The incident occurred on<br \/>\n12.7.2003 at about 2-30 PM at village Ghagharpura of Jetpur Pavi<br \/>\ntaluka of Baroda district. The deceased happened to be the nephew of<br \/>\nthe appellant. The appellant, Bhimsing, father of the victim, and<br \/>\nKhumansing are brothers and were having some disputes regarding land.<br \/>\nOn the day of the incident, the appellant had gone to the house of<br \/>\nAmrutbhai Vechatbhai, who is also his nephew. The appellant,<br \/>\nBhimsing, father of the deceased, and Vechatbhai were there. After<br \/>\nsometime Khumansing joined them. They had some discussion about the<br \/>\nproperty dispute, followed by an altercation, and then the fight. The<br \/>\nappellant was attacked upon with a wooden log by Bhimsing, whereas<br \/>\nhis wife was attacked by Bhimsing, Kanaksing and Vijay. While the<br \/>\nepisode was on, the appellant rushed to his house, which was located<br \/>\nat a short distance of about 70 feet, and came back with a Dharia and<br \/>\ninflicted a blow on the head of Kanaksingh, as a result of which,<br \/>\nKanaksing fell down and the appellant went away. The deceased was<br \/>\ntaken to hospital by relatives. From Jetpur Pavi hospital, he was<br \/>\nreferred to SSG Hospital, Baroda, but while he was being taken to SSG<br \/>\nHospital, Baroda, he succumbed to the injuries. An FIR was lodged by<br \/>\nBhimsing Manga Rathwa. On the basis of the FIR, an offence was<br \/>\nregistered by Jetpur Pavi police and investigated. Having found<br \/>\nsufficient material, a charge-sheet was filed in the Court of JMFC,<br \/>\nChhota Udepur, who, in turn, committed the case of the Court of<br \/>\nSessions.\n<\/p>\n<p>2.\tSessions<br \/>\nCase No.83 of 2003 was registered. Charge was framed against the<br \/>\nappellant at Exh.3 for the offence of murder and offence punishable<br \/>\nunder Section 135 of the Bombay Police Act, to which he pleaded not<br \/>\nguilty and claimed to be tried.\n<\/p>\n<p>3.\tThe<br \/>\ntrial Court having found that the charge of murder was proved,<br \/>\nconvicted him for the same  and sentenced him to undergo imprisonment<br \/>\nfor  life with a fine of Rs.1,000\/-, in default, to undergo SI for<br \/>\none month. He came to be acquitted for the offence punishable under<br \/>\nSection 135 of the Bombay Police Act. This appeal challenges the<br \/>\njudgment and order rendered by Sessions Court, Vadodara at Chhota<br \/>\nUdepur on 17.1.2005 in the said Sessions Case No.83 of 2003.\n<\/p>\n<p>4.\tIncidentally,<br \/>\nthe appellant lodged a cross complaint with Pavi Jetpur police<br \/>\nstation in respect of this very incident and the police has<br \/>\nregistered the offence and after investigating the same, filed<br \/>\ncharge-sheet in the Court of JMFC, Chhota Udepur and is yet to be<br \/>\ncommitted and tried.\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate Ms Shah for the appellant submitted that there are five<br \/>\neye-witnesses to the incident and if their depositions are seen along<br \/>\nwith the fact that the appellant has himself lodged an FIR in respect<br \/>\nof the same incident, it is difficult for her to press for a clean<br \/>\nacquittal or to press for non-involvement of the appellant in the<br \/>\nincident.