it xothuers’ was traveliing in Tempo bearing registration<\/p>\n
‘AA”i\\To’rI{A–16–9962 as paid passenger, near Kari Meddi<\/p>\n
gate, Chithariahatti village, Hosadurga taluk, driver of
\nMini lorry bearing registration No. KA–l6–“\/986 cam_e in
\na rash and negligent manner and dashed against the<\/p>\n
Tempo. As a result, the claimant sustained inju.ries.<\/p>\n
Hence, he filed a claim petition before<\/p>\n
Holalkere, seeking compensation of   <\/p>\n
Tribunal by impugned judigmentf  <\/p>\n
awarded compensation of Rs.69l9_5C,\/V\u00bb  interest <\/p>\n

‘  ‘consi.d’er_ation in the appeal is:<\/p>\n
 ‘[Whether the quantum. of<\/p>\n
c~o_r’rj1-pensation awarded by the Tribunal is<\/p>\n
u just and proper or does it call for
\n‘v.i.enhancem_ent?\n<\/p>\n
   After hearing the learned Counsel for the parties<\/p>\n
 and perusing the award of the Tribunal. I am of the<\/p>\n

View that the compensation awarded by the Tribunal is
\nnot just and proper, it is on the lower side and therefore<\/p>\n
it is deserved to be enhanced.\n<\/p>\n
7. As per wound certificate -~ Ex.P.48, the claimant<\/p>\n
has sustained the following injuries:<\/p>\n
Fracture of hip\/fracture of <\/p>\n
right femur and other inj;uries;\u00ab ” <\/p>\n
Injuries sustained by4_himV”.a1″\u20ac a1so”3cf.ri:dent’; <\/p>\n
discharge cards — Ex.P.49  Vdisability\ufb02gcerti\ufb01cate\n<\/p>\n
– EX. R80, x–ray  to and supported by<\/p>\n
oral evidenceof the-c1.aimantVV,pan’d vdopctor examined as<\/p>\n
P.Ws.,_5 and V6’r\u00a2spe\u00a2ti1–s&_e:y.’ ‘
\nP.VI.[A,.6 ,–x’  in his evidence has stated,<\/p>\n
clairiiaiitv ha’s”‘st1ffered disability of 55.64% to limb and<\/p>\n
‘  toyvhole body and issued disability certi\ufb01cate —<\/p>\n
 .. ‘Cponlsidering the nature of injuries, Rs.43,000\/–<\/p>\n
  it awarded by the Tribunal towards pain and suffering is<\/p>\n

just and proper and there is no scope for enhancement<\/p>\n

9. As Rs.1 1,550\/– awarded by the Tribunal towards<\/p>\n
medical expenses is as per medical bills <\/p>\n
the claimant, the same is just and proper   p<\/p>\n

10. Claimant was treated  <\/p>\n

\nside and ypitis’ dese’mfed”” to be enhanced by another<\/p>\n
Rs.’.’3,0.00u\/d?\u00bb  award Rs.10,000\/– under this head.<\/p>\n
 _1″1. ;7C_1airnant is an agriculturist. His income is<\/p>\n
it  at.~.Rs.3,000\/– per month. Nature of injuries<\/p>\n
suggest-.A\u00ab:that he must have been under rest and<\/p>\n
 A. treatment for a period of three months. Therefore, a<\/p>\n
  of Rs.9,000\/– is awarded towards loss of income<\/p>\n
 during laid up period.\n<\/p>\n<\/p>\n
12. Considering the disability stated by the doctor, in
\naddition to certain amount of discomfort _ and<\/p>\n
unhappiness which he has to undergo for the his<\/p>\n
life, it is just and proper to award a sum   pg<\/p>\n
