Justice S.S.SATHEESACHANDRAN\n\n Dated :20\/08\/2009\n\n O R D E R\n              S.S.SATHEESACHANDRAN, J.\n                   -------------------------------\n             W.P.(C).NO.37815 OF 2008 (B)\n                 -----------------------------------\n       Dated this the 20th day of August, 2009\n\n                       J U D G M E N T\n<\/pre>\n<p>     The writ petition is filed seeking the following reliefs:<\/p>\n<p>        i. to call for the records leading to the<br \/>\n        issuance of Ext.P5 order and set aside the<br \/>\n        same and dismiss Ext.P2 petition.\n<\/p>\n<p>        ii. to issue any other writ, order or<br \/>\n        direction, this Honourable Curt would<br \/>\n        deem fit to issue in the facts and<br \/>\n        circumstances of the case.\n<\/p>\n<p>        iii. to issue the cost of this writ petition.<\/p>\n<p>     2. Petitioners are 15th and 17th defendants in O.S.No.85<\/p>\n<p>of 2007 on the file of the Sub Court, Pala. The above suit has<\/p>\n<p>been instituted by the 1st respondent, a public sector bank for<\/p>\n<p>a declaration that some of the documents executed by<\/p>\n<p>defendants 1 to 4, 15, 16, 17 and 18 are liable to be treated as<\/p>\n<p>fraudulent transfers as covered under Section 53 of the<\/p>\n<p><span class=\"hidden_text\">WPC.37815\/08                   2<\/span><\/p>\n<p>Transfer of Property Act. Since a declaration under Section<\/p>\n<p>53 of the Transfer of Property Act regarding the fraudulent<\/p>\n<p>transfers covered by the registered documents was sought for,<\/p>\n<p>leave of the court was essential to institute the suit, which was<\/p>\n<p>applied for by the plaintiff. The court, after issuing notice to<\/p>\n<p>the parties and hearing both sides, granted leave by Ext.P5<\/p>\n<p>order. Propriety and correctness of that order is challenged<\/p>\n<p>by the petitioners, 15th     and 17th defendants in the suit<\/p>\n<p>invoking the supervisory jurisdiction vested with this Court<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>     3.    I heard the counsel on both sides.       The learned<\/p>\n<p>counsel for the petitioners submitted that no relief is sought<\/p>\n<p>for against the 15th and 17th defendants in the suit, and so<\/p>\n<p>much so, the leave applied for by the plaintiff and granted by<\/p>\n<p>the court is unsustainable as against them under law and<\/p>\n<p>facts. The learned counsel for the 1st respondent bank submits<\/p>\n<p>that in respect of a loan advanced to the 15th defendant<\/p>\n<p>company, the defendants 1 to 4, 15, 16, 17 and 18 are<\/p>\n<p>guaranteers, and all of them had furnished their property as<\/p>\n<p><span class=\"hidden_text\">WPC.37815\/08                      3<\/span><\/p>\n<p>security for the loan transaction.      That being the position,<\/p>\n<p>when suit is instituted, presence of 15th and 17th defendants,<\/p>\n<p>who alone have objected the grant of leave by filing this writ<\/p>\n<p>petition, according to the counsel, is essential and necessary<\/p>\n<p>for a fair and proper disposal of the suit in accordance with<\/p>\n<p>law.   After perusing the materials produced with the writ<\/p>\n<p>petition including copy of the plaint, the application for the<\/p>\n<p>leave applied by the 1st respondent bank with reference to<\/p>\n<p>Ext.P5 order, I find no impropriety or illegality in the order<\/p>\n<p>passed by the court below granting leave to the plaintiff to<\/p>\n<p>institute the suit for the reliefs claimed in the plaint.<\/p>\n<p>      Writ petition is devoid of any merit, and it is dismissed.<\/p>\n<p>                             S.S.SATHEESACHANDRAN<br \/>\n                                         JUDGE<\/p>\n<p>prp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M\/S.
