 Judgement and award would contend that<\/p>\n
 not justified in fastening the liability<\/p>\n
on .44the”‘V.yIn’surance Company. The contention of the<\/p>\n
 learnedlllcounsel is that there was violation of the terms<\/p>\n
–  Aandlicondition of the policy in as much as, the deceased<\/p>\n
 was an un–authorised passenger in the vehicle and in<\/p>\n
that context the Insurance Company cannot be made<\/p>\n

of the insured and if at all any liability is <\/p>\n
it can only be against the owner of the  <\/p>\n

3. Learned counsel for thei’~responvdent*ho.weVe’r.p<\/p>\n
seeks to justify the award ‘passed  the  It <\/p>\n
contended that the   noticed’ the said
\ncontention and in    by it has
\nreferred to  that the deceased
\nwas    i taken and therefore,
\nhe was   and accordingly
\nhas fastened ‘the Insurance Company.<\/p>\n
 _-4. “the  rival contention I have firstly<\/p>\n
  perused the clajmllpetitions filed by the claimants before<\/p>\n
 the’Tribunal.V:l_1’T’hough it is contended by the learned<\/p>\n
cou__r1sel- fori’.v’the appellant that there is an admission that<\/p>\n
the deceased was an un~authorised passenger, the<\/p>\n
  pleading in fact would indicate that the claimants had<\/p>\n
….contended that he was authorised passenger in the<\/p>\n
vehicle, since the deceased was travelling along with<\/p>\n

5. In this regard the tribunal has <\/p>\n
contention on behalf of the  i<\/p>\n

\nTribunai  to come to the
\n ivvas travelling along with
\nthe    be considered as un-\n<\/p>\n
authorised  having come to the said<\/p>\n
concilgsioii” was of the opinion that the<\/p>\n
 appellafxt “hereinVvc’annot claim that they are not liable<\/p>\n
for the compensation. Accordingly, the<\/p>\n
Trib__unai~ {directed the appellant herein to deposit the<\/p>\n
V ‘ compensation.\n<\/p>\n
  Therefore, in such circumstance when the<\/p>\n
 .,,Ti”ibunai has noticed the evidence on record and has<\/p>\n
it rendered \ufb01nding of fact that he was accompanying the<\/p>\n

goods in the vehicle and when there is no other contrary<\/p>\n
evidence available on record, I see no reason tovinterfere<\/p>\n
with the \ufb01nding rendered by the Tribunal.  <\/p>\n
