No.33806 of 2010\n                    NAVEEN KUMAR SON OF SHRI SHANKAR SAH,\n    PERMANENT RESIDENT OF VILLAGE- CHANDPURA, P.S.- NEEMA\n              CHANDPURA, DISTRICT- BEGUSARAI\n                                        Versus\n                                 STATE OF BIHAR\n                                      -----------\n<\/pre>\n<p>2   22\/09\/2010             Heard Mr. Rama Kant Sharma, the learned<\/p>\n<p>                 Senior Counsel appearing on behalf of the petitioner<\/p>\n<p>                 and learned APP for the State.\n<\/p>\n<p>                           Earlier prayer for bail of the petitioner was<\/p>\n<p>                 rejected twice. He is an accused of a case registered<\/p>\n<p>                 under Sections 498 A, 304 B\/34 of the Indian Penal<\/p>\n<p>                 Code. His Special Leave to Appeal (Crl.) No. (s) 1148 of<\/p>\n<p>                 2009 was dismissed at not pressed before the Hon&#8217;ble<\/p>\n<p>                 Supreme Court.\n<\/p>\n<p>                           The informant Santosh Kumar has married<\/p>\n<p>                 his daughter on 19.11.2003 with the petitioner. Out of<\/p>\n<p>                 that wedlock two issues- a son and a daughter aged 3<\/p>\n<p>                 and 2 years respectively were born. Allegation is that<\/p>\n<p>                 after marriage the petitioner and other family members<\/p>\n<p>                 were torturing the informant&#8217;s daughter in connection<\/p>\n<p>                 with demand of additional dowry. Ultimately she was<\/p>\n<p>                 killed on account of her failure to bring the desired<\/p>\n<p>                 dowry articles.\n<\/p>\n<p>                           Submission is that the marriage was not<\/p>\n<p>                 arranged so there was no question of demand of dowry,<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       because dowry is demanded only in cases of arranged<\/p>\n<p>       marriages. It is further submitted that the petitioner is<\/p>\n<p>       in custody since 14.12.2007       and for five months he<\/p>\n<p>       was granted provisional bail for treatment of his ailing<\/p>\n<p>       father and during the period of provisional bail he has<\/p>\n<p>       not misused the privilege of bail.\n<\/p>\n<p>                 The petitioner is the husband of the deceased<\/p>\n<p>       in a case registered under Section 304 B of the Indian<\/p>\n<p>       Penal Code. There is specific allegation against him that<\/p>\n<p>       he being the husband connived with other family<\/p>\n<p>       members and in that connivance the victim was<\/p>\n<p>       tortured and ultimately eliminated. The elimination was<\/p>\n<p>       only because of her failure to bring the desired articles<\/p>\n<p>       by way of additional dowry.\n<\/p>\n<p>                 Considering the allegation, I see no reason to<\/p>\n<p>       take a different view from the earlier.
