Rule.\n<\/p>\n<p> 2. With the consent of the parties, the matter is taken up<br \/>\ntoday for final hearing.\n<\/p>\n<p> 3. This writ petition challenges the denial of the benefit<br \/>\nto the petitioner of Clause 66 of the Export-Import Policy<br \/>\n1992-97 which reads as follows:\n<\/p>\n<p>   &#8220;Exports\/supplies made from the<br \/>\ndate of receipt of an application under<br \/>\nthis scheme by the licensing authority<br \/>\nmay be accepted towards discharge of<br \/>\nexport obligation. If the application<br \/>\nis approved, the license shall be<br \/>\nissued based on the input\/output and<br \/>\nvalue addition norms in force on the<br \/>\ndate of receipt of the application by<br \/>\nthe licensing authority in proportion<br \/>\nto the provisional exports already made<br \/>\ntill any amendment in the norms is<br \/>\nnotified. For the remainder of the<br \/>\nexports, the Policy\/Procedure in force<br \/>\non the date of the issue of the license<br \/>\nshall be applicable. The conversion of<br \/>\nduty free shipping bills to drawback<br \/>\nshipping bills may also be permitted by<br \/>\nthe Customs authorities in case the<br \/>\napplication is rejected or modified by<br \/>\nthe licensing authority. The exports\/<br \/>\nsupplies made in anticipation of the<br \/>\ngrant of a duty free license shall be<br \/>\nentirely on the risk and responsibility<br \/>\nof the exporter.&#8221;\n<\/p>\n<p> 2. The case set out in the writ petition is:\n<\/p>\n<p>  That the petitioner made an application for the grant<br \/>\nof Advance license under the Value Based Advance license<br \/>\nScheme (hereinafter) referred to as the &#8216;VABAL&#8217;) on 18th of<br \/>\nMarch,  1997. On 21st of March, 1997, the application was<br \/>\napproved and sent for processing and on 22nd of March,<br \/>\n1997, the electronic goods were exported by the petitioner<br \/>\nentitling it to Value Based Free license in the sum of US $<br \/>\n28,545. The customs clearance was obtained on 28th of<br \/>\nMarch, 1997 and the goods were dispatched on 29th of March,<br \/>\n1997.\n<\/p>\n<p> 3. One of the significant pleas in the writ petition is at<br \/>\nPara 11 of the petition which reads as under:\n<\/p>\n<p>  &#8220;That it is submitted that the said<br \/>\napplication of the petitioner was<br \/>\napproved by the respondent No. 1 on 21st<br \/>\nMarch, 1997 and the directions were<br \/>\nissued for proceeding the grant of<br \/>\nvalue based license to the petitioner.&#8217;  <\/p>\n<p> 4. The said averment was rebutted by the respondents in<br \/>\ntheir counter affidavit in the following terms:\n<\/p>\n<p>  &#8220;The contents of Para 11 of the<br \/>\nPetition are wrong and denied as the<br \/>\nsame are incorrect information.&#8221;\n<\/p>\n<p> Thus it is clear that there is no categorical denial<br \/>\nof the petitioner&#8217;s  plea that the application of the<br \/>\npetitioner was approved by the respondent No. 1 on 21st of<br \/>\nMarch, 1997. However, without going into the veracity of<br \/>\nthe above, the petitioner&#8217;s case purely turns on the<br \/>\ninterpretation of Clause 66 of the Policy.\n<\/p>\n<p> 4. Mr. Malhotra, the learned counsel for the petitioner<br \/>\nhas submitted that the phrase &#8220;If the application is<br \/>\napproved, the license shall be issued based on the<br \/>\ninput\/output and value addition norms in force on the date<br \/>\nof receipt of the application&#8221; entitled it to avail of the<br \/>\nvalue addition norms in force on the date of the receipt of<br \/>\nthe application irrespective of the date of the approval<br \/>\nand it is indeed a vested right in the export license<br \/>\ngranted by the said policy. He submits that since there is<br \/>\nno rejection of the petitioner&#8217;s application whatever be<br \/>\nthe date of the approval, the petitioner is entitled to<br \/>\ninvoke the input\/output and value addition norms in force<br \/>\non 18th of March, 1997. It appears that there was a change<br \/>\nof policy on 1st of April, 1997 and the changed policy did<br \/>\nnot grant the Value Based Advance license and only approved<br \/>\nthe Quantity Based Advance license or duty drawback.