\n<\/p>\n<p>5.1\tMs<br \/>\nShah, however, submitted that if the evidence of the eye-witnesses is<br \/>\nseen, it is clear that the appellant had gone to the house of his<br \/>\nnephew bare handed and had no weapon with him. Dispute, of course,<br \/>\nwas there, which was sought to be solved with negotiations and, in<br \/>\ndoing so, heat was generated. There was an altercation, followed by a<br \/>\nfight, where the appellant came to be assaulted upon with a wooden<br \/>\nlog, so also his wife. This enraged the appellant and he, therefore,<br \/>\nrushed to his house located in a close proximity of the place of<br \/>\nincident, brought out a Dharia and inflicted a blow on Kanaksing, who<br \/>\nwas actively participating in the incident, by pelting stones. The<br \/>\nappellant inflicted only one dharia blow. Unfortunately, the deceased<br \/>\nfell down and, ultimately, succumbed to the injuries. If the<br \/>\nappellant had any intention of causing death of the deceased, he<br \/>\nwould have repeatedly inflicted the blows. The incident has,<br \/>\ntherefore, occurred without pre-meditation, out of a quarrel and<br \/>\nfight. The intention of causing death of the deceased cannot be<br \/>\nattributed to the appellant and, therefore, the case would not fall<br \/>\nunder Section 302 of IPC but his conviction may be altered to one<br \/>\nunder Section 304 Part-II of IPC. Ms Shah, therefore, submitted that<br \/>\nthe appeal may be allowed accordingly.\n<\/p>\n<p>6.\tLearned<br \/>\nAPP Mr Parikh has opposed this appeal. According to him, the<br \/>\nappellant had rushed to his house, and came back with a Dharia and<br \/>\nthen inflicted a fatal blow on the deceased. The intention can be<br \/>\ninferred from the fact that he had rushed to his house,  brought<br \/>\nDharia, and caused fatal injury on vital part of the body of the<br \/>\ndeceased, namely, head. According to Mr Parikh, therefore, this is a<br \/>\nclear case of murder and the trial Court is justified in convicting<br \/>\nthe appellant for murder. The appeal does not call for any<br \/>\ninterference in exercise of appellate jurisdiction. The appeal may,<br \/>\ntherefore, be dismissed.\n<\/p>\n<p>7.\tMs<br \/>\nShah is right when she contends that it is difficult for her to argue<br \/>\nfor a clean acquittal or non-involvement of the appellant in the<br \/>\nincident. The prosecution has examined first informant Bhimsing Manga<br \/>\nRathwa at Exh.7, Vijay Bhimsing Rathwa at Exh.10, Niruben Bhimsing<br \/>\nRathwa at Exh.9, Ramesh Makabhai Rathwa at Exh.14 and Jayanti<br \/>\nChhuniyabhai Rathwa at Exh.15.\n<\/p>\n<p>7.1\tThese<br \/>\nare eye-witnesses to the incident and if their depositions are seen,<br \/>\nwhat emerges from their depositions as a whole, i.e.<br \/>\nexamination-in-chief and cross-examination, is that the appellant had<br \/>\ngone to the house of his nephew Amrutbhai Vechatbhai. There all<br \/>\nbrothers assembled, namely, Bhimsing, Khumansing and Vechatbhai. It<br \/>\nis also not in dispute that the brothers were having some dispute<br \/>\nover land. The discussion started and resulted into altercation. It<br \/>\nalso emerges from the evidence of eye-witnesses that the appellant<br \/>\nand his wife both were assaulted upon by the others either with a<br \/>\nwooden log or with stones, as a result, the appellant rushed to his<br \/>\nhouse, brought a Dharia, and inflicted a blow on head of Kanaksing,<br \/>\nwho was engaged in stone pelting. After the blow, Kanaksing fell down<br \/>\nand then was taken to the Community Heath Centre at Jetpur Pavi from<br \/>\nwhere he was referred to SSG Hospital, Baroda and died on the way.<br \/>\nThe evidence of eye-witnesses also reveals that the appellant<br \/>\ninflicted only one blow on the head of the deceased. It also emerges<br \/>\nfrom the evidence that after the appellant inflicted a blow on the<br \/>\ndeceased, he fell down and the episode stopped. Therefore,<br \/>\nnecessarily, assault on the appellant and his wife  was prior to the<br \/>\nappellant going to get the Dharia and inflicting the blow. One would<br \/>\nobviously be enraged if he and his wife both are assaulted upon by<br \/>\nothers and same thing seems to have happened with the appellant. It<br \/>\nemerges from the evidence that they had assembled for negotiating<br \/>\nabout the land dispute, which resulted into altercation, followed by<br \/>\na fight and then the assault. There was no pre-meditation. The<br \/>\nappellant inflicted only one blow and cannot be said to have taken<br \/>\nany undue advantage of the situation. In our view, therefore,<br \/>\nException-4 to Section 300 would be attracted as all the ingredients<br \/>\nhaving been satisfied through the evidence of eye-witnesses.