Justice K.T.SANKARAN\n\n Dated :04\/11\/2010\n\n O R D E R\n                  K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.31758     OF 2010\n          ------------------------------\n      Dated this the 4th day of November, 2010\n\n\n\n\n                       JUDGMENT\n<\/pre>\n<p>    The reliefs prayed for in the Writ Petition<\/p>\n<p>are the following:\n<\/p>\n<\/p>\n<blockquote><p>    &#8220;a.  issue  a    writ  of   mandamus    or  other<br \/>\n        appropriate   writ,   order    or   direction<br \/>\n        directing the respondents to re-fix the pay<br \/>\n        of  petitioner  after  granting  him  advance<br \/>\n        increments  in   terms  of   Ext.P4   and  P7<br \/>\n        judgments and disburse the entire arrears due<br \/>\n        to him along with interest at the rate of 12%<br \/>\n        per annum on arrears due to him based on such<br \/>\n        re-fixation;\n<\/p><\/blockquote>\n<blockquote><p>    b.  issue such other directions as this Hon&#8217;ble<br \/>\n        Court may deem fit and proper;\n<\/p><\/blockquote>\n<blockquote><p>    c.  Grant the costs of this petition.&#8221;<\/p><\/blockquote>\n<p>    2. A statement dated 3rd November, 2010 is<\/p>\n<p>filed on behalf of the first respondent.         For the<\/p>\n<p>sake of convenience, the statement is quoted below:<\/p>\n<blockquote><p>    &#8220;1. The petitioner acquired Ph.D on 20.9.1997 and<br \/>\n        his grievance is that he is denied advance<br \/>\n        increment due to him on acquiring Ph.D.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C).No.31758 OF 2010     2<\/span><\/p>\n<blockquote><p>     2.  The petitioner had filed WP(C) No.34803\/2004<br \/>\n          before  the  Hon&#8217;ble  High  Court  of  Kerala.<br \/>\n          Considering the judgment of the Hon&#8217;ble High<br \/>\n          Court of Kerala, the department verified the<br \/>\n          admissibility  of  Advance  Increment  to  the<br \/>\n          petitioner and requested the 2nd respondent to<br \/>\n          sanction him Advance increments with effect<br \/>\n          from 20.9.1997, through letter No.U.G.C Cell 3<br \/>\n          (2) 13217\/05 dated 6.5.2005.  The copy of the<br \/>\n          letter was served to the petitioner also.\n<\/p><\/blockquote>\n<blockquote><p>     3.  The petitioner brought before the attention of<br \/>\n          the department that he is still in not receipt<br \/>\n          of the benefit of advance increments through<br \/>\n          his letter dated 13.6.2009.  Consequent on the<br \/>\n          receipt  of   the  representation   from   the<br \/>\n          petitioner,  a   request   was  made   to   2nd<br \/>\n          respondent about non-fixation of pay by adding<br \/>\n          the advance increments.    The 2nd respondent<br \/>\n          vide  letter  dated  22.9.2010  informed   the<br \/>\n          respondent  that  authorization  slip  can  be<br \/>\n          issued only on receipt of Departmental orders<br \/>\n          sanctioning   advance   increments   to    the<br \/>\n          petitioner.\n<\/p><\/blockquote>\n<blockquote><p>     4.  The request dated 13.6.2009 submitted by the<br \/>\n          petitioner  was   examined  in   detail.   The<br \/>\n          petitioner&#8217;s request was that he is entitled<br \/>\n          to get two advance increments with effect from<br \/>\n          20.9.1997, ie on the date of awarding his Ph.D<br \/>\n          Degree.  Having found that he is entitled for<br \/>\n          the  benefit  from  20.9.1997,  the  same  was<br \/>\n          allowed by proceedings dated 19.10.2010, also<br \/>\n          requested  the  2nd respondent  to   make  pay<br \/>\n          fixation  in   accordance   with   the   above<br \/>\n          proceedings.   Copy has been sent to the 2nd<br \/>\n          respondent and to the petitioner also. True<br \/>\n          copy of the order dated 19.10.2010 is produced<br \/>\n          herewith and marked as Annexure-R1(a).&#8221;<\/p><\/blockquote>\n<p>    3. In view of the statement filed and in view<\/p>\n<p>of Ext.R1(a) order dated 19.10.2010, the only order<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.31758 OF 2010   3<\/span><\/p>\n<p>that is required is to issue a direction to the<\/p>\n<p>Accountant General (Second respondent) to re-fix<\/p>\n<p>the pay of the petitioner and to disburse the<\/p>\n<p>benefits.      Accordingly, there will be  such a<\/p>\n<p>direction to the second respondent.
