JAIN\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M  E N T<\/p>\n<p>Dr. ARIJIT PASAYAT<\/p>\n<p>1.\tIn the present appeal, challenge is to a judgment<br \/>\nrendered by a Division Bench of the Karnataka High Court<br \/>\nholding the appellant guilty of offences punishable under<br \/>\nSection 498-A of the Indian Penal Code, 1860 (in short the<br \/>\n&#8216;IPC&#8217;). The appellant faced trial along with two others, i.e. his<br \/>\nmother and brother for offences punishable under Sections<br \/>\n302, 498-A IPC and Sections 3, 4 and 6 of the Dowry<br \/>\nProhibition Act, 1961 (in short the &#8216;D.P. Act&#8217;). The trial Court<br \/>\nhad acquitted the present appellant and his brother of the<br \/>\ncharges under Section 302 IPC. Latter is described as A-3<br \/>\nwhile former is referred to as A-2.  Mother of the accused<br \/>\n(hereinafter referred to as A-1) was separately convicted under<br \/>\nSection 302 IPC. The State had also filed an appeal<br \/>\nquestioning the acquittal, as noted above.\n<\/p>\n<p>2.\tBackground facts in a nutshell are as follows:\n<\/p>\n<p>The appellant was married to one Shobha (hereinafter<br \/>\nreferred to as the deceased). She was the daughter of PW-l, a<br \/>\nSchool Teacher. PW-2 was her mother, PW-17 her brother and<br \/>\nPW-15 her younger sister. PW-6 is the wife of PW-17.<br \/>\nAccording to the prosecution, PW-1 received information that<br \/>\nshe caught fire and was at the hospital.  On his asking as to<br \/>\nhow she received the injuries, she said that while she was<br \/>\ncooking, A-1 came behind her and lit fire to her saree. The<br \/>\nallegation was that for not fulfilling the demand of dowry, she<br \/>\nwas killed by her mother-in-law and other accused persons.<br \/>\nTo substantiate the plea of demand of dowry, three letters<br \/>\nwere exhibited, which are Ex.P-2, Ex.P-3 and Ex.P-4. The<br \/>\noccurrence took place on 25.9.1993.  As noted above, the<br \/>\nprosecution version rests primarily on the statement<br \/>\npurported to have been made by the deceased before her death<br \/>\nto her father in the presence of other relatives. The Trial Court<br \/>\nplaced reliance on the evidence of PW-l and the letters and<br \/>\naccordingly directed conviction and imposed sentence, as<br \/>\naforesaid. It, however, acquitted A-2 and A-3 of some charges.\n<\/p>\n<p>3.\tThree appeals were filed before the High Court, two by<br \/>\nthe accused persons and one by the State, as noted above.\n<\/p>\n<p>4.\tThe High Court found that the evidence was insufficient<br \/>\nto substantiate the allegations levelled against A-1. It also<br \/>\nnoted that there was no evidence to show any demand of<br \/>\ndowry. Therefore, it directed acquittal of A-1 so far as charges<br \/>\nrelating to Section 302 IPC and Sections 3, 4 and 6 of the D.P.<br \/>\nAct are concerned, but placing reliance on the letters, Ex.P2 to<br \/>\nP-4, held the appellant guilty of offences punishable under<br \/>\nSection 498-A IPC. Interestingly, the conviction of A-1 and A-2<br \/>\nunder Section 498-A was held to be not sustainable by the<br \/>\nHigh Court.\n<\/p>\n<p>5.\tIn support of the appeal, learned counsel for the<br \/>\nappellant submitted that ingredients of Section 498-A IPC are<br \/>\nnot established. In any event, after having directed acquittal<br \/>\nfrom the charges relatable to Sections 3, 4 and 6 of the D. P.<br \/>\nAct, on the self same evidence, the High Court should not have<br \/>\nheld the appellant guilty under Section 498-A IPC. The letters<br \/>\non which the Trial Court and the High Court placed reliance<br \/>\ndo not, in any event, show demand of dowry or any valuable.\n<\/p>\n<p>6.\tIn response, learned counsel for the respondent- State<br \/>\nsubmitted that in the last letter of July, 1990, Ex.P-4 there<br \/>\nwas a clear reference of the intention of appellant for<br \/>\ncontacting a second marriage because the deceased had not<br \/>\nbrought enough dowry. With reference to the evidence of PW-1<br \/>\nand other relatives, it was submitted that A-1 was making a<br \/>\ngrievance that she could have got more dowry as her son,<br \/>\nmeaning thereby, the appellant was in government service.