/>\nSCC 1.\n<\/p>\n<p>6.     Per contra, the stand taken by the respondents, as explained by<br \/>\nSri Manoj Tandon, learned counsel for the respondents, is as follows<br \/>\n:-\n<\/p>\n<p>(i)    By the notification dated 05.04.2007 (Annexure-4), the<br \/>\n       petitioner was posted as Member Secretary in the Commission.<br \/>\n       The notification had clearly stipulated that such posting would<br \/>\n       be till further orders and not in terms of the provisions of<br \/>\n       Section 4 of the Act which mentions the tenure of three years.<br \/>\n       The petitioner&#8217;s posting was thus on deputation allowing him<br \/>\n       to retain his lien in the substantive post of Joint Secretary<br \/>\n       under the State Government.\n<\/p>\n<p>(ii)   Though     the   petitioner    had    initially   expressed   his<br \/>\n       unwillingness to join the post seeking clarification in respect of<br \/>\n       his tenure of posting, he had accepted the fact that his posting<br \/>\n       as Member Secretary of the Commission was by way of<br \/>\n       deputation only. Such admission would be evident from the<br \/>\n       fact that he availed the pay scale of Joint Secretary with all<br \/>\n<span class=\"hidden_text\">                             -4-<\/span><\/p>\n<p>          benefits\/allowances and has also availed the Special pay for<br \/>\n          officiating in the post of Member Secretary which was allowed<br \/>\n          to him.\n<\/p>\n<p> (iii)    The petitioner who had retained his lien on the substantive<br \/>\n          post, has to be guided by the conditions of service under the<br \/>\n          statute and he cannot claim to be retained in service beyond<br \/>\n          the date of his superannuation.\n<\/p>\n<p> (iv)     The judgement in the case of P.Venugopal (Supra) would not<br \/>\n          be applicable to the facts of the petitioner&#8217;s case since the<br \/>\n          questions involved in the case of Venugopal was significantly<br \/>\n          different from the issues raised in the present application.\n<\/p>\n<p>7.        From the rival submissions the facts which emerge and the<br \/>\nlogical and reasonable inference drawn is that the petitioner&#8217;s posting<br \/>\non the post of Member Secretary of the Commission was not strictly<br \/>\nan appointment to the post. As declared in the notification (Annexure-\n<\/p>\n<p>4), his posting as Member Secretary of the Commission was by way of<br \/>\nhis transfer with privilege to retain his lien on his substantive post.<br \/>\nThe petitioner was thus allowed to officiate in the post of Member<br \/>\nSecretary and for which he was allowed to draw the Special Pay by<br \/>\nway of officiating allowance, in addition to the scale of pay of his<br \/>\nsubstantive post. The fact that his posting was only for a limited<br \/>\nperiod, the inference therefore is that such posting was not in<br \/>\nconsonance with the conditions of service as laid down under Section<br \/>\n4(1) of the Act and for all practical purposes it was only a stop gap<br \/>\narrangement.\n<\/p>\n<p>         Since the petitioner&#8217;s posting was not by way of appointment<br \/>\non substantive post of Member Secretary, he cannot claim to be<br \/>\nguided under the service conditions as laid down under Section 4 of<br \/>\nthe Act and neither would the corresponding Rules of the Act apply to<br \/>\nthe petitioner. For the same reason, the Rules relating to the salary and<br \/>\nallowances applicable to the member Secretary of the Commission<br \/>\nwill not apply to the petitioner and as indicated, it was in acceptance<br \/>\nof this aspect that the petitioner had not claimed the salary and<br \/>\nallowances applicable to the post of Member Secretary of the<br \/>\nCommission. Rather, he had claimed and was allowed to draw the<br \/>\n<span class=\"hidden_text\">                                        -5-<\/span><\/p>\n<p>              salary in the scale of Joint Secretary together with all allowances. The<br \/>\n              petitioner shall therefore have to be guided by the conditions of his<br \/>\n              service applicable to his original substantive post.\n<\/p>\n<p>              8.     The judgement in the case of P.Venugopal (Supra) would not<br \/>\n              apply to the facts of the present case. In the case of P.Venugopal, his<br \/>\n              was a direct appointment on a substantive tenure post of Director<br \/>\n              whereas in the instant case, the petitioner was not appointed on a<br \/>\n              tenure post since, as declared in the annexure-4, he was posted as<br \/>\n              Member Secretary only till further orders and not in terms of the<br \/>\n              provisions of Section 4 of the Act.\n<\/p>\n<p>              9.     In the light of the above discussions, I do not find any merit in<br \/>\n              this application. Accordingly, this writ application is dismissed. The<br \/>\n              interim order passed by this Court on 04.12.2008 is hereby vacated.\n<\/p>\n<p>                                                               (D.G.R.
