Agrawal Sr.  Advocate  with  Ms.\n          Rinki  Tamrakar, Advocate for the respondents\n          No.4 & 5.\n\n\n           Honble Shri Satish K Agnihotri\n\n\n      Dated:01\/09\/2008\n\n:    Judgement\n\n\n\n   (Writ petition under Article 226 of the Constitution of\n                           India)\n\n\n\n                         ORAL ORDER\n         (Passed on this 1st day of September, 2008)\n     With the consent of learned counsel appearing  for\nthe parties, the petition is heard finally.\n\n2)    This matter pertains to grant of retrial benefits\nand  family  pension  between  the  two  wives  of  the\ndeceased employee and their children.\n\n3)    By order dated 8-7-2008, with the consent of  the\nparties, the matter was referred to the mediation under\nthe  provisions  of  the Chhattisgarh  Civil  Procedure\nAlternative  Dispute  Resolution and  Mediation  Rules,\n2006.\n\n4)    The  dispute involved in this petition  has  been\nsettled  in  the mediation in the following manner  and\nthe same is become the part of the order :\n         \"That,  the  party No. I, heirs of  deceased\n         Premraj Rajeshwar Dubey, who was Peon in the\n         office  of  Chhattisgarh  State  Electricity\n         Board,  Korba  and has died in harness,  are\n         seeking payment of family pension and  other\n         post  retrial benefits in their  favour  and\n         are    also    seeking    appointment     on\n         compassionate ground in accordance with law.\n         That, the party No. II have been ordered  by\n         the  learned Civil Judge, Class-I, Katghora,\n         the  issuance of succession certificate  for\n         receiving  the amount of Rs.2,10,023\/-  from\n         the  Chhattisgarh  State Electricity  Board,\n         Korba in Succession Case No.16\/04 vide order\n         dated  28.2.2006, which has been  maintained\n         by   the   District   Judge,   Korba   while\n         dismissing  the Misc. Civil Appeal  No.2\/04,\n         preferred  by  the Party No. I  against  the\n         order dated 28.2.2006, vide order dated  7th\n         July, 2006.\n         That, the party No. II are claiming for  the\n         post   retiral  benefits  and  compassionate\n         appointment  on  the  basis  of   succession\n         certificate  granted to them  in  Succession\n         Case No.16\/04 vide order dated 28.2.2006.\n         That,  the  party No. I have  also  filed  a\n         civil  suit  for declaration and  injunction\n         before   the   Additional  District   Judge,\n         Katghora,  Distt. Korba (CG) as  Civil  Suit\n         No.7A\/07, which is pending before  the  said\n         Court.\n         That,  the  parties Smt. Mithila  Dubey  and\n         Smt.   Shanti  Bai  heirs  of  the  deceased\n         Premraj   Rajeshwar  Dubey,   appeared   and\n         participated  in the mediation  proceedings.\n         For  the  sake of convenience,  the  parties\n         were  heard jointly and separately and  also\n         in   presence  of  their  counsel   as   per\n         mediation process.  Both the parties  agreed\n         to   resolve   their  dispute   through   an\n         agreement.   The parties gave their  consent\n         without   any  pressure,  threat;   unlawful\n         promise;  and  collusion and on  the  above-\n         mentioned  basis,  the  following  agreement\n         with  respect to adjudication of the dispute\n         regarding  grant  of post retiral  benefits,\n         family     pension     and     compassionate\n         appointment, has been arrived at between the\n         parties to the proceedings.\n                    AGREEMENT\/COMPROMISE   \n         The    terms    &    conditions    of    the\n         agreement\/compromise are as follows :\n          (i)  That,   the  party  No.  I   will   be\n               receiving the family pension from  the\n               office    of    Chhattisgarh     State\n               Electricity Board, Korba, Distt. Korba\n               (CG)   as   per   Rule   47   of   the\n               Chhattisgarh  Civil Service  (Pension)\n               Rules, 1976.\n          (ii) That,  the family pension of  deceased\n               Premraj   Rajeshwar  Dubey   will   be\n               received  by the party No. I and  from\n               the arrears of the said family pension\n               pertaining to the year 2004 i.e.  from\n               the  date of death of deceased Premraj\n               Rajeshwar Dubey, till date, the  party\n               No. I will pay an amount of Rs.30,000\/-\n               to the party No. II.\n          (iii)      That,  the party No. II will  be\n               receiving  the amount of  death  claim\n               (gratuity    etc.)    amounting     to\n               Rs.2,10,023\/-.\n          (iv) That,  the  party No. I will  withdraw\n               the   Civil  Suit  No.  7A\/07  pending\n               before   the   Court   of   Additional\n               District Judge, Katghora, Distt. Korba\n               (CG).\n          (v) That,  the  party No. I will be  having\n              the  right  and  liberty  to  make   an\n              application   before  the   office   of\n              Chhattisgarh  State Electricity  Board,\n              Korba  for grant of appointment on  the\n              compassionate  basis  on   account   of\n              death  of Shri Premraj Rajeshwar Dubey,\n              who  died  in harness while working  as\n              Peon  in  the  office  of  Chhattisgarh\n              State Electricity Board, Korba and  the\n              party No. II will have no objection  to\n              the application, so preferred.\n          (vi)That,  both the parties will  not  make\n              any  claim with respect to any  of  the\n              amount,  which has been settled between\n              them by way of this agreement from  the\n              office     of    Chhattisgarh     State\n              Electricity Board, Korba.\n         That,  both  the parties to the  proceedings\n         have  agreed to the terms and conditions  of\n         the above agreement on the basis of benefits\n         sought  by  them.   The  contents  of   this\n         agreement has been read over to the  parties\n         and explained to them in Hindi and they have\n         understood the same fully.  The parties have\n         no   objection  to  any  of  the  terms  and\n         conditions of the agreement.\n         That,  the  mediation proceeding  is  hereby\n         complete.
