Justice K.T.SANKARAN\n\n Dated :13\/01\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n                   ---------------------------------------------\n                          B.A.No.51 of 2010\n                   ---------------------------------------------\n              Dated this the 13th day of January, 2010\n\n\n\n                                ORDER\n<\/pre>\n<p>      Apprehending arrest on an accusation of having committed<\/p>\n<p>offence under Section 498A in Crime No.991 of 2009 of Kadackal<\/p>\n<p>Police Station, Kollam, the petitioners have filed this application<\/p>\n<p>for anticipatory bail under Section 438 of the Code of Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p>      2.   The    learned       Public       Prosecutor         submitted that<\/p>\n<p>petitioners 2 and 3 were deleted from the array of accused and<\/p>\n<p>the first petitioner is the sole accused in the case at present.<\/p>\n<p>      3.   Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>      4.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the first<\/p>\n<p>petitioner.\n<\/p>\n<p>      There will be a direction that in the event of the arrest of<\/p>\n<p>the first petitioner, the officer in charge of the police station<\/p>\n<p><span class=\"hidden_text\">BA No.51\/2010                       2<\/span><\/p>\n<p>shall release him on bail on his executing bond for Rs.15,000\/-<\/p>\n<p>with two solvent sureties for the like amount to the satisfaction<\/p>\n<p>of the officer concerned, subject to the following conditions:<\/p>\n<p>a)   The first petitioner shall report before the investigating<br \/>\n     officer between 9 A.M. and 11 A.M. on alternate Mondays,<br \/>\n     till the final report is filed or until further orders;<\/p>\n<p>b)   The first petitioner shall appear before the investigating<br \/>\n     officer for interrogation as and when required;<\/p>\n<p>c)   The first petitioner shall not try to influence the<br \/>\n     prosecution witnesses or tamper with the evidence;<\/p>\n<p>d)   The first petitioner shall not commit any offence or indulge<br \/>\n     in any prejudicial activity while on bail;<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed to the extent indicated<\/p>\n<p>above in so far as it relates to the first petitioner.