\n<\/p>\n<p>8.\tDr<br \/>\nRamanlal Vaishnav is examined at Exh.25. He had performed the<br \/>\npost-mortem and prepared post-mortem notes at Exh.29. The post-mortem<br \/>\nnotes indicate the cause of death to be extradural and subdural<br \/>\nhammertonea followed by incised wound on skull vacult. The doctor<br \/>\nalso opined that the injuries were homicidal and were possible with<br \/>\nsharp cutting weapon. The injuries were ante-mortem and sufficient in<br \/>\nthe ordinary course of nature to cause death.\n<\/p>\n<p>9.\tIn<br \/>\nlight of the foregoing discussion, it is clear that there was no<br \/>\nintention on the part of the appellant to cause death of the deceased<br \/>\nand the offence of murder would not be constituted. It would be  an<br \/>\noffence of culpable homicide not amounting to murder punishable under<br \/>\nSection 304 of IPC.\n<\/p>\n<p>10.\tThe<br \/>\nnext question that arises for consideration is whether  the case<br \/>\nwould fall under Part-I or Part-II of Section 304 of IPC. According<br \/>\nto learned APP, it would fall under Part-I of Section 304, whereas<br \/>\naccording to Ms Shah, it would be fall under Part-II of the said<br \/>\nsection.\n<\/p>\n<p>11.\tConsidering<br \/>\nthe evidence on record, it is clear that the appellant after being<br \/>\nassaulted, rushed to his house and brought Dharia. He inflicted only<br \/>\none blow with Dharia on the head of the deceased, but the fact that<br \/>\nhe used the Dharia and gave a blow on head of the deceased, which is<br \/>\na vital organ,  and considering the nature of injury, we are of the<br \/>\nview that the intention on the part of the appellant  to cause injury<br \/>\nwas with the knowledge that the act was likely to cause such bodily<br \/>\ninjury as was likely to cause death and, therefore, the case would<br \/>\nfall under Part-I of Section 304 of IPC.\n<\/p>\n<p>12.<br \/>\nThe appeal would thus stand partly allowed. The appellant&#8217;s<br \/>\nconviction for the offence punishable under Section 302 of IPC is<br \/>\naltered to one punishable under Section 304 Part-I of IPC.\n<\/p>\n<p>13.\tWe<br \/>\nhave heard both the sides on the quantum of punishment.\n<\/p>\n<p>14.\tMs<br \/>\nShah submitted that the appellant is aged about 56 years and has a<br \/>\nwife, who is required to be looked after. His daughter, having<br \/>\nmarried, stays separately. Even otherwise, he is a poor man and,<br \/>\ntherefore, minimum punishment may be inflicted.\n<\/p>\n<p>15.\tLearned<br \/>\nAPP Mr Parikh has opposed the submissions.\n<\/p>\n<p>16.\tHaving<br \/>\nregard to the facts and circumstances of the case, considering that<br \/>\nthe conviction is altered from Section 302 to Section 304 Part-I of<br \/>\nIPC and the age factor of the appellant, social background, we are of<br \/>\nthe view that ends of justice would be met if the appellant is<br \/>\nsentenced to undergo RI for 7 (seven) years with a fine of Rs.1,000\/-<br \/>\n(Rupees one thousand), in default, SI for one month. The appellant<br \/>\nshall be entitled to the benefit of set off.\n<\/p>\n<p>\tIt<br \/>\nis directed accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.L.\n<\/p>\n<p>DAVE, J.)<\/p>\n<p>\t\t\t\t\t\t\t(BANKIM<br \/>\nN.
