After passing the first year<br \/>\nof PTC, the petitioner got admission in the second year. The<br \/>\npetitioner was granted Socially and Economically Backward Class<br \/>\n( SEBC  for brevity) quota as he was granted Caste Status<br \/>\nCertificate by the competent authority. The respondent No. 2 summoned<br \/>\nthe petitioner for verification  of his Caste Status Certificate,<br \/>\nwhere he remained present before respondent No.2. After hearing the<br \/>\npetitioner the respondent No. 1 addressed a letter to the College<br \/>\nauthorities which the petitioner received on 21.02.2006 whereby the<br \/>\nadmission has been cancelled by respondent No.1 who has no authority<br \/>\nbecause the petitioner&#8217;s case is conducted by respondent No.2. The<br \/>\npetitioner addressed a letter to respondent No.1 dated 22.02.2006<br \/>\nrequesting him to supply a copy of order dated 26.12.2005 basing upon<br \/>\nwhich his admission has been cancelled.  The petitioner has not<br \/>\nreceived any order from respondent No.2- Director of Developing Caste<br \/>\nwho is competent authority who purported to have cancelled the<br \/>\npetitioner&#8217;s admission. The petitioner received said communication<br \/>\nthrough the school authorities intimating them to cancel the<br \/>\npetitioner&#8217;s admission. The said decision is taken behind the back of<br \/>\nthe petitioner. Not only that, but even respondent No.1 did not<br \/>\ninform the petitioner about anything but straightway issued the<br \/>\nimpugned order when the petitioner was attending the class. Hence,<br \/>\nthis petition.\n<\/p>\n<p>3.0\tHeard<br \/>\nMr. Qureshi, learned counsel appearing for the petitioner and Mr.<br \/>\nJaswant K. Shah, learned Assistant Government Pleader for the<br \/>\nrespondent State. Respondent No. 3 is served but no-one has appeared<br \/>\non behalf of the respondent No.3.\n<\/p>\n<p>4.0\tLearned<br \/>\nadvocate for the petitioner submitted that the petitioner is belonged<br \/>\nto Khatik sub-caste which is considered to be SEBC. The petitioner<br \/>\nhas brought up in Ahmedabad.\n<\/p>\n<p>5.0\tLearned<br \/>\nadvocate for the petitioner further submitted that the petitioner<br \/>\nsubmitted to the respondent No.2 various documents including his<br \/>\nCaste Status Certificate and School Leaving Certificate of his<br \/>\nuncles. The petitioner&#8217;s father has been residing since 1960.\n<\/p>\n<p>6.0\tLearned<br \/>\nAssistant Government Pleader for the respondent- State authorities<br \/>\ncontended that if the petitioner has taken any undue benefits of the<br \/>\ncertificate issued on any incorrect record, then in that<br \/>\ncase the petitioners have to face the consequence of taking undue<br \/>\nbenefit, to which they were<br \/>\nnot legally entitled.\n<\/p>\n<p>7.0\tThe<br \/>\nissue involved in the present petition is squarely covered by the<br \/>\ndecision dated 12.03.2008 of this Court rendered in Special Civil<br \/>\nApplication No. 7853 of 2005.\n<\/p>\n<p>8.0\tIn<br \/>\nview of the facts and circumstances and the reasons set out in the<br \/>\naforesaid judgment, the impugned order passed by respondent No.2 is<br \/>\nnot interfered with, but with the observations that it would be open<br \/>\nto the petitioner to file appropriate civil suit for appropriate<br \/>\ndeclaration that the petitioner belongs to SEBC category. It is<br \/>\nfurther observed that if such a declaration is given by the Civil<br \/>\nCourt, thereafter it would be open to the petitioner to move the<br \/>\nauthority for issuance of the certificates in accordance with law.\n<\/p>\n<p>9.0\tIt<br \/>\nis clarified that if the aforesaid suit is filed by the petitioner,<br \/>\nthe Civil Court shall independently examine the matter and shall not<br \/>\nbe guided by the order of this Court.\n<\/p>\n<p>10.0\tThe<br \/>\npetition is partly allowed to the aforesaid extent.
