He<br \/>\nplaced reliance on the decision of the Punjab and Haryana High Court,<br \/>\nin  Rajesh Mahajan &amp; others vs. Commissioner of Income-tax,<br \/>\n[2002] 257 ITR 577, wherein, on identical fact-situation, it is held<br \/>\nthat the reasons recorded are not relevant for transfer and the order<br \/>\nof transfer was held to be not valid. At page 589 of the aforesaid<br \/>\ndecision in  Rajesh Mahajan [supra],<br \/>\nthe cases referred are: (i) <a href=\"\/doc\/542496\/\">Vijayasanthi Investments Pvt. Ltd. v.<br \/>\nChief CIT,<\/a> [1991] 187 ITR 405 [AP]; (ii) <a href=\"\/doc\/1884719\/\">Saptagiri Enterprises v.<br \/>\nCIT,<\/a> [1991] 189 ITR 705 (AP); (iii) Y. Moideen Kunhi and Co. v. ITO,<br \/>\n[1993] 204 ITR 29 [Karn]. Shivajirao Angre vs. CIT, [1986] 158 ITR<br \/>\n162 [MP]; and (iv) Power Controls vs. CIT, [2000] 241 ITR 807<br \/>\n(Delhi).\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Soparkar, further, submits that, before transferring the case from<br \/>\none CIT to another CIT under Section 127(1) of the Income Tax Act,<br \/>\n1961, condition precedent should be that the reasons should not be<br \/>\nvague and an opportunity of being heard should be given before<br \/>\npassing final order.  In this case, though opportunity of being heard<br \/>\nhas been given, but reason for transfer is not relevant. The reason<br \/>\nhas been given that the assessee has some business connection with<br \/>\nSukhwani, who has been assessed at Pune. That group case was not<br \/>\ntransferred to Mumbai and the case of the assessee is proposed to be<br \/>\ntransferred from Vadodara to Mumbai.\n<\/p>\n<p>\tConsidering<br \/>\nthe submissions and the case-law cited at the Bar, we set aside the<br \/>\nimpugned order of transfer dated 6th October 2006 because<br \/>\nthe reason is given that, ?Sthe fact remains that assessee is<br \/>\nconnected with the Sukhwani group??. Admittedly, the assessee is<br \/>\nnot connected directly with Sukhwani group. Therefore, the reason is<br \/>\nirrelevant.\n<\/p>\n<p>\tWhen<br \/>\nthe order dated 6th October 2006 has been set aside on the<br \/>\nground that the reasons given in the notice are vague and no relevant<br \/>\nreason has been given in the final order dated 6th October<br \/>\n2006, the Officer concerned will be at liberty to issue fresh notice<br \/>\nstating therein the reasons, but that should not be vague, and, after<br \/>\ngiving opportunity of hearing to the assessee, if necessary, pass<br \/>\ntransfer order under Section 127(1) of the Income Tax Act, 1961.\n<\/p>\n<p>\tAccordingly,<br \/>\nthis petition is allowed.\n<\/p>\n<p>(Y.R.<\/p>\n<pre>\nMEENA, ACTG.C.J.)\n \n\n \n\n\n \n\n[swamy]\t\t\t\t\t\t\t\t(ANANT\nS.