\n<\/p>\n<p> 5. Ms. Pratibha M. Singh, the learned counsel, appearing<br \/>\nfor the respondents, however, has submitted that the<br \/>\npetitioner had two option as per the Policy Circular dated<br \/>\n1st of April, 1997, the Para 3 of which reads as under:\n<\/p>\n<p>  &#8220;However, in respect of pending<br \/>\napplications filed before 1.4.97 for<br \/>\nissuance of Value Based Advance license<br \/>\nwhere such licenses have not been<br \/>\nissued before 1.4.97, the applicant<br \/>\nshall have the option to convert their<br \/>\napplication into Advance license in<br \/>\naccordance with the Exim Policy<br \/>\n1997-2002 and the Handbook of<br \/>\nProcedures (Vol. 1) and (Vol. 2)<br \/>\n1997-2002. Such application shall be<br \/>\nconsidered by the licensing authority<br \/>\nwithout calling for the application<br \/>\nafresh in terms of Handbook of<br \/>\nProcedures (Vol. 1) 1997-2002.\n<\/p>\n<p>Alternatively, the applicant in such<br \/>\npending cases, shall also have the<br \/>\noption to claim drawback in lieu of<br \/>\nissuance of advance license under Exim<br \/>\nPolicy 1997-2002.&#8221;\n<\/p>\n<p> Thus according to the learned counsel for the<br \/>\nrespondents, the petitioner was entitled to have option<br \/>\nof either claiming drawback in lieu of issue of Value Based<br \/>\nAdvance license under the Exim Policy 1997-2002 or convert<br \/>\nits application into Quantity Based Advance license.\n<\/p>\n<p> 6. She further submitted that the petitioner was entitled<br \/>\nto avail of any of these options which it is not seeking in<br \/>\nthe present writ petition and only seeks a mandamus for<br \/>\nissuance of Value Based Advance license in terms of its<br \/>\napplication dated 18th March, 1997. She has also relied<br \/>\nupon Para 66 of the Exim Policy of the year 1992-97 to<br \/>\nsubmit that if there is no approval, there cannot be any<br \/>\ngrant of license and the Policy clearly implies that<br \/>\nexports undertaken in such a situation are at the risk of<br \/>\nexporter in the event of the approval not forthcoming. She<br \/>\nfurther relies upon Clause 7.14 of the Exim Policy of the<br \/>\nyear 1997-2002 to contend that export obligation has to be<br \/>\nfulfilled within a period of 18 months which Clause clearly<br \/>\nshows that approval means that it is only from the date of<br \/>\nthe grant of license.\n<\/p>\n<p> 7. The primary issue which arises in the writ petition is<br \/>\nthe interpretation of Clause 66 of the Policy by the<br \/>\nrespondents. The respondents&#8217; case seems to be that with<br \/>\neffect from 1st of April, 1997, the petitioner was not<br \/>\nentitled to invoke the earlier norms and was governed by<br \/>\nthe norms applicable from 1st of April, 1997. In my view,<br \/>\nconsidering the Clause 66 and in particular the saving of<br \/>\nthe applicable norms with reference to the date of the<br \/>\napplication, the said interpretation does not represent the<br \/>\ncorrect position of law. The petitioner is entitled to<br \/>\ninvoke the input\/output and value addition norms in force<br \/>\non the date of the receipt of the application, subject to<br \/>\nthe approval of the application whatever the date of the<br \/>\napproval and in fact that is the precise purpose of Clause\n<\/p>\n<p>66. Furthermore considering the averments in paragraph 3<br \/>\nof the writ petition and its reply in the counter<br \/>\naffidavit, the petitioner has demonstrated that its<br \/>\napplication under Clause 66 was approved.\n<\/p>\n<p> 8. In this view of the matter, the stand taken by the<br \/>\nrespondents, in so far as it rejects the petitioner&#8217;s<br \/>\napplication for issuance of Value Based Advance license on<br \/>\nthe basis of the norms which came into force on 1st of<br \/>\nApril, 1997 cannot be countenanced by the provisions of<br \/>\nClause 66. Accordingly, the writ petition is entitled to<br \/>\nsucceed and is thus allowed, directing the respondents to<br \/>\nprocess the application of the petitioner for approval in<br \/>\naccordance with law and Clause 66 which states that in case<br \/>\nthe petitioner&#8217;s application is approved, it shall be<br \/>\nentitled to invoke the provisions of Clause 66 for issuance<br \/>\nof a Value Based Advance license on the input\/output and<br \/>\nvalue addition norms in force on the date of receipt of the<br \/>\napplication, i.e., 18th of March, 1997. The petitioner&#8217;s<br \/>\napplication be processed within a period of eight week&#8217;s<br \/>\nfrom the date of receipt of this judgment.\n<\/p>\n<p> 9.
