    This revision petition is preferred by the accused in a<\/p>\n
prosecution for an offence punishable under Sec.138 of the<\/p>\n
Negotiable Instruments Act, as he is aggrieved by the<\/p>\n
conviction and sentence ordered by the courts below.<\/p>\n
    2.   The   case   of   the    complainant     is that the<\/p>\n
accused\/revision petitioner borrowed a sum of Rs.30,000\/-<\/p>\n
from the complainant and towards the discharge of the debt<\/p>\n
due to the complainant, he issued a cheque dated 19.7.2005<\/p>\n
for a sum of Rs.90,000\/-, which when presented for<\/p>\n
encashment dishonoured, as there was no sufficient fund in<\/p>\n
the account maintained by the accused and the cheque<\/p>\n
amount was not repaid inspite of a formal demand notice<\/p>\n
and thus the revision petitioner has committed the offence<\/p>\n

punishable u\/s.138 of the Negotiable Instruments Act. With<\/p>\n
the said allegation, the complainant approached the Judl.<\/p>\n
First Class Magistrate Court, Chavakkad, by filing a formal<\/p>\n
complaint, upon which cognizance was taken u\/s.138 of the<\/p>\n
Negotiable         Instruments       Act   and   instituted<\/p>\n
C.C.No.967\/2005.        During the trial of the case, the<\/p>\n
complainant himself was examined as PW1 and Exts.P1 to<\/p>\n
P6 were marked. No evidence was adduced from the side<\/p>\n
of the defence. On the basis of the available materials and<\/p>\n
evidence on record, the trial court has found that the<\/p>\n
cheque      in   question  was      issued by the  revision<\/p>\n
petitioner\/accused for the purpose of discharging his debt<\/p>\n
due to the complainant. Thus accordingly the court found<\/p>\n
that, the complainant has established the case against the<\/p>\n
accused\/ revision petitioner and consequently held that the<\/p>\n
accused is guilty and thus convicted him u\/s.138 of the<\/p>\n
Negotiable Instruments Act. On such conviction, the trial<\/p>\n
court sentenced the revision petitioner to undergo simple<\/p>\n
Crl.R.P.No.2989 of 2010<\/p>\n

imprisonment for a period of three months and to pay a<\/p>\n
compensation of Rs.90,000\/- to the complainant and the<\/p>\n
default    sentence    is fixed    as three months     simple<\/p>\n
imprisonment.\n<\/p>\n
      3. Though an appeal was filed, at the instance of the<\/p>\n
revision petitioner\/accused, by judgment dated 6.7.2010 in<\/p>\n
Crl.A.No.913\/2007, the Court of Sessions Judge, Thrissur<\/p>\n
allowed the appeal only in part, and while confirming the<\/p>\n
conviction, the substantial sentence is modified and reduced<\/p>\n
to imprisonment till the rising of the court. It is the above<\/p>\n
conviction and sentence are challenged in this revision<\/p>\n
petition.\n<\/p>\n
      4. I have heard the learned counsel appearing for the<\/p>\n
revision petitioner and also perused the judgments of the<\/p>\n
courts below.\n<\/p>\n
      5.   The learned counsel for the revision petitioner<\/p>\n
submitted that the complainant who was examined as PW1<\/p>\n
was not cross examined and therefore the matter may be<\/p>\n

remitted back to the trial court for cross examining PW1. I<\/p>\n
am unable to sustain the above contention, since the trial<\/p>\n
court has observed that though PW1 was available for cross<\/p>\n
examination, he was not cross examined. It is also relevant<\/p>\n
to note that no steps were taken by the revision petitioner<\/p>\n
to recall the witnesses for the purpose of cross examination<\/p>\n
at any point of time before the disposal of the matter by the<\/p>\n
trial court. It is also relevant to note that the complainant<\/p>\n
has filed a suit against the revision petitioner and he had<\/p>\n
obtained a decree in his favour and towards the execution<\/p>\n
of the decree he had attached the property of the revision<\/p>\n
petitioner.    So the liability of the revision petitioner is<\/p>\n
established and there is laches on the part of the revision<\/p>\n
petitioner in not cross examining the complainant at<\/p>\n
appropriate time and there is sheer negligence in taking<\/p>\n
any effective steps for cross examining PW1. Therefore, I<\/p>\n
am of the view that it is illegal and improper to remit the<\/p>\n
matter back to court below at this stage.\n<\/p>\n

      6.    As this court is not inclined to interfere with the<\/p>\n
order of conviction recorded by the courts below, the<\/p>\n
learned counsel for the revision petitioner submitted that<\/p>\n
the sentence of imprisonment ordered by the court below is<\/p>\n
unreasonable and exorbitant and it requires reconsideration<\/p>\n
and some breathing time be granted to pay the<\/p>\n
compensation amount.\n<\/p>\n
      7.    Having regard to the facts and circumstances<\/p>\n
involved in the case, I am of the view that the said<\/p>\n
submission can be considered positively keeping in mind<\/p>\n
that the cheque in question pertaining to the year 2005.<\/p>\n
The Apex Court in the decision in Damodar S.Prabhu V.<\/p>\n
Sayed Babalal H. (JT<\/a> 2010(4) SC 457) has held that, in<\/p>\n
the case of dishonour of cheques, the compensatory aspect<\/p>\n
of the remedy should be given priority over the punitive<\/p>\n
aspects. In the light of the above settled legal position and<\/p>\n
the facts referred above, I am of the view that the sentence<\/p>\n
of imprisonment ordered by the court below can be<\/p>\n

modified and while granting some time to the revision<\/p>\n
petitioner to pay the compensation amount, the amount can<\/p>\n
be enhanced slightly.\n<\/p>\n
            In the result, this revision petition is disposed of<\/p>\n
confirming the conviction of the revision petitioner u\/s.138<\/p>\n
of the Negotiable Instruments Act as recorded by the courts<\/p>\n
below.     Accordingly, while confirming the sentence of<\/p>\n
imprisonment as modified and fixed by the appellate court,<\/p>\n
and confirming the order to pay compensation and also the<\/p>\n
default sentence, the compensation amount is enhanced as<\/p>\n
95,000\/-, which shall be paid within three months from<\/p>\n
today.    Accordingly the revision petitioner is directed to<\/p>\n
appear before the trial court on 11th January, 2011 to<\/p>\n
receive the sentence and to pay the revised compensation<\/p>\n
amount. If there is any failure on the part of the revision<\/p>\n
petitioner in appearing before the court below and paying<\/p>\n
the compensation amount, the trial court is free to take<\/p>\n
coercive steps to secure the presence of the revision<\/p>\n
Crl.R.P.No.2989 of 2010<\/p>\n

petitioner and to execute the sentence. The coercive steps<\/p>\n
if any, pending against the revision petitioner shall be<\/p>\n
deferred till 11.1.2011.\n<\/p>\n
