SINGH, THE DIRECTOR CHIEF HEALTH DEPARTMENT,\n          GOVERNMENT OF BIHAR, PATNA\n                               -----------\n<\/pre>\n<p>02.   19.01.2011             Heard learned counsel for the petitioner and<\/p>\n<p>                   for the opposite parties.\n<\/p>\n<p>                             Learned counsel for the petitioner fairly<\/p>\n<p>                   concedes that the departmental proceedings have been<\/p>\n<p>                   concluded and final orders have been passed. He<\/p>\n<p>                   however submits that the period in between 5.7.1995<\/p>\n<p>                   and 25.9.1995, as also 1.11.1995 to 31.1.1996 all<\/p>\n<p>                   related to claim for regularization of leave and which<\/p>\n<p>                   was not the subject matter in either of the two<\/p>\n<p>                   departmental proceedings and still in the garb of the<\/p>\n<p>                   order of the Writ Court, the respondents have refused<\/p>\n<p>                   to deal with that period and take any final decision.<\/p>\n<p>                             The petitioner is due for superannuation on<\/p>\n<p>                   31.1.2011.\n<\/p>\n<p>                             If what the petitioner contends is correct, in<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       all fairness the respondents were themselves required<\/p>\n<p>       to deal with this aspect of the matter, if the question<\/p>\n<p>       had been raised by the petitioner before them earlier.<\/p>\n<p>                 The petitioner is stated to have represented<\/p>\n<p>       to this effect on 7.9.2010.\n<\/p>\n<p>                 Let   the   opposite   parties   consider   the<\/p>\n<p>       representation of the petitioner dated 7.9.2010 and<\/p>\n<p>       pay the legitimate dues, if any, for the aforesaid period<\/p>\n<p>       within a maximum period of four weeks from the date<\/p>\n<p>       of receipt\/production of a copy of this order.<\/p>\n<p>                 The application stands disposed.\n<\/p>\n<\/p>\n<pre>P.K.
