No appearance\n\t\t\t\t\n:ORDER\n<\/pre>\n<p>\tThe writ petition is directed against the order passed by the Labour<br \/>\nOfficer, holding charge of post of Assistant Commissioner, Madurai, in exercise<br \/>\nof the power of the Controlling Authority, under the payment of Gratuity Act.\n<\/p>\n<p>\t2.The case set up by the petitioner is that the 5th respondent was<br \/>\nemployed by the petitioner company and on superannuation, he was relieved from<br \/>\nservices after payment of gratuity.\n<\/p>\n<p>\t3.The 5th respondent being dissatisfied with the payment of gratuity,<br \/>\nfiled a claim before the Controlling Authority under the payment of Gratuity<br \/>\nAct, on the ground, that he had not been paid gratuity for two years of service.\n<\/p>\n<p>\t4.The claim raised by the 5th respondent was accepted and the petitioner<br \/>\nwas directed to pay a sum of Rs.6,000\/- as balance amount of gratuity due to the<br \/>\n5th respondent.\n<\/p>\n<p>\t5.When the writ petition came for hearing, this Court while admitting the<br \/>\npetition on 21.01.2006 passed the following order:-\n<\/p>\n<p>\t&#8220;There will be an order of interim stay, subject to the condition that the<br \/>\npetitioner depositing 50 percent of the amount to the Assistant Commissioner of<br \/>\nLabour\/first respondent, within a period of three weeks from the date of receipt<br \/>\nof a copy of this order, failing which the interim stay shall be stand<br \/>\nautomatically vacated. Notice.&#8221;\n<\/p>\n<p>\t6.The learned counsel for the petitioner states that pursuance to the<br \/>\norder passed by this Court, 50% of the gratuity amount stands paid.\n<\/p>\n<p>\t7.The only ground on which the petitioner had challenged the order passed<br \/>\nby the Controlling Authority, is that by way of notification, dated 15.04.2000,<br \/>\nthe  Assistant Commissioner of Labour, office of the Deputy Commissioner of<br \/>\nLabour, Madurai, were conferred with powers of the Controlling Authority under<br \/>\nthe payment of Gratuity Act.\n<\/p>\n<p>\t8.It is the case of the petitioner that on transfer of Assistant<br \/>\nCommissioner of Labour, no new Assistant Commissioner was appointed, and the<br \/>\npowers of the Assistant Commissioner were vested with the Labour Officer, the<br \/>\n4th respondent, by way of stop gap arrangement, for administrative duties only.\n<\/p>\n<p>\t9.It is contended by the learned counsel for the petitioner that a person<br \/>\nholding administrative charge as stop gap arrangements has no jurisdiction to<br \/>\nexercise the statutory powers under the Act.\n<\/p>\n<p>\t10.In support of his contention, the learned counsel for the petitioner<br \/>\nrelied upon the judgment of this Court in 1997 Writ L.R.33, [<a href=\"\/doc\/742187\/\">C.Baskaran vs. The<br \/>\nDistrict Collector, Trichy and<\/a> another] wherein the Hon&#8217;ble Division Bench of<br \/>\nthis Court was pleased to lay down as under:-\n<\/p>\n<p>\t&#8220;There is one more aspect of the matter which has not been noticed by the<br \/>\npetitioner\/appellant and also by the learned single judge.  The order is not<br \/>\npassed by the District Collector, Trichy, but it is passed by the officer-in-<br \/>\ncharge of the office of the District Collector.  The very title of the<br \/>\nproceedings shows that it is the order passed by the Incharge Collector. In-<br \/>\ncharge Collector cannot be considered to be the Collector and he is entitled to<br \/>\ndischarge the statutory functions of the Collector.  He is only intended to look<br \/>\nafter the day-to-day administration and is not entitled to exercise the<br \/>\nstatutory powers. Therefore, on this ground also, the impugned order is liable<br \/>\nto be set aside.&#8221;\n<\/p>\n<p>\t11.In the case of <a href=\"\/doc\/521967\/\">K.Thangarajan vs. K.Palanisamy, the<\/a> view of the Hon&#8217;ble<br \/>\nDivision Bench of this Court referred to above was reiterated.\n<\/p>\n<p>\t12.The learned counsel appearing for the State, on the other hand,<br \/>\ncontended that by way of notification the Assistant Commissioner, was given the<br \/>\npower of the Controlling Authority under the Gratuity Act, and the fact that the<br \/>\nLabour Officer was performing the duties of the Assistant Commissioner.<br \/>\nTherefore, no fault can be found with the exercise of the power of Controlling<br \/>\nAuthority, by the Labour Officer.\n<\/p>\n<p>\t13.It is also the contention of the learned counsel appearing for the<br \/>\nState, that once a person is vested with the power of the Assistant<br \/>\nCommissioner, the notification would cover the exercise of power of the<br \/>\nControlling Authority by Labour Officer and as no special notification is<br \/>\nrequired.\n<\/p>\n<p>\t14.However, on consideration, I find force in the contention raised by the<br \/>\nlearned counsel for the petitioner. Once by notification, an authority is<br \/>\nconferred with jurisdiction of quasi-judicial authority, the same cannot be<br \/>\nexercised by a person holding the post as stop gap arrangements. This is the<br \/>\nview of the Hon&#8217;ble Division Bench of this Court referred to above.\n<\/p>\n<p>\t15.In view of the pronouncement by the Hon&#8217;ble Division Bench of this<br \/>\nCourt referred to above, the writ petition deserves to be allowed, accordingly,<br \/>\nimpugned order is set aside, the matter is remanded back to the Controlling<br \/>\nAuthority, to pass fresh orders after hearing the parties.\n<\/p>\n<p>\t16.Keeping in view of that the claim of workman is pending since, the<br \/>\nControlling Authority is directed to expedite the hearing and finally dispose<br \/>\nthe application within a period of two months from the date of receipt of<br \/>\ncertified copy of this order. Consequently, connected Miscellaneous Petition is<br \/>\nclosed.
