Justice ANTONY DOMINIC\n\n Dated :04\/11\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                  W.P.(C) NO. 28753 OF 2005 (W)\n                  =====================\n\n          Dated this the 4th day of November, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioner is an Assistant Engineer under the Kerala State<\/p>\n<p>Electricity Board.\n<\/p>\n<p>      2.    In this writ petition, he is challenging Ext.P7, an order<\/p>\n<p>imposing a punishment of barring one annual increment without<\/p>\n<p>cumulative effect and ordering recovery of Rs.11,137\/- from the<\/p>\n<p>petitioner. This order was passed pursuant to the disciplinary<\/p>\n<p>proceedings initiated following Ext.P1 memo of charges.<\/p>\n<p>      3.    It is now submitted by both sides that the Full Board of<\/p>\n<p>the KSEB considered the case of another person who was<\/p>\n<p>proceeded against along with the the petitioner on 9\/3\/2009 and<\/p>\n<p>by Ext.P8 order, that person has been exonerated of the charges.<\/p>\n<p>It is stated that subsequently on 24\/10\/2009, yet another order<\/p>\n<p>has been issued by the Board exonerating the petitioner also. A<\/p>\n<p>copy of the said order has been made available by the standing<\/p>\n<p>counsel for the respondents.\n<\/p>\n<p>      4.
