Justice KURIAN JOSEPH\n\n Dated :15\/10\/2008\n\n O R D E R\n                      KURIAN JOSEPH, J.\n\n             -----------------------------------------\n                  W.P(C) No.28377 of 2006\n             -----------------------------------------\n           Dated this the 15th day of October, 2008\n\n                             JUDGMENT\n<\/pre>\n<p>      The challenge is on Ext.P1 notice issued by the second<\/p>\n<p>respondent Forum. It is stated in the show cause notice that the<\/p>\n<p>petitioner who was appointed as Advocate Commissioner did not<\/p>\n<p>discharge her duties and that amounts to disobedience of the<\/p>\n<p>order of the Forum. I do not find any provision enabling the<\/p>\n<p>second respondent Forum to issue such an order for taking<\/p>\n<p>action. Apparently the notice is issued under Section 27 of the<\/p>\n<p>Consumer Protection Act, 1986.          I am afraid the second<\/p>\n<p>respondent has not properly understood the purpose and purport<\/p>\n<p>of Section 27. It is meant to take appropriate action against the<\/p>\n<p>person or the opposite party in a complaint or the complainant.<\/p>\n<p>That provision will not clothe with any jurisdiction on the Forum<\/p>\n<p>to proceed against an Advocate Commissioner.
