By  Special Leave Petition, the Petitioner\nsought to discredit the dying declarations.\n     Dismissing the Petition,\n^\n     HELD: Concurrent  findings of  fact cannot be disturbed\non enormity  of improbability.\tThe dying declarations under\nSection 32  of the Evidence Act, are the groaning utterances\nof a  dying woman in the grip of dreadful agony which cannot\nbe judged  by the standards of fullness of particulars which\nwitnesses may  give in\tother situations.  To discredit such\ndying declarations  for shortfalls here and there or even in\nmany places,  is unrealistic,  unnatural and unconscionable,\nif basically there is credibility. [280E-G]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL  APPELLATE   JURISDICTION\t :   Special   Leave<br \/>\nPetition (Crl.) No. 3478 of 1979.\n<\/p>\n<p>     From the  Judgment and  order dated  10-8-1979  of\t the<br \/>\nPunjab &amp; Haryana High Court in Criminal Appeal No. 427\/77.\n<\/p>\n<p>     N.C. Talukdar,  J.P. Malhotra  and J.D.  Jain  for\t the<br \/>\nPetitioner.\n<\/p>\n<p>     The order of the Court was delivered by<br \/>\n     KRISHNA IYER,  J., Wife  burning-that atrocious species<br \/>\nof murder  horrendously escalating  in some  parts  of\tthis<br \/>\ncountry-is the\tshocking  crime\t proved,  according  to\t two<br \/>\ncourts, by the prosecution in this case. Concurrent findings<br \/>\nof  fact   cannot  be\tdisturbed  save\t  on   enormity\t  of<br \/>\nimprobability which  we are  unable to\tsee in\tthe  present<br \/>\ncase. The  three dying\tdeclarations corroborated  by  other<br \/>\ncircumstances are  sufficient in  our view to bring home the<br \/>\noffence. Counsel  has sought to discredit these declarations<br \/>\nrelevant under\ts. 32  of the  Evidence Act  forgetting that<br \/>\nthey are  the groaning\tutterances of  a dying\twoman in the<br \/>\ngrip of\t dreadful  agony  which\t cannot\t be  judged  by\t the<br \/>\nstandards of  fullness of  particulars which  witnesses\t may<br \/>\ngive  in   other  situations.\tTo  discredit\tsuch   dying<br \/>\ndeclarations for  shortfalls here  or there  or even in many<br \/>\nplaces\tis  unrealistic,  unnatural  and  unconscionable  if<br \/>\nbasically there\t is credibility.  The terrible\tin this case<br \/>\nhas taken  place in  the house\tand in\tthe presence  of the<br \/>\nhusband who has been convicted. We hardly see any reason for<br \/>\ninterfering  with  this\t conviction,  and  would  have\tbeen<br \/>\nshocked ourselves  if any  other  course  had  been  adopted<br \/>\neither by  the trial  court or\tby the\tHigh  Court.
