SHAH\n\t\t\n\t\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tIn<br \/>\nthe present petition under Article 226 of the Constitution of India,<br \/>\npetitioners have prayed for appropriate writ, order or direction<br \/>\ndirecting respondent No.2 to forthwith consider and adjudicate the<br \/>\npetitioners&#8217; application dated 29.11.2008 submitted under Section<br \/>\n70(O) of the Bombay Tenancy Act.\n<\/p>\n<p>2.\tIt<br \/>\nappears that in view of the proceedings pending before the Division<br \/>\nBench on the aspect with respect to jurisdiction of the authority to<br \/>\ndecide the application submitted under Section 70(O) of the Bombay<br \/>\nTenancy Act, the authority is not deciding the application dated<br \/>\n29.11.2008 submitted by the petitioners under Section 70(O) of the<br \/>\nBombay Tenancy Act.  When the question with respect to jurisdiction<br \/>\nof the authority to decide the application under Section 70(O) of the<br \/>\nBombay Tenancy Act is pending before the Division Bench and unless<br \/>\nand until the said dispute is resolved, when respondent No.2 has kept<br \/>\nthe application pending, it cannot be said that respondent No.2 has<br \/>\ncommitted any error and\/or illegality.  Jurisdiction to decide the<br \/>\napplication under Section 70(O) of the Bombay Tenancy Act is a<br \/>\nquestion which goes to the root of the matter and therefore, to avoid<br \/>\nany multiplicity of proceedings, when respondent No.2 has kept the<br \/>\napplication pending, according to this Court, respondent No.2 is<br \/>\njustified in keeping the application pending.  Therefore, no<br \/>\nillegality has been committed by respondent No.2 in not deciding the<br \/>\napplication under Section 70(O) of the Act.\n<\/p>\n<p>3.\tAt<br \/>\nthis stage, Shri Sanjanwala, learned advocate appearing on behalf of<br \/>\nthe petitioners has submitted that without prejudice to the rights of<br \/>\nthe petitioners to submit appropriate application afresh, petitioners<br \/>\nare ready and willing to submit appropriate application for<br \/>\ndetermination of premium payable under Section 43 of the Act and in<br \/>\nthe meantime shall withdraw the application dated 29.11.2008<br \/>\nsubmitted under Section 70(O) of the Bombay Tenancy Act and if the<br \/>\npetitioners are ready and willing to pay\/deposit premium as may be<br \/>\ndetermined by the appropriate authority, in that case, petitioners<br \/>\nshall not submit application afresh under Section 70(O) of the Act.<br \/>\nHowever, if the petitioners are not agreeable to pay\/deposit the<br \/>\npremium that may be determined by the appropriate authority, in that<br \/>\ncase, petitioners may submit appropriate application afresh under<br \/>\nSection 70(O) of the Bombay Tenancy Act, which may be considered in<br \/>\naccordance with law and on merits.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate appearing on behalf of the petitioners has submitted that<br \/>\nthe petitioners shall withdraw the application dated 29.11.2008 under<br \/>\nSection 70(O) of the Bombay Tenancy Act at this stage and request the<br \/>\nappropriate authority to pass appropriate order for determining<br \/>\npremium on the said application, which shall be submitted by the<br \/>\npetitioner under Section 43 of the Act, which may be directed to be<br \/>\ndecided in accordance with law and on merits at the earliest.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and for the reasons stated above, present petition<br \/>\nis disposed of.  Let the petitioners withdraw the application dated<br \/>\n29.11.2008 submitted under Section 70(O) of the Bombay Tenancy Act,<br \/>\nwith a liberty in favour of the petitioners to submit appropriate<br \/>\napplication afresh, in case the petitioners are not agreeable to<br \/>\npay\/deposit the premium as may be determined by the appropriate<br \/>\nauthority.  On withdrawal of the application dated 29.11.2008<br \/>\nsubmitted by the petitioners, it will be open for the petitioners to<br \/>\nsubmit appropriate application before appropriate authority to<br \/>\ndetermine the premium under Section 43 of the Bombay Tenancy Act and<br \/>\nto grant such a permission and to determine the premium for removing<br \/>\nthe restrictions to convert the same from new tenure to old tenure<br \/>\nand the same shall be considered by the concerned authority in<br \/>\naccordance with law and on merits after following due procedure and<br \/>\ncommunicate the outcome of the same to the petitioners.  If the<br \/>\npetitioners are ready and willing to pay\/deposit the premium as may<br \/>\nbe determined by the appropriate authority and actually pay the same,<br \/>\nthere is no question of further submitting application by the<br \/>\npetitioners under Section 70(O) of the Act, as the petitioners have<br \/>\naccepted the land in question as new tenure land.  In case, if not<br \/>\nagreeable to pay premium as may be determined by the appropriate<br \/>\nauthority, in that case, it will be open for the petitioners to<br \/>\nrevive the application dated 29.11.2008 by submitting fresh<br \/>\napplication under Section 70(O) of the Act and as and when such<br \/>\napplication is submitted, the same may be considered in accordance<br \/>\nwith law and on merits and the aforesaid exercise shall not come in<br \/>\nthe way of the petitioners.\n<\/p>\n<p>6.\tWith<br \/>\nthis, present Special Civil Application is disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>Shah, J.)<\/p>\n<p>*menon<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Whether vs State on 29 September, 2011 Author: M.R.
