He has<br \/>\nsubmitted that in pursuance of the said advertisement candidates who<br \/>\nwere placed in the select list were given the appointments. However,<br \/>\none of the candidate who was placed at Sr. No. 2 in the select list<br \/>\nhad not joined the duty. Therefore, in his place the petitioner<br \/>\nherein ought to have been given the appointment since one of the<br \/>\ncandidate who was placed in the select list had not joined the duty<br \/>\nand the petitioner herein was placed at Sr. No. 1 in the wait list.<br \/>\nIn support of his submission, the learned counsel for the petitioner<br \/>\nhas placed reliance on the decision of this Court in the case of<br \/>\n<a href=\"\/doc\/448593\/\">Vinodkumar Rajabhai Rathod v. State of Gujarat &amp; Ors.,<\/a><br \/>\nreported in 2005 (2) GLR 1274, wherein it has been held<br \/>\nthat the Government could not deny appointment to the candidate on<br \/>\nthe ground that the validity of select list has lapsed.\n<\/p>\n<p>\t\tOn<br \/>\nthe other hand, it has been contended by the learned counsel for<br \/>\nrespondent no. 2-GPSC that in pursuance of the advertisement dated<br \/>\n15.04.2006, the petitioner was placed at Sr. No. 1 in the wait list.<br \/>\nHowever, subsequently, respondent no. 2-GPSC had published another<br \/>\nadvertisement dated 18.07.2007 and the results in respect of the said<br \/>\nadvertisement for the same posts were declared on 16.09.2008.<br \/>\nTherefore, the wait list of the candidates prepared in pursuance of<br \/>\nthe advertisement dated 15.04.2006 cannot be operated.\n<\/p>\n<p>\t\tHeard<br \/>\nlearned counsel for the respective parties. It is true that the<br \/>\npetitioner was placed at Sr. No. 1 in the wait list of the candidates<br \/>\nprepared in pursuance of the advertisement dated 15.04.2006 for the<br \/>\npost\/s in question.  Respondent no. 2-GPSC had subsequently published<br \/>\nanother advertisement dated 18.07.2007 for recruitment of the<br \/>\ncandidates to the same posts. However, it may be noted that the<br \/>\nsubsequent advertisement dated 18.07.2007 was issued before the<br \/>\nresults of first advertisement i.e. advertisement dated 15.04.2006<br \/>\nwere declared. It is not in dispute that the candidate placed at Sr.<br \/>\nNo. 2 of the select list prepared in pursuance of the advertisement<br \/>\ndated 15.05.2006 had not joined the duty. Therefore,  evidently, one<br \/>\nseat had fallen vacant.\n<\/p>\n<p>\t\tIt<br \/>\nis well settled law that a candidate in the wait list has the right<br \/>\nto claim appointment if one or more candidate in the select list does<br \/>\njoin the duty. In the present case, since second advertisement dated<br \/>\n18.07.2007 was issued before the declaration of the results of the<br \/>\nfirst advertisement dated 15.04.2006, the petitioner has a right to<br \/>\nclaim appointment since one of the candidate\/s in the select list had<br \/>\nnot joined the duty and the petitioner was placed at Sr. No. 1 in the<br \/>\nwait list and subsequent advertisement never provides for any<br \/>\nreservation of the seats in connection with the examination conducted<br \/>\nin respect of any earlier advertisement.\n<\/p>\n<p>\t\tTherefore,<br \/>\nlooking to the aforesaid factual scenario and the principle laid down<br \/>\nin the case of Vinodkumar Rajabhai Rathod [Supra], I am of the<br \/>\nopinion that the case of the petitioner ought to have been considered<br \/>\nfor appointment to the said post.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above,  RULE,<br \/>\nreturnable in the 1st<br \/>\nweek of September, 2010.
