No.1219 of 2008\n    ------------------------------------------------\n    Dated this the 16th day of September, 2009\n\n                    JUDGMENT\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>     The Government is in appeal. The acquisition was<\/p>\n<p>for the purposes of Thiruvananthapuram International<\/p>\n<p>Airport. The Land Acquisition Officer included the<\/p>\n<p>properties in category-2 and awarded land value at<\/p>\n<p>the rate of Rs.98,712\/- per Are. The Reference Court<\/p>\n<p>under the impugned judgment re-fixed the same at<\/p>\n<p>Rs.2,25,000\/- per Are.\n<\/p>\n<\/p>\n<p>     2. It is submitted by Smt.Latha T. Thankappan,<\/p>\n<p>the learned Senior Government Pleader that this Court<\/p>\n<p>considering the acquisition of properties included in<\/p>\n<p>category-1,   has   approved    the   award    of  70%<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1219 of 2008        -2-<\/span><\/p>\n<p>      enhancement for properties in that category. It is<\/p>\n<p>      submitted that for category-1, the rate approved is<\/p>\n<p>      Rs.2,25,000\/- per Are only. The learned Senior<\/p>\n<p>      Government       Pleader requested   that   the    ratio<\/p>\n<p>      maintained by the Land Acquisition Officer between<\/p>\n<p>      the value of category-1 and category-2 will be<\/p>\n<p>      maintained and a proportionate decrease be made.<\/p>\n<p>      Enhancement beyond 70% may not be granted, so<\/p>\n<p>      requested the learned Government Pleader.<\/p>\n<p>             3. Sri.Gopakumar R. Thaliyal submitted that the<\/p>\n<p>      Reference Court in L.A.R.62\/06 has enhanced the land<\/p>\n<p>      value from Rs.78,743\/- per Are to Rs.15 lakhs per Are.<\/p>\n<p>      The Government has not so far preferred any appeal<\/p>\n<p>      against that award. Therefore, there is no justification<\/p>\n<p>      at all for interfering with the present enhancement.<\/p>\n<p>      The learned counsel also referred to judgment of this<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1219 of 2008        -3-<\/span><\/p>\n<p>      Court in L.A.A.1081\/08 wherein the property involved<\/p>\n<p>      was categorised under category-6. For property in<\/p>\n<p>      category-6, this Court has re-fixed land value at<\/p>\n<p>      Rs.2,25,000\/- per Are. Category-2 is superior to<\/p>\n<p>      category-6 and therefore, there is every justification<\/p>\n<p>      for approving the present enhancement.<\/p>\n<p>             4. We have anxiously considered the rival<\/p>\n<p>      submissions. It is true that this Court become inclined<\/p>\n<p>      to approve the enhancement granted to properties in<\/p>\n<p>      category-6 in LAA.1081\/08. But, the present property<\/p>\n<p>      is in category-2 and evidently, the properties in<\/p>\n<p>      category-2 are more comparable to the properties in<\/p>\n<p>      category-1 than the properties in category-6. May be<\/p>\n<p>      on the basis of the evidence available in L.A.A.<\/p>\n<p>      No.1081\/08, this Court found that the categorisation<\/p>\n<p>      of that property in category-6 by the Reference Court<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1219 of 2008          -4-<\/span><\/p>\n<p>      was not proper. We are more inclined to follow the<\/p>\n<p>      decision taken by us in cases pertaining to category-1.<\/p>\n<p>      At the same time, we feel that there is justification in<\/p>\n<p>      this case for granting a slightly higher percentage of<\/p>\n<p>      increase than what was granted to the properties in<\/p>\n<p>      category-1. Relying on the judgment of this Court in<\/p>\n<p>      cases involving properties in category-1, we re-fix the<\/p>\n<p>      land value of the properties under acquisition at<\/p>\n<p>      Rs.1,80,000\/- per Are in modification of the rates fixed<\/p>\n<p>      by the Reference Court under the impugned judgment.<\/p>\n<p>      The appeal will stand allowed to the above extent.<\/p>\n<p>      Parties are directed to suffer their costs.<\/p>\n<p>             5. Smt.Latha T. Thankappan would argue that<\/p>\n<p>      the Reference Court was not justified in awarding<\/p>\n<p>      additional amounts under Section 23(1A) even during<\/p>\n<p>      periods when the land acquisition proceedings were<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1219 of 2008         -5-<\/span><\/p>\n<p>      under stay. Sri.Gopakumar would submit that the<\/p>\n<p>      claimants\/respondents were not parties to the case in<\/p>\n<p>      which     this  Court  stayed   the    land  acquisition<\/p>\n<p>      proceedings. We are not inclined to accept the<\/p>\n<p>      submissions of Smt.Latha T. Thankappan, the learned<\/p>\n<p>      Senior Government Pleader in the above regard, as<\/p>\n<p>      there is no specific ground in that respect raised in the<\/p>\n<p>      memorandum of appeal.\n<\/p>\n<\/p>\n<p>                                        PIUS C.
