            Petitioner      is     a    Self      Financing         Educational<\/p>\n
Institution, which has applied for starting an Industrial Training<\/p>\n
College.    Affiliation of the course is to be granted by the<\/p>\n
second respondent. Such affiliation is granted based on an<\/p>\n
inspection by an expert committee constituted by the first<\/p>\n
respondent and its recommendation.\n<\/p>\n
       2.   According to the petitioner, they applied for<\/p>\n
affiliation for three course, viz., Physiotherapy Technician,<\/p>\n
Health Sanitary Inspector and Medical Transcription. After<\/p>\n
inspection, petitioner’s Institution was recommended for<\/p>\n
affiliation only for Health Sanitary Inspector course. In so far<\/p>\n
as the other two courses are concerned, reason for not<\/p>\n
recommending the Institution, according to the petitioner, is<\/p>\n
that the petitioner did not have three phase power connection.<\/p>\n
       3.   Relying      on     Ext.P17,        petitioner      submits    that<\/p>\n

although three phase power connection is ordinarily required,<\/p>\n
the respondents are authorised to recommend the institutions<\/p>\n
having single phase connection also in non technical areas.<\/p>\n
Therefore, according to the petitioner, the view taken that the<\/p>\n
petitioner    should   have   three  phase     connection   for<\/p>\n
recommendation, in so far as the aforesaid two courses are<\/p>\n
concerned, is incorrect.\n<\/p>\n
      4.    Learned Government Pleader submits that the<\/p>\n
inspection and recommendation is based on the guidelines<\/p>\n
issued by the second respondent. It is stated that at any rate,<\/p>\n
even going by Ext.P17, the course of Physiotherapy<\/p>\n
Technician is a technical one and, therefore, in the absence<\/p>\n
of three phase connection, the respondents cannot be faulted<\/p>\n
for insisting on three phase connection.<\/p>\n
      5.    I have considered the submissions made. It is true<\/p>\n
that as contended by the        learned Government Pleader,<\/p>\n
Physiotherapy      Technician   is  categorised    under    the<\/p>\n
engineering trades and, therefore, the exemption provided in<\/p>\n
W.P.(C) No.36187\/10
\n                               : 3 :<\/span><\/p>\n
the foot note contained in Ext.P17 cannot apply in so far as<\/p>\n
Physiotherapy Technician course is concerned. However, the<\/p>\n
course of Medical Transcription is categorised under the non<\/p>\n
engineering trades and, therefore, in my view, prima facie, the<\/p>\n
petitioner should be eligible for the benefit of the exemption<\/p>\n
provided in the foot note. If that be so, at least the petitioner’s<\/p>\n
request for reconsideration in so far as their request for<\/p>\n
Medical Transcription is concerned is a matter for the first<\/p>\n
respondent to consider. It is seen that complaining of the<\/p>\n
refusal of the first respondent in recommending the courses<\/p>\n
the petitioner has already filed Ext.P18 before the first<\/p>\n
respondent.\n<\/p>\n
      6.    Taking note of the pendency of the representation<\/p>\n
and as prima facie Medical Transcription is a non engineering<\/p>\n
course, I direct the first respondent to consider Ext.P18 in so<\/p>\n
far as the course in Medical Transcription is concerned and<\/p>\n
pass appropriate orders in the matter. This shall be done by<\/p>\n
the first respondent as expeditiously as possible and at any<\/p>\n

rate, within four weeks from the date of production of a copy<\/p>\n
of this judgment.\n<\/p>\n
      Writ petition is disposed of as above.\n<\/p>\n
