TAIMNI, MEMBER. \n\n \n\n\u00a0 \n\n \n\nUnfair trade\npractice  petitioner-opposite party in revision  concurrent finding that he\ndid not possess even valid RMP licence to practice medicines  second\npetitioner, opposite party is\ncompounder who gave injection to the complainants son without any technique or prescription by qualified\ndoctor  indulging in unfair trade practice inasmuch as petitioner is not\npossessing any medical qualification\nand yet prescribing medicines  direction to the petitioners to close down\ntheir dispensary by the District Forum and upheld by the State Commission. \n\n \n\n  \n\n \n\n\u00a0 \n\n \n\nFor the\npetitioner : Mr. B.S.\nChauhan &amp;  \n\n \n\n  Mr. Vinay Garg, Advocates \n\n \n\n\u00a0 \n\n \n\n  \n\n \n\n\u00a0 \n\n O R D E R \n<\/pre>\n<p> \u00a0 <\/p>\n<p> \u00a0 <\/p>\n<p> DATED THE 25TH JULY, 2003 <\/p>\n<p>\u00a0 <\/p>\n<p>\u00a0 <\/p>\n<p> JUSTICE D.P. WADHWA, J.(PRESIDENT).\n<\/p>\n<p> \u00a0 <\/p>\n<p> \u00a0 <\/p>\n<p> This<br \/>\npetition has been filed by Dr. Baleshwar Prasad and his compounder who were the<br \/>\nopposite parties before the District Forum on the complaint of medical<br \/>\nnegligence filed against them by the respondent\/complainant. District Forum allowed the complaint and<br \/>\ndirected that petitions were liable to compensation of Rs.3.00 lakhs to the<br \/>\ncomplainant. They were further ordered<br \/>\nto shut down their dispensary working at Bhuli. Appeal filed in the State Commission was dismissed and the order<br \/>\nof the District Forum affirmed.\n<\/p>\n<p>Both the Forums<br \/>\nnoticed that the first petitioner Dr. Baleshwar Prasad was not having any<br \/>\nmedical qualification either in Allopathy or in Homeopathy system of<br \/>\nmedicine. His case was that he was<br \/>\ncompetent to treat the ailing persons since he was having a qualification of<br \/>\nR.M.P. (Rural Medical Practitioner) in Allopathy system of medicine. He is an intermediate in Arts.<br \/>\nThough he produced a copy of the certificate issued by the Counsel of<br \/>\nR.M.P., Bihar, District Forum has doubted the genuineness and correctness of<br \/>\nthe certificates. The case against the<br \/>\npetitioner was that while the minor son of the complainant was coming from<br \/>\nschool at 3.00 P.M., he suddenly complained of severe headache alongwith high<br \/>\nfever. The boy was taken to the<br \/>\ndispensary of the first petitioner for treatment. The petitioner No.2 who is the brother of the first petitioner<br \/>\nDr. Baleshwar Prasad and was performing the duties of a compounder, injected<br \/>\nmedicine. When there was no improvement<br \/>\nin the condition of the boy the second petitioner again administered 2nd<br \/>\ninjection. Again there was no<br \/>\nimprovement and the second petitioner advised the complainant to take his son<br \/>\nelsewhere for treatment. Immediately, the<br \/>\nboy was brought to the Bhuli Central Hospital but the doctor declared the minor<br \/>\nboy brought dead. This was at about<br \/>\n9.00 P.M. on the same day.\n<\/p>\n<p>District forum has<br \/>\nstrongly commented on the conduct of the petitioner and remarked that they are<br \/>\nfirst rate liars. Their statements<br \/>\nwere not relied upon. The second<br \/>\npetitioner was compounder and working under the first petitioner who<br \/>\nadministered the injection. It was a<br \/>\nclear case of negligence and has been rightly held to be so against both the<br \/>\npetitioners.\n<\/p>\n<p>Learned Counsel<br \/>\nhowever submitted that the District Forum has no jurisdiction to direct the<br \/>\nclosure of the dispensary being run by the first petitioner and which order was<br \/>\naffirmed by the State Commission.\n<\/p>\n<p>Unfair trade practice has been defined in Clause (r) of Section 2 of<br \/>\nthe Consumer Protection Act, 1986. It<br \/>\nis an unfair practice if a person represents that the services are of a<br \/>\nparticular standard, quality or grade or makes a false or misleading representation<br \/>\nconcerning the need for , or the usefulness of, any goods or services<br \/>\n[sub-clauses (ii) &amp; (vi)]. Both the<br \/>\nForums have found that while the petitioner did not possess even valid RMP<br \/>\nlicense, it was certainly an unfair trade practice. The second petitioner being compounder certainly could not give<br \/>\ninjection without any technique or prescription by qualified doctor. He works as a compounder under the first<br \/>\npetitioner. There is no doubt that they<br \/>\nare indulging in an unfair trade practice in as much as they did not possess<br \/>\nany medical qualification and prescribing medicines which they could no<br \/>\ndo. Under these circumstances, District<br \/>\nForum was right in directing the petitioners to close down the dispensary as<br \/>\nunder Clause (f) of sub-Section (1) of Section 14 of the Act, District Forum<br \/>\ncan direct the petitioner to discontinue unfair trade practice they were<br \/>\nindulging in.\n<\/p>\n<p> We<br \/>\ndo not find any error in the impugned order for us to exercise our jurisdiction<br \/>\nunder clause (b) of Section 21 of the consumer Protection Act, 1986.