\n<\/p>\n<p>7.\tUndisputedly, the High Court has held so far as A-1 and<br \/>\nA-2 are concerned, that the accusations relatable to Sections<br \/>\n3, 4 and 6 of the D.P Act have not been established as no<br \/>\ndemand of dowry has been proved. Section 498-A, IPC reads<br \/>\nas follows:\n<\/p>\n<p>&#8220;Husband or relative of husband of a woman<br \/>\nsubjecting her to cruelty  Whoever, being the<br \/>\nhusband or the relative of the husband of a<br \/>\nwoman, subjects such woman to cruelty shall<br \/>\nbe punished with imprisonment for a term<br \/>\nwhich may extend to three years and shall also<br \/>\nbe liable to fine.\n<\/p>\n<p>Explanation  For the purpose of this Section,<br \/>\nSection, &#8220;cruelty&#8221; means-\n<\/p>\n<p>(a) any wilful conduct which is of such a<br \/>\nnature as is likely to drive the woman to<br \/>\ncommit suicide or to cause grave injury or<br \/>\ndanger to life, limb or health (whether mental<br \/>\nor physical) of the woman; or<\/p>\n<p>(b) harassment of the woman where such<br \/>\nharassment is with a view to coercing her or<br \/>\nany person related to her to meet any unlawful<br \/>\ndemand for any property or valuable security<br \/>\nor is on account of failure by her or any person<br \/>\nrelated to her to meet such demand.&#8221;\n<\/p>\n<p>8.\tSection 498-A does not specifically speak of a dowry<br \/>\ndemand. It speaks of unlawful demand for property and<br \/>\nvaluable articles.\n<\/p>\n<p>9.\tSection 498-A IPC was enacted by the Criminal Law<br \/>\n(Second Amendment) 1983 with effect from 25.12.1983. The<br \/>\nword &#8220;cruelty&#8221; has been explained in Section 498-A; so also<br \/>\nharassment. &#8220;Cruelty&#8221; under the Explanation deals with two<br \/>\ntypes of circumstances. Clause (a) refers to wilful conduct<br \/>\nleading to suicide or grave injury or danger to life, limb or<br \/>\nhealth which can be either mental or physical of the woman.<br \/>\nClause (b) relates to harassment with a view to coerce her or<br \/>\nany person related to her to meet any unlawful demand for<br \/>\nany property or valuable or is on account of failure to meet<br \/>\nsuch demand.\n<\/p>\n<p>10.\tThere is no evidence on record on this aspect of any such<br \/>\ndemand. Even in the letters, on which prosecution placed<br \/>\nheavy reliance, there is no reference to any demand of dowry<br \/>\nor for that matter of any nature.  In fact in Ex. P-2, the<br \/>\ndeceased had written to her mother that she had promised to<br \/>\npay for some articles which the mother-in-law i.e. A-1 had<br \/>\npurchased.  She had stated that she was embarrassed that<br \/>\nher parents were not paying the money, though A-1 had never<br \/>\nasked for it.  This was not a case of any demand for property<br \/>\nor valuable security.  On the contrary, the deceased had<br \/>\nobjected to her parents not paying for something which the A-<br \/>\n1 had spent the money.  To similar effect was letter Ex.P-3. It<br \/>\nis evident from the evidence on record that half of the marriage<br \/>\nexpenses were borne by the accused-appellant and his family.<br \/>\nEven Ext. P-4 on which learned counsel for the State placed<br \/>\nstrong reliance does not speak of any demand. It only speaks<br \/>\nof a apprehension of a second marriage. Though, he submitted<br \/>\nthat the demand of dowry is in the background and has to be<br \/>\ninferred, the plea is clearly unacceptable in the absence of any<br \/>\nmaterial to substantiate that plea. This letter was also written<br \/>\nthree years prior to the occurrence.\n<\/p>\n<p>11.\tAbove being the position, the inevitable conclusion is that<br \/>\nthe prosecution has failed to establish its accusations so far as<br \/>\nSection 498-A IPC is concerned to hold the accused-appellant<br \/>\nguilty. The conviction is, accordingly, set aside. The appeal is<br \/>\nallowed.
