He was sentenced to simple<br \/>\n\timprisonment for ten days and six months respectively for the said<br \/>\n\toffence. He also ordered to pay fine.\n<\/p>\n<p>Broadly<br \/>\n\tstated prosecution case was that on 21.10.1991 at about 5:30 in the<br \/>\n\tevening the complainant Nathabhai had gone to the grocery shop of<br \/>\n\tthe appellant. At that time, the appellant abused the complainant<br \/>\n\tsaying that he belongs to a Schedule Caste and why did he enter the<br \/>\n\tshop. So saying he gave fist and kick blows. Wife of the complainant<br \/>\n\twas also present. The appellant picked up an iron rod lying nearby<br \/>\n\tand gave a blow to the complainant on his head.\n<\/p>\n<p>The<br \/>\n\tcomplainant Nathabhai Lakhabhai-PW4 was examined at exh.12. He<br \/>\n\tstated that one of his daughters is married in village Suliyat. He<br \/>\n\ttherefore, frequently goes to the said village. On  21.10.1991, in<br \/>\n\tthe evening, he wanted to go to his daughter&#8217;s house. He had<br \/>\n\ttherefore, started of with his wife from his village. To reach<br \/>\n\tSuliyat, he had to cross Mettal village. He reached Mettal village<br \/>\n\tat 5:30 in the evening. At Mettal village he entered a shop for<br \/>\n\tbuying the bidies. Many people were in the shop at that time. The<br \/>\n\tappellant was inside the shop and was doing his business. When the<br \/>\n\tcomplainant asked for bidies, the appellant abused him in the name<br \/>\n\tof his community and asked him why  did he enter the shop. He<br \/>\n\tslapped the complainant. His wife also reached there. The accused<br \/>\n\tpicked up an iron rod and hit him on the head. At that time cousin<br \/>\n\tbrother of the appellant came there and admonished the appellant  He<br \/>\n\tand his wife thereafter, came to Suliyat village by bus. They went<br \/>\n\tto the police station to lodge the complaint, but the police officer<br \/>\n\twas not present there. He identified the rod shown to him in the<br \/>\n\tCourt as one used in the offence.\n<\/p>\n<p>4.1\t\tIn<br \/>\n\tthe cross examination, he denied the suggestion that while trying to<br \/>\n\tboard on tempo, he was prevented by the cleaner to do so and in the<br \/>\n\tprocess he had received injury.\n<\/p>\n<p>Wife<br \/>\n\tof the complainant Dhaniben Kanabhai-PW5 was examined at exh.15. She<br \/>\n\tstated that she and her husband had started of to reach Suliyat<br \/>\n\tvillage. At 5:30 they reached Mettal village. Her husband had<br \/>\n\tentered the shop. She stood outside. Her husband asked for bidies<br \/>\n\tfrom the appellant. The appellant ordered the complainant to leave<br \/>\n\tthe shop using derogatory language about his Caste. He slapped the<br \/>\n\tcomplainant and also hit him with an iron rod. They thereafter, took<br \/>\n\ta bus and reached Suliyat village and went to the police station to<br \/>\n\tlodge the complaint. The police officer was not present. They<br \/>\n\tthereafter, lodged the complaint on the next date.\n<\/p>\n<p>Raising<br \/>\n\tJokhnabhai-PW6 was examined at exh.16. He was supposedly the<br \/>\n\teyewitness to the incident. He however, turned hostile and did not<br \/>\n\tsupport prosecution.\n<\/p>\n<p>Dr.\n<\/p>\n<p>\tGirishkumar Damordas-PW1 was examined at exh.6. He was the medical<br \/>\n\tofficer, Primary Health Centre when the complainant was brought to<br \/>\n\thim for treatment by the police. He had found that the complainant<br \/>\n\thad one lacerated wound on the right side of his head. He opined<br \/>\n\tthat such injury could be caused by hard blunt substance such as<br \/>\n\tMuddamal article no.1 iron rod.\n<\/p>\n<p>7.1\t\tIn<br \/>\n\tthe cross examination, he agreed that such injuries can also be<br \/>\n\tcaused  if a person accidentally fell down.\n<\/p>\n<p>It<br \/>\n\twas on the basis of above evidence that prosecution sought to<br \/>\n\testablish the charge against the appellant.\n<\/p>\n<p>At<br \/>\n\tthe outset, it may be noted that in the cross examination of the<br \/>\n\tcomplainant-PW4 and his wife PW5, no suggestion is put by defence<br \/>\n\tthat there was any enmity between the complainant and accused prior<br \/>\n\tto the incident. The evidence of the said two witnesses need to be<br \/>\n\tassessed in light of the above circumstances.\n<\/p>\n<p>As<br \/>\n\talready noted, Nathabhai-PW4 clearly stated that when he entered the<br \/>\n\tshop of the accused, he was transacting business. Nathabhai-PW4<br \/>\n\tasked for bidies. The accused therefore, insulted him in the name of<br \/>\n\this caste and asked him why he even entered his shop. He thereafter,<br \/>\n\tgave him some slaps and hit him with an iron rod lying nearby. This<br \/>\n\tevidence of the complainant is fully supported by his wife<br \/>\n\tDhaniben-PW5 who is also an eyewitness. She stated that she had<br \/>\n\tstarted off with her husband to reach the village where their<br \/>\n\tdaughter was married. On the way when they were at Mettal village,<br \/>\n\ther husband had entered the shop where the accused was present. She<br \/>\n\thad stood outside.\n<\/p>\n<p>As<br \/>\n\tindicated there was no previous enmity between the complainant and<br \/>\n\tthe accused. No suggestion has been put forth by the defence in the<br \/>\n\tcross examination about the motive of the complainant to involve the<br \/>\n\taccused falsely. Though suggestion was made to the effect that the<br \/>\n\tcomplainant received injuries while trying to board the tempo upon<br \/>\n\tbeing prevented by the driver, same was denied by the complainant.\n<\/p>\n<p>I<br \/>\n\thave no reason to discard the testimony of these eyewitnesses only<br \/>\n\ton the ground that Raising Jokhnabhai-PW6 turned hostile and did not<br \/>\n\tsupport the prosecution.\n<\/p>\n<p>\tDr.\n<\/p>\n<p>\tGirishkumar Damordas-PW1 had treated the complainant and found that<br \/>\n\tthere was an injury corresponding to one described by the<br \/>\n\tcomplainant on his head. In that respect, the testimony of the<br \/>\n\tDoctor corroborates with the evidence of the complainant. I have<br \/>\n\tnoticed the language stated to have been used by the accused to<br \/>\n\tinsult and humiliate the complainant with reference to his Caste.<br \/>\n\tThere is no dispute that the applicant belongs to the Schedule<br \/>\n\tCaste. The incident took place in full public view. Learned trial<br \/>\n\tJudge therefore, rightly believed that the accused had committed<br \/>\n\toffence punishable under Section 3(1)(10) under the Atrocities Act.\n<\/p>\n<p>In<br \/>\n\tthe result, I see no infirmity in the judgement. The appeal is<br \/>\n\ttherefore, required to be and hereby dismissed.
