No.23303 of 2011\n                          Geeta Devi wife of Ram Bilash Sadai\n                                        Versus\n                                  The State Of Bihar\n                                      -----------\n<\/pre>\n<p>4\/   18.10.2011                    Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                   The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 366, 366-A, 368, 372, 373 of the Indian<\/p>\n<p>                      Penal Code and section 3(i) (x) of Scheduled Castes and Scheduled<\/p>\n<p>                      Tribes (Prevention of Atrocities) Act.\n<\/p>\n<p>                                   Considering that the girl has been recovered and she<\/p>\n<p>                      stated that she had been sold for the purpose of marriage and not for<\/p>\n<p>                      prostitution, let the petitioner, above named, be released on bail<\/p>\n<p>                      after framing of charge in the case against her on furnishing bail<\/p>\n<p>                      bond of Rs.5,000\/- (five thousand) with two sureties of the like<\/p>\n<p>                      amount each or any other surety to be fixed by the court below to<\/p>\n<p>                      the satisfaction of the Chief Judicial Magistrate, Madhubani, in<\/p>\n<p>                      connection with Deodha P.S. Case No.15 of 2010, subject to the<\/p>\n<p>                      conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                      petitioner, who will give an affidavit giving genealogy as to how he<\/p>\n<p>                      is related with the petitioner and another bailor shall be Ram Prasad<\/p>\n<p>                      Sadai, cousin brother-in-law of the petitioner. The bailor will<\/p>\n<p>                      undertake to furnish information to the court about any change in the<\/p>\n<p>                      address of the petitioner, (ii) That the affidavit shall clearly state that<\/p>\n<p>                      the petitioner is not an accused in any other case and, if she is, she<\/p>\n<p>                      shall not be released on bail, (iii) That the bailor shall also state on<\/p>\n<p>                      affidavit that he will inform the court concerned if the petitioner is<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       implicated in any other case of similar nature after her release in the<\/p>\n<p>       present case and thereafter the court below will be at liberty to<\/p>\n<p>       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>       misuse, (iv) That the petitioner will be well represented on each date<\/p>\n<p>       and if she fails to do so on two consecutive dates, her bail will be<\/p>\n<p>       liable to be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                           (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Geeta Devi vs The State Of Bihar on 18 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
