\nExecut’iv.ep4’O1h’ce.rVend.uA1:erender respectively of Deepak Co-<\/p>\n
operatiye .f3an};\u00a7”V”sit1jate at Rajajinagar, Bangalore. On<\/p>\n
. .  ”    PW2 8: PW4 with a bearer’s cheque for<\/p>\n
  — drawn on Apex Bank at Chamarajpet<\/p>\n
td..44\u00a2nc;a.s~h_ :1f.\u00a31Ae same and bring cash to Deepak Cooperative<\/p>\n
 I3a11k.\u00bb.(\u00a7n that day at about 11 a.m., PW2 <3: PW4 encashed<\/p>\n
 _ ehceque, kept. cash. in a suit ease and they were returr1ing to<\/p>\n
  Deepak Co–operaIIive Bank in an autorickshaw driven by<\/p>\n
accused No.6 to Rajajai.r1agar via Magadi Road. When the<\/p>\n

\nLepro’sy”Iiotspitalliifiiisituate” onlltlflagadi Main Road. PW2, PW4
\nand lddother  chasing accused No.1.\n<\/p>\n
PWlmSathy_anarayana and PW5–Mahendz’a Babu, who were<\/p>\n
p_r6cee_d1ng in”an …. autorickshaw from opposite direction<\/p>\n
‘;caught”~holldvof accused No.1 along with a suit case<\/p>\n
  of Rs.6,00.000\/–. Thereafter, PWI, PW2,<\/p>\n
PW-13 and other public brought accused No.1 to Magadi<\/p>\n
 on “Road Police Station along with a suit case containing cash of<\/p>\n
l”–VRs.’A\u20acAi,OO.O0O\/m and handed over accused no.1 along with<\/p>\n
“lsuitcase containing cash of Rs.6.00.000\/m to PW10mShivappa.<\/p>\n
Hadimalli (jtnvestigatillg Officer). PW2 &
\nsuffered injuries at the hands of accused    .

\nhospital and thereafter was lodged by PW2

\narrested   cash of Rs.6,00,000\/~

  a sum of Rs.6,00,000\/– to encash from<\/p>\n

Ap–e__x  at Charnarajpet. The defence has sought to<\/p>\n

   an autorickshaw driven by accused No.6: the<\/p>\n
 V a_iutoi?.ic1{.shawV’proceeded towards Deepak Cosoperative Bank<\/p>\n
si1,;}1’c1t’_\u20ac~  Rajajinagar via Magadi Road has not been<\/p>\n
 controtre1’ted. The eviclence of PW2 8: PW-4; that accused No.6,<\/p>\n
 _ ‘who was driving autoriokshaw while proceeding on Binny<\/p>\n
5IVIilI Road. took a deviation towards Binniston Garden Road,<\/p>\n
PW4 caught hold accused No.6 and made him to stop\n<\/p>\n

  _26.{_i2.l998 in Tejas Nursing Home at Rajajinagar,<\/p>\n

  ' .Lacerat.ed injury measuring 3" X 1\/2" over left side
\na  1' back of scalp<\/p>\n
PW6 has opinion above said injury was simple in<\/p>\n
_;%naiu1'e and it could be Caused by i\\\/1.0.3. \/

11. PW7~Dr.T.Seenappa had examined PW2–<\/p>\n
V.Venkatapathy Rao at about 1 p.m., on 26.12..j’l’9\u00bb98 in<\/p>\n
Thejas Nursing Home situate at Magadi Road, <\/p>\n
found following injuries:–  ll  <\/p>\n
I. Swelling present over :’u”ln’ar.\n<\/p>\n
forearm over lower’
\ntenderness presenttbrepitus .__ felt,
\nmobility present. l h’ V<\/p>\n
11. Left leg swelling  _left lateral<\/p>\n
__ of leg, defusing nature,

  opined injury No.1. which had resulted in
\nl’r”a.c:tt1_re’  ulnar was grievous in nature and injury No.2<\/p>\n
 _ was llsirrlple in nature. PW?’ has opined injuries 1 :31 2 Could<\/p>\n

\nSoon after taking treatment, PW2 & PW4 reached
\nMagadi Road Police Station, by which time, PW3arid\u00bb_io.ther<\/p>\n
bank officials had arrived there. At this <\/p>\n
necessary to state that accused No.1, who”na\u00a7:i~ ,snat”c.he:i a’ . 1 <\/p>\n
suitcase containing cash of   “*I1the
\npossession of PW2 was caught rediihanded.
\nand other members of  when  no.1 was
\nrunning towards   hosnitai. PW2 <3:\n<\/p>\n
PW4 cried for he1p  accused No.1<\/p>\n

13. 8; PW4 regarding apprehension of
\naccused 2 No.1 Vaiong,_:witi’1 a suit case containing cash of<\/p>\n

‘ from   that accused No.1 was produced before PW10<\/p>\n

14. It is seen from the eyiderice of l Ir'”‘\\’lf:I”Vt.:half\u00a7l’1\u20ac has not
\ncompletely supportedtlae ease.l.ol’:pi’os’ecntion: ‘l”he evidence
\nof PW1 at the relevantV:’tirnelV__lat1ld & PW5 were<\/p>\n
travelling in an .a_utor’ick”shaw.’and they saw a person running
\nwith asuilt case. toWard”s._then1 from opposite direction and he<\/p>\n
wagubeingl chased lbyv 25 to 30 persons; PW} St PW5<\/p>\n
  thavtllllplerson and found a suitcase held by him<\/p>\n
     Therefore, PW}, PW5 and other public took<\/p>\n
h.iin to Magadi Road Police Station does not suffer from any<\/p>\n
 discrepancy. PW} has not identified accused No.1 before<\/p>\n
  Therefore, evidence of PW} to the extent that a person.<\/p>\n
?was running with a suitcase and was apprehended by PW}<\/p>\n
& PW5 and other persons of public and he was taken to<\/p>\n
 ,4’  <\/p>\n

Magadi Road Police Station is consistent with the-_.._case of
\nprosecution.\n<\/p>\n

During cross–exarninatioI1, PW1 :”:ha\u00a3{_:’adniitted <\/p>\n
visited Deepak Co~operat1ve_ ‘B_ankt”to’t:rece1V\u00e9’
\nand concerned bank of\ufb01cia1s\u00a7V:’_t:o’i\u00a5fe1’ed   a security<\/p>\n
guard, PW1 not satisi”ied”wAitAh  left the job.<\/p>\n
16. v’P’W’\u00abIe:Pj:avtn;\u00a7”*ap’pre-headed’ accused No.1 aiong with a
\nsuit case :Rs.6,00,000\/ –, which admittedly
\nbelongedito vt’he-_bank’\u00ab..hVad high expectations and he was<\/p>\n
ofi’\u00a7:red”a, job to’t”‘seVc_1,i1rity guard in Deepak Cowoperative Bank.<\/p>\n
‘ 1 ..had*tI.h’ou_ght that he was the sewer of situation and he<\/p>\n
i. =  o’rei.?ented’VDeepak Co~ope1*ative Bank from losing a sum<\/p>\n
oi;44’Rs.’\u20ac,VOO;t)00\/~. PW} expected the bank to reciprocate him<\/p>\n
in.__avV”‘befitting manner. On the other hand, PW} was<\/p>\n
appjointed as a security guard in the said bank with a lower<\/p>\n
“sa1.ary. Therefore, PW}. who was not satisfied with<\/p>\n
