Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/12\/2009\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ------------------------------------------\n            Crl.M.C.NO.4032 OF 2009\n           ------------------------------------------\n           Dated 22nd          December 2009\n\n\n                         O R D E R\n<\/pre>\n<p>          Petitioners are the                       accused and<\/p>\n<p>third respondent, the de facto complainant<\/p>\n<p>in C.C.609\/2003 on the file of Judicial<\/p>\n<p>First  Class      Magistrate,                  Alathur     taken<\/p>\n<p>cognizance for the offences under Section<\/p>\n<p>326 read with Section 34 of Indian Penal<\/p>\n<p>Code.   Prosecution case is that                         on the<\/p>\n<p>night of 18\/5\/2003 at about 7.30 p.m, due<\/p>\n<p>to  the  previous         enmity,             petitioners     in<\/p>\n<p>furtherance of their common object beat<\/p>\n<p>third  respondent,          while          he       was  walking<\/p>\n<p>towards Kariyangadu               and caused grievous<\/p>\n<p>hurt  to  him     and        thereby            committed   the<\/p>\n<p>offence under Section 326 of Indian Penal<\/p>\n<p>Code. Petition is filed under Section 482<\/p>\n<p>Crmc 4032\/09<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>of Code of Criminal Procedure to           quash<\/p>\n<p>Annexure-I final report and the cognizance<\/p>\n<p>taken       and proceedings pending before the<\/p>\n<p>learned Magistrate contending that the entire<\/p>\n<p>disputes were settled with third respondent<\/p>\n<p>and in view of the settlement, it is not<\/p>\n<p>interest       of  justice    to   continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>            2. Third respondent appeared through<\/p>\n<p>the counsel and filed a joint petition with<\/p>\n<p>the     petitioners   stating  that  they   have<\/p>\n<p>settled      the  entire   disputes  and   third<\/p>\n<p>respondent      has  no   subsisting   grievance<\/p>\n<p>against the petitioners and hence permission<\/p>\n<p>is to be granted to compound the offence.<\/p>\n<p>            3. Learned counsel appearing for the<\/p>\n<p>petitioners, third respondent and        learned<\/p>\n<p>Public Prosecutor     were heard.<\/p>\n<p>Crmc 4032\/09<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>            4. Offence   under  Section  326 of<\/p>\n<p>Indian Penal Code is not compoundable       and<\/p>\n<p>hence        permission  cannot  be  granted  to<\/p>\n<p>compound      the  offence  as   sought  for  in<\/p>\n<p>Crl.M.A.6880\/2009. Permission to compound the<\/p>\n<p>offence sought for is rejected.<\/p>\n<p>             5. Annexure-I     final      report<\/p>\n<p>establishes that offence alleged against the<\/p>\n<p>petitioners is purely personal in nature as<\/p>\n<p>against      the  third  respondent. Annexure-II<\/p>\n<p>joint      agreement     entered  into  by   the<\/p>\n<p>petitioners and third respondent establishes<\/p>\n<p>that their disputes were settled amicably out<\/p>\n<p>of      court.     Joint   petition   filed   by<\/p>\n<p>petitioners      and  third  respondent  further<\/p>\n<p>establishes that consequent to the settlement<\/p>\n<p>third respondent has no subsisting grievance<\/p>\n<p>as against petitioners. Though offence under<\/p>\n<p>Crmc 4032\/09<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>Section 326 of Indian Penal Code is not<\/p>\n<p>compoundable, as held by the Apex court in<\/p>\n<p><a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008<\/p>\n<p>(3) KLT 19 (SC) when the offence alleged<\/p>\n<p>against the accused is purely personal in<\/p>\n<p>nature as against third respondent and there<\/p>\n<p>has been a complete settlement of the dispute<\/p>\n<p>between them, it is not in the interest of<\/p>\n<p>justice       to  continue the  prosecution  as<\/p>\n<p>ultimately       chances   of    a   successful<\/p>\n<p>prosecution is very bleak.\n<\/p>\n<p>            In such circumstances, petition is<\/p>\n<p>allowed.
