PUNAM DEVI, WIFE OF KUNDAN PASWAN, RESIDENT OF VILLAGE\n     SALEMPUR, POLICE STATION HANSPURA, DISTRICT AURANGABAD\n                              **********\n<\/pre>\n<p>2    01\/08\/2011               Heard Counsel for the petitioner and the<\/p>\n<p>                  A.P.P. appearing on behalf of the State.<\/p>\n<p>                              This application has been filed for quashing<\/p>\n<p>                  of the entire First Information Report of SC\/ST Gaya<\/p>\n<p>                  Police Station Case No. 11 of 2005 instituted under<\/p>\n<p>                  Sections 323, 354, 384, 341, 346, 347, 120B of the<\/p>\n<p>                  Indian Penal Code and Sections 3 (8), (9), (10), (11), (15)<\/p>\n<p>                  of the Schedule Caste and Schedule Tribes (Prevention<\/p>\n<p>                  of Atrocities) Act.\n<\/p>\n<p>                              Learned Counsel for the petitioner submits<\/p>\n<p>                  that despite the lapse of six years, the Police has not<\/p>\n<p>                  submitted final report. He further submits that this<\/p>\n<p>                  case needs to be quashed on the ground that the<\/p>\n<p>                  husband of Punam Devi, who is the informant in the<\/p>\n<p>                  present case, ran away with a sum of Rs. 8 lakhs which<\/p>\n<p>                  belongs to a particular organization. One Ajay Kumar<\/p>\n<p>                  has lodged a case being Belaganj Police Station Case<\/p>\n<p>                  No. 99 of 2005 in which the petitioner is one of the<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        witnesses. Learned Counsel further submits that the<\/p>\n<p>        present case is the counter to the case filed against the<\/p>\n<p>        Opposite Party No.     2. It is also submitted that it is<\/p>\n<p>        malicious and vexatious.\n<\/p>\n<p>                     All these aspects of the matter shall be<\/p>\n<p>        considered by the Court below at the appropriate stage<\/p>\n<p>        of the case.
