Dave, learned advocate for the applicant and Ms.Dhara M.<br \/>\n\tShah, learned advocate for the respondent.\n<\/p>\n<p>The<br \/>\n\tpresent application is filed by the applicant under Section 24 of<br \/>\n\tthe Civil Procedure Code seeking transfer of Hindu Marriage Petition<br \/>\n\tNo.52 of 2007 filed in the Court of Additional Senior Civil Judge,<br \/>\n\tGandhinagar, Camp at Kalol.\n<\/p>\n<p>It<br \/>\n\tis the case on behalf of the applicant that she married with the<br \/>\n\trespondent on 07.02.2004 and, thereafter, she has started residing<br \/>\n\twith the respondent at Kalol. It is submitted that initially, she<br \/>\n\twas treated fairly, but subsequently, the respondent started<br \/>\n\tharassing the applicant and, thereafter, she was compelled to leave<br \/>\n\tthe matrimonial home and  stay at her parental home. It is submitted<br \/>\n\tthat the applicant filed Hindu Marriage Petition No.414 of 2007 in<br \/>\n\tthe Family Court, at Ahmedabad for restitution of conjugal rights<br \/>\n\tunder Section 9 of the Hindu Marriage Act and moment the notice was<br \/>\n\tissued upon the respondent. With a view to harass the applicant, the<br \/>\n\tproceedings have been initiated at Kalol Court for divorce being<br \/>\n\tHindu Marriage Petition No.52 of 2007 by the respondent. Therefore,<br \/>\n\tit is requested to transfer the proceedings of Kalol Court being<br \/>\n\tHindu Marriage Petition No.52 of 2007 to the Family Court, at<br \/>\n\tAhmedabad. Mr.Dipan R. Dave, learned advocate for the applicant has<br \/>\n\trelied upon the decision of the Hon&#8217;ble Supreme Court in case of<br \/>\n\tSumita Singh Vs. Kumar Sanjay, reported in AIR 2002 SC\n<\/p>\n<p>\t396. <\/p>\n<p>The<br \/>\n\tpresent application is opposed by  Ms.Dhara M. Shah, learned<br \/>\n\tadvocate for the respondent by submitting that there is no much<br \/>\n\tdistance between Kalol and Ahmedabad and even examination-in-chief<br \/>\n\tof the husband, respondent herein is already over in the proceedings<br \/>\n\tbefore the Kalol Court.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocates appearing on behalf of the respective parties.\n<\/p>\n<p>At<br \/>\n\tthe outset it is required to be noted that the proceedings have been<br \/>\n\tinitiated by the applicant in first point of time at Family Court at<br \/>\n\t Ahmedabad  for restitution of conjugal rights under Section 9 of<br \/>\n\tthe Hindu Marriage Act and immediately, thereafter, the respondent<br \/>\n\thusband has initiated proceedings at Kalol Court for divorce under<br \/>\n\tSection 13 of the Hindu Marriage Act.\n<\/p>\n<p>It<br \/>\n\tis not in disputed that the applicant   wife is residing at<br \/>\n\tAhmedabad. Considering aforesaid, proceedings and even to avoid any<br \/>\n\tfurther contradictory conflicting orders passed by the two Courts<br \/>\n\tbelow, it will be in the fitness of things to exercise powers under<br \/>\n\tSection 24 of the Civil Procedure Code  to transfer the proceedings<br \/>\n\tfrom Kalol Court to Family Court, Ahmedabad with a direction that<br \/>\n\tboth the proceedings are heard together.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances and for the reasons stated above, the application<br \/>\n\tsucceeds. Hindu Marriage Petition No.52 of 2007 filed in the Court<br \/>\n\tof leaned Additional Senior Civil Judge, Gandhinagar camp at Kalol<br \/>\n\tis hereby ordered  to be transferred to Family Court, Ahmedabad and<br \/>\n\tis directed to be heard along with Hindu Marriage Petition No.414 of<br \/>\n\t2007 pending in the Court of Family Court at Ahmedabad. It will be<br \/>\n\topen for the respective parties to submit before the Family Court at<br \/>\n\tAhmedabad for expeditious hearing of the aforesaid proceedings and<br \/>\n\tthe same shall be considered by the Family Court positively.
