Justice ANTONY DOMINIC\n\n Dated :01\/02\/2011\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                   W.P.(C) NO. 3260 OF 2011\n                  =====================\n\n           Dated this the 1st day of February, 2011\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner claims to be a PWD Contractor. Initially, Ext.P3<\/p>\n<p>order was passed blacklisting the petitioner. That was challenged<\/p>\n<p>before this Court, which resulted in Ext.P4 judgment. Ext.P3 order<\/p>\n<p>was set aside on the ground that the order was passed without<\/p>\n<p>issuing notice to the petitioner and the respondents were directed<\/p>\n<p>to pass fresh orders in the matter with notice to the petitioner.<\/p>\n<p>Petitioner submits that, so far fresh proceedings have not been<\/p>\n<p>initiated and that his registration as a contractor remains valid. It<\/p>\n<p>is stated that, meanwhile tenders were invited by the 4th<\/p>\n<p>respondent and when the petitioner attempted to submit his<\/p>\n<p>tender, that is refused to be accepted on the ground that proposal<\/p>\n<p>for blacklisting is pending. It is aggrieved by the above, the writ<\/p>\n<p>petition is filed.\n<\/p>\n<p>      2.    If as stated by the petitioner, no order of blacklisting<\/p>\n<p>has been issued, petitioner&#8217;s registration as contractor remains<\/p>\n<p>valid and he is entitled to participate in the tender. Therefore, I<\/p>\n<p>direct that, if order of blacklisting pursuant to the judgment<\/p>\n<p>WPC No. 3260\/11<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>referred to above has not been passed and if the petitioner is<\/p>\n<p>otherwise qualified, it will be open to the petitioner to submit his<\/p>\n<p>tender to the 4th respondent, in which event, such tender will also<\/p>\n<p>be considered in accordance with law.\n<\/p>\n<p>     3.
