The accused-petitioner has preferred this revision<\/p>\n<p>                        application against the judgment and order dated<\/p>\n<p>                        28.02.2002 passed by the learned 1st Additional Sessions<\/p>\n<p>                        Judge, Gaya in Criminal Appeal No.3\/01 by which the<\/p>\n<p>                        judgment and order of conviction and sentence dated<\/p>\n<p>                        22.07.1998 under Section 20 of Bihar Forest Produce<\/p>\n<p>                        (Regulation of Trade) Act, 1984 by the learned Judicial<\/p>\n<p>                        Magistrate, Ist Class, Sherghati at Gaya in Forest Case<\/p>\n<p>                        No.146\/90, Trial No.34\/98 has been confirmed and the<br \/>\n Patna High Court CR. REV. No.428 of 2002 dt.26-09-2011                             2<\/p>\n<p>                      appeal has been dismissed.\n<\/p>\n<p>                              The prosecution case, in brief, is that on<\/p>\n<p>                      20.11.1990, Forest Officials were performing checking<\/p>\n<p>                      work at Banke Bazar Forest Check Naka and they<\/p>\n<p>                      stopped one Ambassador car and on search Katha<\/p>\n<p>                      biscuits weighing 90 K.Gs. kept in four bags in dickey<\/p>\n<p>                      of Car were found being transported without transit<\/p>\n<p>                      permit and four accused persons including the petitioner<\/p>\n<p>                      were arrested and others managed to escape and the<\/p>\n<p>                      convict and others could not produce any paper of katha<\/p>\n<p>                      and Car and office report and seizure list were prepared<\/p>\n<p>                      on the spot and they were arrested and remaining four<\/p>\n<p>                      accused persons fled away. After investigation, charge-<\/p>\n<p>                      sheet was submitted. Cognizance was taken against all<\/p>\n<p>                      the accused including the petitioner. The other accused<\/p>\n<p>                      absconded after getting bail. The petitioner has faced his<\/p>\n<p>                      trial and he has been convicted and sentenced to R.I. for<\/p>\n<p>                      six months under Section 42 of the Indian Forest Act<\/p>\n<p>                      and six months R.I. under Section 20 of the Bihar Forest<\/p>\n<p>                      Produce (Regulation of Trade) Act, 1984. Thereafter the<\/p>\n<p>                      petitioner filed Criminal Appeal No.3\/01 against the<\/p>\n<p>                      aforesaid judgment of conviction and sentence passed<br \/>\n Patna High Court CR. REV. No.428 of 2002 dt.26-09-2011                             3<\/p>\n<p>                      by the learned Judicial Magistrate. After hearing the<\/p>\n<p>                      learned counsel for both the parties, the judgment and<\/p>\n<p>                      order of conviction and sentence under Section 42 of the<\/p>\n<p>                      Indian Forest Act has been set aside and the conviction<\/p>\n<p>                      and sentence under Section 20 of the Bihar Forest<\/p>\n<p>                      Produce (Regulation of Trade) Act, 1984 has been<\/p>\n<p>                      affirmed by the impugned judgment and order.<\/p>\n<p>                              The learned counsel for the petitioner has<\/p>\n<p>                      submitted that there is no material on the record to show<\/p>\n<p>                      that the petitioner has any criminal antecedent. The<\/p>\n<p>                      petitioner should have been granted the benefit of<\/p>\n<p>                      Probation of Offenders Act. The occurrence has taken<\/p>\n<p>                      place on 20.11.1990 and almost 21 years have passed.<\/p>\n<p>                      The accused petitioner has been suffering from mental<\/p>\n<p>                      agony and the sentence of the petitioner deserves to be<\/p>\n<p>                      modified.\n<\/p>\n<p>                              Learned counsel for the State could not controvert<\/p>\n<p>                      the contention of the petitioner.\n<\/p>\n<p>                              After hearing the learned counsels for both the<\/p>\n<p>                      parties and on perusal of the materials on record, it<\/p>\n<p>                      appears that the contention of the learned counsel for the<\/p>\n<p>                      petitioner is correct. The case is of the year 1990 and<br \/>\n        Patna High Court CR. REV. No.428 of 2002 dt.26-09-2011                           4<\/p>\n<p>                             almost 21 years have passed. The accused petitioner has<\/p>\n<p>                             been suffering from mental agony and has also served<\/p>\n<p>                             the sentence for about one month.\n<\/p>\n<p>                                     Considering the facts and circumstances, in my<\/p>\n<p>                             opinion, it is fit case in which the sentence of the<\/p>\n<p>                             petitioner should be modified. The sentence of the<\/p>\n<p>                             petitioner is reduced to the period already undergone in<\/p>\n<p>                             custody.\n<\/p>\n<p>                                     With this modification in the sentence, this<\/p>\n<p>                             petition is dismissed.\n<\/p>\n<\/p>\n<p>                                                      ( Amaresh Kumar Lal, J.)<br \/>\nPatna High Court, Patna<br \/>\nDated the 26th September, 2011<br \/>\nNAFR\/V.K.
