Justice K.T.SANKARAN\n\n Dated :11\/06\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n                    ----------------------------------\n                          B.A.No.3075 of 2009\n                     ---------------------------------\n                 Dated this the 11th day of June, 2009\n\n\n                                 ORDER\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioner is the sole accused in<\/p>\n<p>Crime No.108 of 2009 of Kidangoor Police Station.<\/p>\n<p>      2. The offence alleged against the petitioner is under Section<\/p>\n<p>304B of the Indian Penal Code.\n<\/p>\n<p>      3.   The prosecution case is that the wife of the petitioner<\/p>\n<p>committed suicide on account of the cruelty and harassment meted<\/p>\n<p>against her by the petitioner. The learned Magistrate had recorded the<\/p>\n<p>dying declaration of the victim. A copy of the declaration was made<\/p>\n<p>available by the learned public prosecutor.<\/p>\n<p>      4.    I have carefully gone through the case diary and the<\/p>\n<p>dying declaration. Taking into account the facts and circumstances of<\/p>\n<p>the case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner. There<\/p>\n<p>will be a direction that in the event of the arrest of the petitioner, the<\/p>\n<p>officer in charge of the police station shall release him on bail on his<\/p>\n<p>executing bond for Rs.50,000\/- with two solvent sureties for the like<\/p>\n<p><span class=\"hidden_text\">BA No. 3075 \/2009                     2<\/span><\/p>\n<p>amount to the satisfaction of the officer concerned, subject to the<\/p>\n<p>following conditions:\n<\/p>\n<p>a)    The petitioner shall report before the investigating officer<br \/>\n      between 9 A.M. and 1 P.M. on all Sundays, till the final report<br \/>\n      is filed or until further orders;\n<\/p>\n<p>b)    The petitioner shall appear before the investigating officer for<br \/>\n      interrogation as and when required;\n<\/p>\n<p>c)    The petitioner shall not try to influence the prosecution witnesses<br \/>\n      or tamper with the evidence;\n<\/p>\n<p>d)    The petitioner shall not commit any offence or indulge in any<br \/>\n      prejudicial activity while on bail;\n<\/p>\n<p>e)    In case of breach of any of the conditions mentioned above, the<br \/>\n      bail shall be liable to be cancelled.\n<\/p>\n<p>\n      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                   K.T.SANKARAN,<br \/>\n                                                      JUDGE<br \/>\ncsl<\/p>\n<p><span class=\"hidden_text\">BA No. 3075 \/2009    3<\/span><\/p>\n<p><span class=\"hidden_text\">BA No. 3075 \/2009    4<\/span><\/p>\n<p>                          K.T.SANKARAN,<br \/>\n                            JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Tomy Joseph vs Deputy Superintendent Of Police on 11 June, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3075 of 2009() 1.
