Justice ANTONY DOMINIC\n\n Dated :02\/02\/2009\n\n O R D E R\n                   ANTONY DOMINIC,J.\n           ---------------------------\n           W.P.(C).Nos.3301 &amp; 3306 OF 2009\n           ---------------------------\n          Dated this the 2nd day of February, 2009.\n\n                        JUDGMENT\n<\/pre>\n<p>     Challenge in these writ petitions is against the award<\/p>\n<p>of the Labour Court, Kollam in I.D.Nos.6\/08 and 4\/08. The<\/p>\n<p>issue referred for adjudication was regarding the validity of<\/p>\n<p>the retrenchment of the workmen concerned. The Labour<\/p>\n<p>Court found the retrenchment to be invalid and directed<\/p>\n<p>that the workmen be paid the retrenchment compensation,<\/p>\n<p>notice pay and compensation of of Rs.25,000\/- each.<\/p>\n<p>     2. The first contention raised is that 3rd respondent<\/p>\n<p>employer is the agent of the first respondent and therefore<\/p>\n<p>irrespective of whether the 3rd respondent is defunct or not,<\/p>\n<p>the Labour Court ought to have directed        reinstatement<\/p>\n<p>under the Ist respondent. The Labour Court while<\/p>\n<p>discussing the claim for reinstatement has found that the<\/p>\n<p>there is no employer-employee relationship between the<\/p>\n<p><span class=\"hidden_text\">WP(c).Nos.3301\/09&amp; anor.        2<\/span><\/p>\n<p>workmen and the first respondent. Labour court also found<\/p>\n<p>that the third respondent is defunct since 2004. It was on that<\/p>\n<p>basis that the claim for reinstatement has been rejected.<\/p>\n<p>Petitioners have not substantiated before me that there was<\/p>\n<p>any employer-employee relationship between the Khadi and<\/p>\n<p>Village Industries Board and the petitioners. If that be so, the<\/p>\n<p>conclusion of the Labour court cannot be said to be faulty.<\/p>\n<p>Further the case of the petitioners is that the third respondent<\/p>\n<p>is an agent of the Ist respondent and hence the Ist respondent<\/p>\n<p>is liable to provide employment to them. Nothing has been<\/p>\n<p>shown to me to conclude that the Ist respondent is the<\/p>\n<p>Principal employer. Even if it is so, there is no provision in the<\/p>\n<p>Industrial Disputes Act, creating liability on the principal<\/p>\n<p>employer to provide employment.\n<\/p>\n<p>      3. It was then contended that the establishment is<\/p>\n<p>functioning and therefore the compensation ought not have<\/p>\n<p>been limited to 20.7.2004, when the workmen were illegally<\/p>\n<p>retrenched. A reading of the award shows that the admitted<\/p>\n<p><span class=\"hidden_text\">WP(c).Nos.3301\/09&amp; anor.        3<\/span><\/p>\n<p>case of the parties was that the establishment was   defunct<\/p>\n<p>from July, 2004 onwards. It was therefore that the Labour<\/p>\n<p>court limited the retrenchment compensation till that date. If<\/p>\n<p>an establishment is defunct, the workmen could not have had<\/p>\n<p>employment, in which case the retrenchment compensation<\/p>\n<p>for the period after the establishment become defunct cannot<\/p>\n<p>be claimed. Therefore the second contention also does not<\/p>\n<p>deserve any consideration.\n<\/p>\n<p>      I do not find any substance in the writ petition.
