SHAH\n\t\t\n\t\n\n \n\nDate\n: 18\/03\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.Utkarsh Jani, learned advocate waives service of notice of Rule on<br \/>\nbehalf of the Opponents.\n<\/p>\n<p>2.\t\tHeard<br \/>\nMr.Ashish Dagli, learned advocate appearing on behalf of the<br \/>\napplicants and Mr.Utkarsh Jani, learned advocate appearing on behalf<br \/>\nof the Opponents.\n<\/p>\n<p>3.\t\tWith<br \/>\nthe consent of the learned advocates appearing on behalf of the<br \/>\nrespective parties, the present Civil Revision Application is taken<br \/>\nup for final hearing today.\n<\/p>\n<p>4.\t\tBy<br \/>\nway of this Civil Revision Application under Section 115 of the Code<br \/>\nof Civil Procedure, the applicants have challenged the impugned order<br \/>\npassed by learned Principal Civil Judge, Harij dated 17\/01\/2008 below<br \/>\napplication Exh-23 in Regular Civil Suit No.28 of 2008, by which,<br \/>\nlearned Trial Court has rejected the said application which was<br \/>\nsubmitted by the applicants to dismiss the Suit on the ground that<br \/>\nthe Suit is barred by res-judicata and it was requested to dismiss<br \/>\nthe said Suit under Section 11 of the Code of Civil Procedure.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe facts and circumstances of the case, this Court is of the opinion<br \/>\nthat even the issue as to whether the Suit is barred by res-judicata<br \/>\nor not, is required to be decided as preliminary issue and,<br \/>\ntherefore, learned advocates appearing on behalf of the respective<br \/>\nparties have aggried that let the petitioners submit a fresh<br \/>\nappropriate application before the Trial Court raising preliminary<br \/>\nissue as to whether the Suit is barred by res-judicata or not and let<br \/>\nthe same be treated as preliminary issue by the Trial Court and let<br \/>\nthe Trial Court decide the same in accordance with law and on merits<br \/>\nwithin the time which may be decided by this Court and without in any<br \/>\nway being influenced by the impugned order passed by the learned<br \/>\nPrincipal Civil Judge, Harij  dated 17\/01\/2008 below application<br \/>\nExh-23 in Regular Civil Suit No.28 of 2008.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above, the present Civil Revision Application is disposed<br \/>\nof. Let the applicants submit a fresh appropriate application before<br \/>\nthe Trial Court raising preliminary issue as to whether the suit is<br \/>\nbarred by res-judicata or not and the same be treated as preliminary<br \/>\nissue by the Trial Court. Such an application shall be submitted by<br \/>\nthe applicants within a period of three weeks from today and the<br \/>\nrespondents to file reply to the same within a period of three weeks<br \/>\nthereafter and the leaned Trial Court to decide the preliminary issue<br \/>\nin accordance with law and on merits within a period of three months<br \/>\nthereafter, without in any way being influenced by the impugned order<br \/>\ndated 17\/01\/2008 passed below application Exh-23 in Regular Civil<br \/>\nSuit No.28 of 2008.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present Civil Revision Application is disposed of.
